    This issue of same-sex marriage not being recognised is not just an outcome of ignorance, but also an outcome of a colonial/western mindset of a social and biological binary, when eastern cultures (like south asia) have almost always had a fluid relationship with gender and sexuality (even as seen in hindu mythology). it is genuinely disheartening to see this persist for this long when i and so many others deserve the same basic rights to love and marriage as any other person because it is human nature to love who you love.

      @@Rudra-rf5cn what do you mean "hamara hissa"? pehle ke zamane mein marriage was only considered to be something for procreation but then log pyaar ke liye shaadi karne lage. toh same sex marriage doesn't come under that issue unless we talk about love marriages in today's times. however, in ancient hindu texts, homosexuality has not been considered a crime or a sin or anything like that, balki in many cases, homosexuality has been seen in regular circumstances, for example lord ayyapa was born of vishnu and shiva (mohini's form showing gender fluidity). therefore, it has not been explicitly called to be anything because it is considered nature to love whoever you do. the material world is of less importance than the soul's and it's wishes.

      Because two "consenting adults" are not the bases for society.
      If you go to a prostitute and both are consent to have sex (by agreeing to the price and hour of service), does that mean you are now married to that prostitute?
      That is the difference between sex through marriage (which could create family) and sex through hook-up culture. You cannot equalize both with a simple nonsense like "consenting" and basic rights. You are human living in a human society, not a stray dog.

Marriage is a choice and a promise, a legally valid one. But that does not criminalise consenting adults to form relationships. "Consent" is NOT "nonsense".

    Even the Hindu mythology narrates stories of same-sex relationships and also mentions about the existence of transgender deities. The discrimination that the lgbtq community faces today in india is solely an outcome of ignorance. They can't get away with saying same sex marriage can't be legalized because it will hurt religious sentiments. Great to hear so many lawyers voicing their thoughts.     The ancient Indian text Kamasutra written by Vātsyāyana dedicates a complete chapter on erotic homosexual behaviour. Historical literary evidence indicates that homosexuality has been prevalent across the Indian subcontinent throughout history.
    Living in a country whose whole philosophy is of advaita, Upanishads which keep telling you that you are beyond this material body. These notions of gender were trivial things to fight for. It is victorian mindset where even the legs of table are covered, leave that of woman.

    I listened to most of the arguments made during the 10 days of hearing spread over almost a month and this argument from Guruswamy was the most succinct and the most compelling argument. She delivered a masterclass. It is sad to know that the majority of the judges were not persuaded and our brothers and sisters from the LGBT community continue to be treated as second class citizens.

    A society where same sex marraige is not recognised is a society which forces rape upon the person who is homosexual by forcing and social conditioning of the heterosexual marraige upon the homosexual person and thus to live with a heterosexual person.
    If a woman does not like the touch of a man, but if the parents of her are forced out of social and legal conditions to give her daughter to a heterosexual man, the legalised sexual advance of that man to his lesbian mentality based wife is legalised rape, which may be allowed by law but is injustice or adharma.

      but when I look at the other problems of the society like - women and children being raped and killed, human trafficking, illegal conversions, murders, robberies, communal riots etc....etc

Our culture have always respected love and have not bound them with any gender, Krishna se pyaar gopiyon ne bhi kiya tha aur krishna ke rang mein gwale bhi saje the.     Legalize Same sex marriage is not a problem for me personally, it doesnt mean that i support this Lgbtq+ idea. However, one cannot force this ideology onto someone everyone has their own rights and preferences so respect it. Also keep in mind that Western ideologies always not right. Most of the people think that "this idea is from western developed countries so it must not be false". Hypocricy is still there in the world.

    Basically her reason for legalizing same sex marriage is so that LGBTQ people can easily buy life, medical and home insurance like the normal couples (i.e husbands and wives) do .
    Why not just add/have a law to get those easily accessible to the LGBTQ community instead of legalizing same-sex marriage?

      One problem with legalizing same sex marriage is normalization of the LGBTQ views. Just like you're not supposed to force your religion down someone's throat why should the LGBTQ agenda be forced down people's throat . People want to be gay, great keep it yourself. You want to be a Muslim or Hindu keep it yourself.
      Don't try to change the law or add laws for your own selfish gains. You want traditional rights and norms you need to stick to traditional rights and norms.

    As per PC-PNDT ACT (undeveloped genitals by birth), SC forbade parents to decide for their kid's surgery in favour of a Son before 18 yrs. Such kids after 18 may have difficulty being a boy and engulf into mixed emotions to homo or hetero sex. They may have harmonal urge of a girl to love a boy i.e. the surgical boy will love a boy - So no question of "marriage is b/w a *biological* male-female " can avert these unconventional conditions, as by NATURE itself such babies are born.

      Biological sex and sexuality are different things.
      Sexuality is about what you are attracted to, so either same sex or different sex or both.
      Homosexual means same sex, heterosexual means opposite sex and bisexual is both.
      Sex is either male or female, but due to gender dysphoria, you do not identify with the sex assigned at birth. Hence, you undergo transition. These people are what we call transgender.
      Both gays and transgender are very different.
      You can be gay but not trans, or you can be trans but not gay. You can also be gay and trans.

    Legalization of same-sex marriage is actually asking for new constitution itself.
    It's not that easy at all.
    Getting married is one thing. We need to think about all other factors that comes later as well.
    As a single homosexual, i myself can't understand how I will survive in Indian heterosexual society. Getting married and living As married homosexual is definitely a nightmare.

    Todays Hinduism is nothing different from Saffron coloured Islam.

Islam prohibits Homosexuals. Hinduism does not! Period.
