      Irrelevant. No one but registered PO's have (or should have), access to licence plate information...The lot has 2 legal options: #1. Ask them to leave private property, and not to return. #2. Tow the vehicle from off their private property. Rules are no different than your/my private parking area...And Yes. Obtaining private driver info is illegal...

    They probably got it from your insurance company to be honest insurance company cell data like crazy. It’s a pretty heavy revenue source for them.

      Yes. Happens all over the country...Search "Everything Auto", or others for examples...Law is clear; Ask them to leave, or remove it from the lot...Many removal services will pay a fee for re-occuring businesses that keep using their services...

    This kind of lawsuit is long overdue. Our private information should be private!
    But the moment you buy a home or move... you get bombarded with junk mail trying to fool you into buying useless services, and the only way this can happen is if the post office or more likely the county office is disclosing your personal information to these sleazy businesses.
    And from my experience Florida is much worse than other states when it comes to disclosing your privat3 information to businesses that have no rational reason or permission to view it.

      “But the moment you buy a home or move…” That’s an interesting point you’ve brought up. The post office is prevented by law from providing mailing addresses but there is no law preventing them from contacting existing businesses about a forwarding address. Instead of filling out a forwarding address at the post office when you move, contact all your business dealings independently and you won’t have that problem. By filling out a forwarding address card, you are literally giving permission to the post office to provide that info to anyone who asks.

      That is exactly what I did not long ago, and still got a ton of junk paper mail. Inspite of immediately telling everyone that I setup service with that I do NOT consent to any kind of advertising nor sharing of my data. The only ones left in the suspect list is the county, or the postal service if they capture my private data from mail sent to my address.

      There are commercial services that collect publicly available property tax, registrar of deeds, and court filing information and sell it. Most of the interactions we have with any level of government is not automatically private.

      @@nospamallowed4890 The postal service is prohibited from selling personally identifying information. They are not the source. Your city, county, and state governments are another matter and what is public or private is a matter of local laws.

    Florida is one of the States which considers certain records to be public information. However, the Driver Privacy Protection Act, 18 USC Section 2721, was enacted to keep personal information private. According to the Florida DMV website, "the department automatically blocks personal information in all motor vehicle and driver license records that we maintain".
    What does personal information include? According to the Florida DMV website, it consists of "your social security number, driver license or identification card number, name, address, telephone number, and medical or disability information contained in your motor vehicle or driver license records". These data elements are prohibited against public disclosure by the DPPA. State law may also prohibit disclosure of additional information, such as emergency contact information and email addresses.

    The purpose of a license plate is specifically to identify the vehicle, and it's owner. As to using a camera and software to read a license plate, if that plate is visible from any public space, no matter where it is on a private space, it is quite legal to take that photograph. There is zero expectation of privacy. Had that vehicle been on a private lot, surrounded by a privacy fence, when the license plate was photographed, then they may have a case. But the instant the vehicle exited that space and went into the public street, that expectation of privacy went out the window. License plates are public information at all times. More likely any law that says you have no right to obtain that purely public information for a legitimate purpose will be tossed out.

    If they’re receiving information from the DMV, wouldn’t it be the DMV that is breaking the law? If a regulatory, government agency is providing the information, how is it illegal for the parking company to have the information to retrieve monies owed? Since states all over the country utilize license plates to retrieve owner information to charge the owner if they ran a toll, is that be illegal? The people, who park cars and refuse to pay, breached the contract between themselves and the lot owner. Doesn’t the person hurt by the breach of contract have a right to request information from authorities to proceed with common methods of retrieving funds owed? There are no nefarious reasons by the parking company, there is only some entitled car owner who believes he can steal services and get away with it. No business is safe if we allow such thieves to be able to operate with impunity.

    They probably have some one on the inside giving the info out for cash easly cross reference the planif and see when there tag was last looked up and by who and check to see if there was a formal request made

      So yeah, the law that they’re quoting is a law that prevents government agencies from giving away that information. And with this being Florida, it’s very likely that that is the case in this particular circumstance because of Florida’s open record laws. But in all likelihood, they probably bought the data from some other third-party. Private companies are not hold the same standard when it comes to exchanging that information likely they got the license plate number and address referred through an insurance company as they collect that same data and insurance companies are known for selling data, that’s actually literally the whole entire business model is knowing everything about you so they can determine how much of a liability you are in case of an accident.

    So you have the right to park and not pay but they don’t have the write to try to get your information to collect from you. I think your right should be voided if you fail to pay….

    No law against photo a car or license in a public parking lot or a private company parking lot i can walk down the side walk and take a photo of their car and plate and sell it

      So you didn't watch the video huh? Because 1:02 in they explain the photo has nothing to do with the lawsuit, it's the fact they took that license plate number and used a non-public source to identify the owner; which is a federal no no. Accessing DMV, etc databases comes with rules and regulations and allegedly they're not allowed to use license plate numbers to identify people. Which I think is a good thing. Do you have any idea how abusable being allowed to look up anyone who cut you off in traffic would be? Think about it for a second. "Driver Privacy Protection Act"

      @@GeorgeWashingtonLaserMusket It is public information in a lot of states not just I can pick up something you threw down like a coffee and run the DNA sample the average person can do that now, anything you do you are in public unless you are in your home and they can see what you do on the internet unless you have a VPN even than it is possible

      @@GeorgeWashingtonLaserMusket According to the report, if the parking lot got the info direct from the DMV, they are in violation. However, if the DMV sells the SAME info to a third party and the lot gets the info from that third party, the lot didn't commit a crime. Same info regardless, still think a crime has been committed? Also, without accessing DMV data, just how do you propose parking violations be handled?

      There still a law enforcement agency involved in providing the information... a privet company can not access tag information nor any information in NCIC or other secured governmental data base..

    Ooks yo me that they should be suring the DMV a d not the parking lot. I would think the parking lot would just put a lien on the vehicle no matter who owns it.
