Actual attorney here, you kind of described it correctly. 😂 When police request a search warrant they have to show probable cause for why the warrant is necessary. Here, the police showed probable cause to search his home because he was a suspected xxxx dealer and they were reasonably certain xxxx would be found in the house. However, the police’s real intent of the warrant was to find evidence of hit not 💉. Therefore, the warrant was not valid/legal. As a result, under the doctrine of the fruit of the poisonous tree, if police search a home illegally, anything found as a result of the search is fruit of the poisonous tree. Therefore, the bang bang was not legally obtained and cannot be used as evidence against the defendant.
You're obviously not a lawyer because a judge would not sign a warrant to go search for drugs on a murder investigation what he's trying to say is when you are friends with a judge you can talk any kind of b******* and get the judge to comply especially a crooked judge

I noticed 30 minutes in that it's near what look like projects? I also wonder if the kid lured them there, not only for it's isolation but there is at minimum 6 lanes of highway traffic, maybe more? to drown out the noise of gunfire. So sad, get out of there if you can!
You should find a way to leave there and find a peaceful place where you can live without the stress of being there.

You being a human being should be able to look into the eyes of the young man who did this, and sense that something is very wrong. that strong stare, is not natural. No dilation of pupils. Maybe they are mistaken about the one guys time of death. Maybe he lived for a while. The suspect being only 16 years old, out there with 3 guys all by himself, maybe they tried to rob him? Maybe it was self defense. ANYTHING is possible.(He probably had contact with someone else on probation)

Update: The Court of Appeals overturned the judge's ruling, and the Indiana Supreme Court rejected his appeal to them.

If a search warrant is for drugs and during the search of drugs they find a gun they must go and get another warrant requesting why you need to extend your search warrant to guns and ammo. If not you can’t take the gun. He’s free from unreasonable search and seizure.
So a “search warrant” isn’t for anything and anywhere on the property? It has to be specified what is being looked for and everything else is ignored?🤔
@@moxie9091 yep. However if you find something illegal you have to get another search warrant which is easy. You make a call to the judge and say while searching for this gun in the closet we found a dead body. We need a search warrant to now look for evidence of a murder etc. The judge will say go search and I’ll give you the search warrant tomorrow. Judges can issue them later detectives just need assurance they’ll get it later then they search. However when searching on a search warrant you can only look in places where it can only possibly be. For example If the search warrant is to look for a person who they believe is hiding in the house they can only search in places where a human can hide. They can’t search in drawers or purses or wallets or between couches etc then say oh look I found a gun in the drawer now I’ll get another search warrant to search for guns NO NO NO that’s illegal you can’t search in places where the original search warrant can never possibly be. No different than an immigrant applying to get a F1-student non-immigrant visa to go to College in the U.S. and return back to her Country after graduation but her true intent is to actually come marry a U.S. citizen and adjust her status to permanent residency as a K1-Visa Spouse of a U.S Citizen. That’s illegal and a life time ban from entering the U.S. ever again. Same thing with Warrants. You can’t falsely get a Warrant with intent of entering there home for something else.

The judge threw out the guns because the warrant was for drug dealing and the law says you need to say what youre looking for specifically on a warrant. As sad as it is, the cops did bad work and the judge made the right call.

My son is in law enforcement. Regarding the search warrant, it is essential that you can only search for what is in the warrant. I understand that if you find something else it is considered "fruit of the poisonous tree ". Not admissible in court.
Uh,yes, what you're looking for, has to be stated in the warrant, uh, the city/state/county where I live would tell you the very same.
But what if you uncover a dead body or a child kidnapping or anything along those lines?

You can only search designated areas mentioned when the warrant was submitted.
however if in the scope of that search, you find something you would have found legally behind that search warrant& in the area/s the warrant designates & that you weren't specifically looking for, then
you don't have to pretend you didn't see it.

It’s not hard to see why the evidence was thrown out. The cops lied on and about the search warrant. Yes it suck’s when killers get away, but you can’t be deceptive as cops and expect things to always go your way. Nobody’s rights should be violated in order to solve a crime
