Artical 142 के तहत तलाक मिल भी जाए लेकिन यहां एक अहम और कामन फैक्टर है, वो है प्रॉपर्टी को लेकर। एक कपल ऐसा है जिस में पति ने अपनी सारी संपत्ति अपनी पत्नी के नाम कर रखी है तो Artical 142 के तहत तलाक मिल गया तो ऐसे में उस प्रॉपर्टी का क्या होगा? उस पति को उसकी प्रॉपर्टी वापस कैसे मिलेगी? मिलेगी भी या नहीं? अगर मिलती है तो कितनी मिलेगी और कैसे मिलेगी और कब तक मिलेगी?

Several women are there existing who live a very painful life. They sit in a different country and support their husbands family and end of the day they are been asked after all the adjustments from their husband and in-laws ' what have you done for us'. A girl, a lady who gives away her age, youth, health for serving a gent must be worshipped like goddess. She works, cooks takes care of ur home and almost everything in what sense she is not supposed to get alimony.
When a married couple start a life and if incase they stay in a rented house payment is made to the landlord. Then why no payment for serving as your wife making adjustments and sacrifices.
Women population in total is very less they must be respected for what they are. End of the day a man takes birth from a women not from a gent.
So if any rights are there it's only for women not for men.
Majority of women suffer due to husband's tantrums reasons are many drowy, status, etc etc. Why women is blamed why are they not respected for what they r giving.

Indian courts never grant decree of divorce to the husband by one or the other way intentionally whereas wife can get divorce in Indian courts very liniatly by taking her own wrong advantages. Court never find the emotions and limitations of husband. This is same for Indian courts

Courts must identify a timeline...cases should nor be ground. Its part of lawyer's divorce packages. Give them divorce and cases can be continued on humanatrian or criminal ground.
Better option
This ground is more prominent if both parties put various IPC sections against each other, its never retrievable. Award them divorce first and punish after court's proceedings. But let them live first.

Dahej kanoon, DV, 498 dekhte, shadi karte samay, ya shadi se pehle stamp paper par written agreement, terms and conditions saaf saaf likhit mein, shadi kaise hogi, kharch kitna Kiya jayega, ladki ladke waalon ki traf se, ladki joint family, ya saas sasur ke sath rahegi ya nahi, etc etc, shadi ke baad dispute ho to kya remedy hogi woh bhi agreement mein ho, divorce Lena, dena ho, to apas mein kaise settle karenge, agreement mein hona chahiye. Shadi mein kya liye Diya jayega, woh bhi pehle hi agreement mein hona chahiye. Court police stn ke chakkar nahi honge, aapsi sehmati se talaq, maintenance bhi agreement mein ho, yeh aapsi personal agreement dono pati patni, unke parents dono agreement sign kare. .

Ye sab court me valid nai h. Kyunki as per Indian laws hindu marriage is not contract but is a sanskaar. Therefore not governed by any contractual bindings. Prenuptial agreements are not valid in the Indian courts.

He can file case of section 9 of hindu marriage act ( restitution of conjugal rights ) this means either husband or wife wants his / her spouse back in their life they can go for this section and can show the court that they r not interested in divorce 😊

Why only Supreme Court has discretion to use Article 142? How many people can go to Delhi and afford the fees of Supreme Court Advocates? Lakhs of couples are staying separately without getting formal divorce. Concept of family courts and period of 6 months should be scrapped.
