    I took notes, thank you for clarity on the basics of Trusts! No probate! I now can explain exactly what I want my rule book to say with the help of my lawyer. I am loving the idea of TRUST automatically shifting control for me and my spouse if we get sick or upon death. God bless you!

    I am a 51 year old retired veteran who is now a 2L in law school. I am currently taking my T&E class, and this was very helpful.

      Lol - an excellent and relevant point (real life v. exams).
      I plan (and pretty much have a job waiting for me) to work in the DA's office in Alaska (where I was stationed and still have a house) - and I mention that because this isn't going to be my "field of expertise" - but, that said, having an experienced and articulate attorney break it down so that even a layperson (or, worse, a law student, lol) can understand, was very helpful.
      I wish you the best in your practice and look forward to seeing more of your videos to help me better understand this important aspect of the law.

      To add:
      I retired from the military and gave great thought to what I wanted to do. For brevity I'll keep this short:
      1) I wanted a job that elevated my life.
      2) I wanted a job that would help financially secure my future.
      3) I wanted a job that when I came home at night if I told my wife what I had done that day that she would look at me with pride and think "this is the man I married"
      I then picked "Working the DA's office" - and we plan to return to Alaska (our home) and that will be my second career until I finally "really retire."
      I thank you for your kind words, and as my 2L year closes I now know "I'm going to make it" - and, yes, I am also very hopeful as to my future and glad I have made this journey.
      Thanks again for making this video - and I'll keep an eye out for more that might fill my brain with useful knowledge.

    Well I arrived at this video by accident as I was investigating financial investment trusts but I've learned about another type of trust that I've been pondering for a while as I need to put something tangible in place before its too late, even just a simple will. I was unfortunately mesmerized throughout by the beautiful styling of this ladies hair, pure class. Hopefully I'll not be sued for saying that as I'll have no assets to put in my trust if that happens 😢

    This is excellent. I'm not even all the way through and I'm so glad I found and am watching it. You break things down in an easily digestible way. I'm a lawyer, but not an estate lawyer, and I wish all lawyers were capable of this kind of presentation.

    This lovely lady explained this SO concise and simply I could cry. I took a wills and trusts class and I had a basic understanding of it in general, and though I liked my teacher so much she convoluted things a bit for me. I dont think I fully understood the materials. This was explained so well that a ten year old would be able to understand it. THANK YOU so much.

    Thank you! You just gave me more info than I got from my lawyer when I created an irrevocable trust. I need more info on funding it and I had no idea the trustee has to pay taxes on the trust.

    Been there. It's a good thing. There is a lot they assume and don't tell you. Later can become quite complex and painful. A lot of 'if this happens....'. I'll still get one, just with a lot more details in it. A lot.

    Thanks for the awesome, simplified overview. After watching numerous videos to acquire info, this one definitely clarified the most info. May I suggest for the future you identify jurisdiction and how broad your info applies geographically? States and countries vary widely I've now learned.

      This information is generally applicable to how trusts work in the United States. That being said, I would never advise anyone to try to draft a trust themselves or to do it online without specific legal advice from someone qualified in their state.

    In a case where a fraudulent Trust was created through Undue Influence & Lack of Capacity: Let's say the document is determined to be VOID by the court and the valid pre-existing Trust is accepted as the correct one. How do the beneficiaries then collect their rightful inheritance? Does the probate judge order the stolen assets to be returned and distributed according to the valid Trust document terms? How does that work? It gets extremely complicated when there's a 'bad Trustee' who is adversarial towards the beneficiaries and steals all the Trust assets.

    what if you already had a will made but now would prefer to to have a living trust. Can you have both? I prefer the house to not go through probate as my invalid sister is living there and would like her to remain as she is one of the 3 beneficiaries.

      In almost all instances, even when you have a trust, you also have a will. However, it is usually a specific type of will called a "pour over will." This is something to discuss with your attorney!

    I want to make a trust with a clause that it will change according to my will when I pass. The reason is I want to be the beneficiary whilst alive (property trust/holding trust) but upon my death, I would want to change it. So, do I go for the revokable trust then? For now?

    So im in a situation here. My grandpa own half a house in Arizona and put the house in his trust to give to his family. Now he has passed and the other owners of the house claim they own 100% of the house now. Is that possible?

    your video is very interesting and easy to understand the initial process of a trust.
    I have a couple question if you could clarify, my appreciation in advance.
    1. I read that in a Irrevocable living trust changes are not allowed. Is that true? So, if I have a property in this kind of trust, I can not sell the property or make any change to it? what kind of restrictions are included in this kind of trust?
    2. If husband and wife do a trust can they be the trustee of each other in a revocable or irrevocable living trust? Can one be the beneficiary of the other?

      In some types of irrevocable trusts, you can make changes. This is a specialty area that attorneys like myself can help in. Spouses can be each other's beneficiaries, but it needs to be set up properly if you are trying to achieve asset protection.

      SHE IS LIEING to you, it is sad to see that people commenting have NO CLUE , what they are listening to, and refuse to do their own research to verify that she or any so called Trust lawyer is telling you the truth, The Blind leading the Blind as they say.... ?? THEIR is NO estate Trust that protects one's estate because YOUR so called estate has NEVER been recorded or registered properly on the land. How can you verify this information shared, by looking at your Property tax bill and the Fictitious name on said property tax bill. #.1 pay attention to how many acres you pay tax on? Land is property, if you see ZERO acres of land that you are paying taxes on, that is a MASSIVE red flag? . #2. The name as written on your Property tax information is NOT YOU another MASSIVE RED FLAG. Your FULL LEGAL NAME includes in the following order... Your Given Name and your last name. Your given name is your first and middle name IS your given name, then your Last/fathers name. Does not matter if you are married or single. So for example, Your displayed name is Louisa Keddell, now if your name was written in all caps e.g. LOUISA KEDDELL - this all caps description is not you, it is a fictitious name created by someone else, and it is fraud against you. If you have a middle name? lets say your middle name is Clair?

    This was a great introductory video. I am 50 and really have to think about financial planning. So, is the first step creating a trust with an attorney? Then what? after that do you change your bank acct name to the trust name? Your house? Change your 401k?

    me and my dad own a house 1/3 for him and 2/3 for me thats the partition on the dead or the tittle owner, he make an revocable living trust, he make my brother and sisters as his beneficiaries im not mention or included on his trust, now can i refinance the property for renovations?

    If there are two people in a trust and they can not come to an agreement such as in selling or not selling a property, how is the decision made? Who can "break the tie"?

    How can we tell if my mother had a trust? My brother is the executor of her estate and refuses to share any information or provide paperwork. Also, If my mother’s IRA and bank accounts only have my brother listed as the beneficiary does that mean he gets to keep the money or does it go to part of the estate I’m not sure and I am not sure how to find out.Thank you for your time

      You need a lawyer now to write a letter to the jerk brother. You must see all the info. All that money goes to your brother, yes. But he is supposed to divide it with you.

      Welcome to my world! My older sister works for an attorney and she had my parent’s Trust “updated” a few months before my Father passed away. She had my brother’s name removed from the Trust so he wouldn’t lose his inheritance to the bankruptcy case that he was currently involved in where he lived out of state. Her boss, the attorney had no idea that my Father no longer had the capacity to make sound decisions, since his office was 4hrs away. To make a long story short, she had control of everything, she laughed at my copy of his will stating it meant nothing! I did receive a few items, mostly things that no one else wanted. My three boys have been told by their Grandpa that they were going to receive certain things when he passes, they received junk no one else wanted. My siblings had been discussing things for months behind my back, unfortunately they are now dead to me. I work with several people who have went through the same exact thing. Same story with different people.

      You might talk to an attorney. I went through probate today and they asked if there had been recent changes and if my dad was in sound mind when he set up the trust. I’m sorry that this has happened to you.

    If a joint bank account (held by husband and wife) is placed into an individual's trust (say the husbands) can both husband and wife write checks, withdraw money, etc? Or to do the would the checking account have to be placed in a joint trust or and individual trust with husband and wife as co trustees?

      If properly put into the trust and both parties are trustees of the trust, there should be no issues with operating as you would normally.

    If you have property in multiple states, can your trust include those or would you need to create trusts in each state?

      With a properly drafted trust, you can place property in multiple states inside. There may be benefits from having separate trusts, but that is definitely all a conversation to have with a GOOD lawyer.
