Mkhwebane's legal representative Adv. Dali Mpofu says her suspension is unconstitutional

- Suspended Public Protector Busisiwe Mkhwebane's legal representative Advocate Dali Mpofu says her suspension is unconstitutional because it happened before the process to remove her started in Parliament. Mpofu has sought to convince the court that because the current Section 194 committee is not a removal committee as contemplated in the Constitution, its existence cannot be used to trigger her suspension by President Cyril Ramaphosa.
Mpofu says the constitution provides for possible suspension only after the commencement of the removal committee. He says the suspension is unconstitutional because there is no clarity on when the commitee's proceedings started as different dates have been given as commencement dates.

Mpofu’s interpretation in that constitution is above almost everyone’s level and is amazing how they can be confused with such🤦♂️they seems not to be understanding

I have said in this same forum a few days ago, that the problem of Adv. MPOFU is that he is intelligent and reads a lot, but fails on matching the law with circumstantial facts. One one this problem is that he spent a lot of time speaking, but then, the Judges quoted the way the PP started her application: "...in behalf of the PP..."! Therefore as the Judges said, (this wasn't today) she didn't write in her individual capacity. However, Adv. MPOFU was saying the PP Office shouldn't withdraw the application because it is not part of the process. He was write in the way the law states, but WRONG in the current fact. Responding directly to your comment, the only one who doesn't understand is Adv. MPOFU himself, in such simple matter. What is WRONG with Adv. MPOFU and MKHWEBANE? The impeachment and the suspension processes are against her in individual capacity, but wrote to court on behalf of the PP OFFICE! Was it a way for the PP Office to pay the legal costs?

Adv. MPOFU seems to have been giving the qualification for free without any competence just in order to defend these people who are corrupt, incompetents and against the President! Let us see how far he will go! I am concerned that he may win this matter with regarding to the fact the PP OFFICCE not be a part of the matter in court and as such unable to Withrow.

Please, once in you life, accept a fact! She is an INCOMPETENT and every step she tries the more INCOMPETENCE she reveals to us! Adv. MPOFU tried his best, but he should know that it was a waist of time on alleging that the suspension was UNLAWFUL! I did say in this forum that I was expecting to see how her application was made to the court in order to make a judgement on eventual INCOMPETENCE of the Action PP. Today the World saw the Judges reading the suspended PP's application. She applied writing " in the behalf of the PP Office...", therefore she didn't acted in her individual capacity. What a shame! She is under an impeachment process against her, as the individual, but apply to the court as an INSTITUTION. As an Adv. she should know that Institutions are not impeached! This woman is not ONLY INCOMPETENT, but we should consider submitting her to a mental medical evaluation. The PP OFFICE must request her to refund all expense so far incurred for her in courts. By the way, the acting PP must have been part of this matter alongside her.
