- The plaintiff parked her car at her boyfriend’s house, and one night during a rainstorm, a branch fell on her vehicle and damaged it. The tree is half on her boyfriend’s property and half on the defendant’s land, so she’s suing the defendant for half of the insurance deductible. The defendant thinks the plaintiff is trying to extort her because she didn’t say anything to her until five months later.

I disagree. Plaintiff said her insurance paid for the car damage. I'm sure that policy has her assigning her right to sue to the insurance company (subrogation) so they can get reimbursed from the responsible party. Sounds like a double dip to me.
total damage was 6k. she paid 2k of that out her own money. so she got 1k from her boyfriend and 1k from the neighbour.

I feel like this judge is nitpicking and bipolar with a lot of her cases and her rulings are based on her moods only. There was a similar case I’ve seen before where someone’s car got smashed by someone’s tree branch also during a storm but she ruled in favor of the defendant because she said it was an act of nature only not by the homeowner. Also the plaintiff isn’t even out of pocket she clearly stated that her insurance covered it! So she basically got free money!
It’s cos the tree was dead and therefore the responsibility of the defendant to remove the hazard. The defendant can sue the city if the negligence was on their part
@@KonstantinaVlahos I understand that part it’s her responsibility but I’m just saying I’ve seen cases similar to this case where she ruled on the defendant because she said it was cause due to nature not intentionally by the defendant. Here, it was caused by nature to, a storm but she ruled against the defendant.

I've noticed in the comments everyone is going on about an act of God (or act of nature for atheists) but this wasn't, this was an act of negligence since the tree was dead and had needed to be cut down for some time...

This happened to my mom not too long ago. We moved to AL and one day it started to get extremely windy outside and the next thing we knew a tree was on top of her car. I talked to the neighbors and found out the tree was dead. They’ve known for years because they had someone come out to inspect it, it had also been struck by lightning. My mom’s car held sentimental value, it was my deceased grandparent's car. The car was in good condition. After the damage from the tree, it was totaled. My mom did not sue but she was disappointed that they didn't offer her anything.
Your mom's situation differs because the owners knew the tree was dead.

She got money because the defendant was on notice that she had a dead tree for over a year. At that point she should've gotten the tree taken care of because it became a hazard. Granted, she was waiting for the city. However, she could've taken action herself and hired a tree trimmer and filed a suit against the city for reimbursement.

I don't think that the defendant should have been half responsible for the plaintiffs deductible and definitely not her survey I think instead the judge should have ruled that she was half responsible for what it would have cost to cut down the tree, the reason I feel this way is because even though the plaintiff's boyfriend didn't know that that was half his tree ignorance doesn't excuse you from your responsibilities and he did absolutely nothing to take care of the tree or rectify the situation, the defendant may have gotten lucky because half of the deductible may have been cheaper than paying for half of getting the tree cut down I'm not sure but I understand why she didn't hire someone to cut it down considering it was entangled in the telephone wires.
OMG - they were allowed to hire just anybody to cut that tree down???? If those are indeed electric power lines and not phone or cable, that would be EXTREMELY dangerous and should only be done by tree-trimmers certified by the electric utility.
