I have gone through all comment before I decide what to say, critically the Judge needs to ask few question and needed to be backup with evidence 1. Was there anything else in the container, parked with a BROWN CARTON and A GREEN GLASS BOTTLE, how was the HONEY PARKED? 2. Did Yinka's ant show up on the last day of loading or was she present every time they loaded the container? 3. Did Yinka/her Husband inform (date) Oretide when they learned that the shipment had arrived in the US? 4. When were they made aware that the package contained ALCOHOL? When did they learn that there will be shipping container examination? 5. When did Yinka or her husband (date) actually see the goods? Was it after the ALCOHOL'S DESTRUCTION? When did they inform Oretide that alcohol was discovered in the shipment? She also noted that the beans weren't separated and a BOTTLE of honey was gone, was it AFTER OR BEFORE YOU told Oretide about alcohol 6. Were Yinka or her husband ever seen the alcohol bottle weather images or video before they were destroyed, or were they just shown this image (of the broken glass bottle) shown in court? 7. Yinka: HOW MANY PARKS of ALCOHOL BOTTLES WERE FOUND? Did the US customs officer rearrange or offload the goods in the container for inspection? Was it discovered inside (at the back of the container), in the middle, or by the door? 8. Oretide: Did you completely fill the container with nothing no space left? Did you take pictures on the last day of loading to send to Yinka? Can you recall when and where you filled the honey bottle? This questions will give clear picture of how this happened and question 7 & 8 tell us who loaded and how the ALCOHOL got into container. If the questions are answered honestly and with sufficient evidence, neither Oretide nor Yinka need to tell us the truth because both of you will lose. For example, if Oritide can lose her shipping licence to the US, why would she load contraband? However, if Yinka is only losing some money for the destruction of the contraband ALONE, this reveals who is playing the game. AWESOME JUDGE FUNMI, It unfortunate that this is the way I will learn about a great business opportunity without spending money or attending a class. MA GIVE YOUR VEDIT!!!!!!
According to the defendant(from the first episode) the missing honey and branded stickers were reported 2months before the alcohol was reported. And that's so suspicious. She said she didn't want to disturb Oredite that's why she didn't report immediately. 🤨 so it looks like she's now ready to disturb 2🤷♀️

Lot of lessons to learn here 1. First, the problem started when different suppliers were asked to bring goods instead of Oretide alone. Had it been she was the only one who sourced for the goods in Nigeria, she could have easily been held responsible. 2. Second, what happened during the process of loading? Could it be that those who loaded the container did a mix up or something because this always happen in our everyday lives. Mix ups always occur in businesses that has to do with moving things. 3. Third, I think Oretide got vexed with their attitude at a point when she was checking the goods brought for her and that sort of affected thorough checking of other things that was brought from other sources. It such a pity 🤦🏽♀️
Oretide is at fault forget that fact that goods comes from different sources but, Oretide loaded the container and later she stop picking her this two points alone disqualified Oretide

So many observations! Yinka's aunty knows somethings, her body language shows it. Oretide has anger issue, which is why they are smarter than her, why block ur client cos she is insultive, how many of ur clients can u block. Yinka should know that u win some and loose some, don't try to be smarter than ur teacher, else he will use ur weakness against u and leave u halfway. Finally, Yinka should let go of this issue cos she got everything, except that there was alcohol there, she should use this as a learning curve and forge ahead. As for Oretide, if u know u don't want to eat meat, don't use ur teeth to share it. Next time, if customers don't buy everything from u, warn the customers and let them know that anything that happens to their containers, they will bear the consequences. I pray Judge Funmi handles this case with wisdom.
Part of the lessons here is that the services of lawyers should be developed in Nigeria. We often enter into agreements without legal considerations and backings. The result is that things get messed up and everyone gets bruised when things go wrong.
I think the shipping company has a big role to play in explaining how their ship managed to stop over in Ghana, whereby alcohol was loaded in an already laden container. They need to explain how the locks to the container were breached, and someone somewhere managed to load contraband items (which probably had already been singled out for destruction at the Ghana Sea Port) and perhaps, had taken out some legitimate goods and replaced them with the alcohol. If padlocks were used to secure the container, Oretide, being the defendant, should be able to tell from pictorial evidence, any differences in the locks on the container when it finally arrived in the US. The agreement for Oretide to load 90% of the goods on the container was already breached ab initio, and more or less voided the transaction. This alone could have brought about some degree of resentment in her towards her client, besides the subsequent insults from both Olayinka and her aunt. Any other transaction would just be fulfilling all righteousness. The plaintiff, Olayinka Emmanuel alongside her husband and the Aunt cannot be blameless, as they all failed to sing out in time about having found alcohol in their consignment. It took them almost two whole months to reach out to the defendant, even when they clearly had the breakdown of the contraband items on paper, officially and also had along the line, gone ahead to pay for its outright destruction. How would you destroy contraband goods without reaching out to the person who supposedly shipped them in the first place, simply because your relationship had already suffered some strain? If the husband still had open access to the defendant, Oretide, he should simply have raised a lot of dust while the case was still hot, except if they know something we don't, and don't want to reveal. Both parties (the plaintiff and the defendant) in my opinion are being economical with the truth. They are only treading with caution, and just wouldn't want to assume full responsibility for any of their lapses and shortcomings, so that neither of them would eventually take the fall for service rendered unsatisfactorily. May God grant Judge Funmi the necessary wisdom to unearth the truth about this case and bring it to a final wrap.🙏

Wow, this case is really an eye-opener. I liked when the judge asked the oretide lady if it was her first time in the business of exporting. She said no, it's her 2nd time, meaning she still does t have the experience. The oretide lady is looking tensed to avoid paying 3.5M, but I still feel she still has something shady.

What a case!! Very eye-opening. In this 2nd part, I believe the plaintiff and her family. Oretide admitted that she did not check everything that was delivered to her. She said how can she be checking everything? 17:5524:00 She also said that once contraband is in the container and once everything is not sourced from her, she won't use her FDA, yet paper work was 100% in her name 13:20. In this 2nd part, I'm standing by the plaintiff. Oretide also seems to be angry that though they agreed for them to buy 90% of the goods from her, they only bought 25% from her 24:00. She has very poor customer service because she blocked her customer and her aunt 20:4522:44. To me, Oretide is at fault. She has done this only once prior to the plaintiff's, yet before being asked her history with exporting to US, she kept on saying she knows the business. She's a newbie trying to appear like she's been exporting to the US for years 22:59. Can't wait for the verdict. Got to be extremely careful and prayerful when dealing with Nigerians 🇳🇬 either in Nigeria or outside. Such a negative image.

I will respond to this as a business person myself.It’s much easier to keep a returning customer than get new customers. There’s no reason why oretide will use her money to buy alcohol and load in her customers container.even though what she bought is one naira , the question is what will be her gain ? There’s no evidence the alcohol was actually in the container except there will be more documentation to support this. And again why is the other supplier not been held to ransom.

The origin of the alcohol is GHANA . I checked it myself … club beer . When you had an initial agreement with the defendant , why did you switch half way ? All the suppliers that supplied goods loaded in that container should be sued as well . Upon receiving and opening your container why didn’t you make a video or picture . Of the alcohol in the container? That would have been a perfect evidence

Judge Funmi needs to ask the woman that loaded the container for what we call the PACKING LIST. This is an official document needed to ascertain the contents of the container and it is compulsory to declare this . I live in Australia and this is what I have been doing for the past 6 years. I think she’s not telling the whole truth. I can even see that she’s a bit nervous.
She is just bitter that the lady did not source 90percent of the items from her as earlier discussed amd decided to be vengeful. She was paid to be responsible for the loading, which she admitted that she did not properly do. That is negligence on her part and she should shoulder that of the damages. Yinka though should have learnt the business first by allowing ireti to do the first sourcing and shipping and then take it up from there but she was playing smart I guess to cut cost.
...but how do we explain that they only contacted Oretide two months after destruction of the contraband? No one keeps quiet after spending that much on destroying contrabands that he/she had no prior knowledge of. I can't wait to hear the judgement on this case.

The defendant responsibility was to double check all that was brought to her. For her to say she couldn't check all cartons to know what's inside is negligence cos the plaintiff must have paid her for loading the truck.

What are the companies names of the cartons goods bought by the complainant before they were loaded by the defendant?

Olaritide______knows about the alcohol in the container, that's how they did, they will load to you something you did not purchased, after you successfully clear the container with unknown risk, the owner of the alcohol will call you and start telling you that he's coming to carry his alcohol and Olaritide will also call you to inform you that she used the remaining space in the container to load the alcohol so that it won't be a wasted space, for you to accept payment from the owner of the alcohol in USA. Olatide will be well paid by the owner of the alcohol and the owner of the container will be compasated. That's their GAME

That’s actually incorrect. Her contract was not to inspect the goods. Nothing went missing from the order. She kept the plaintiff informed with everything that was delivered. She loaded the container. Plaintiff chose to use multiple sources. When you order something to be sent through DHL, they don’t inspect the good your delivery. They just ensure it’s delivered

If you travel they always ask did you pack your suitcase. If something is found you cannot now say my best friend helped me pack. She needs to be held accountable as she was the one meant to be doing the checks regardless of where it is sourced from.

The case seems long but the main problem Is from the person that has access to the container before it leaves port. The agent is the main problem here.. The only verdict that can favor planitif is if there is full picture or video that link the container in question if not the case will be dismissed but the main problem still lies with the agent because she plays smartness with importer. Negligence of duty is what caused her problem. She decided to shine her eyes away from monitoring the full loading

Register with Nigerian Export Promotion Council , attend online and offline capacity building workshops, before you export , Export is technical and you need to be skilled to export.
At the end of this case arguments, it’s base on the alcohol being loaded by oretide or not.. The plaintiff can't plant alcohol in her counter. The custom will have to clear the container so clearly that thing was planted from oretide side either by one of the people loading. I am a Psychologist and have watched the whole Video now here are my observations. 1: The Dealer from Nigeria knew exactly the Field of Business in exports and was the only one with the Locks of the container. 2: The fact that she wasn’t the only one bringing in items in the container, would have made her check the packages more Carefully to avoid Wahala , if it was a case of drugs by now she will be having bigger issues. 3: There are chances of her wanting to cut a side deal from another client to top up the Gain on her own side since she knew exactly that the container was half way loaded. Now the name of the Alcohol or origin of the alcohol isn’t a key point, simply because Many people export different goods to the overseas. 4: No other Person had access to the Container, when the container was been closed she should have video recorded the closing of the container. She knew how she will avert the case when issues follows up simply because she’s in the game for Long. 5: From the records they both have alcohol wasn’t included in it, which could state in my view that the client is on a safe side because she wouldn’t magically put the alcohol in there. What ever happened to that container could be from Nigeria 🇳🇬. 6: From the pictures in the video showed in court the alcohol was in a Bottles then packed in a Carton. How would you inspect cartons and packages without hearing the Bottle Sounds? Correct me when I am wrong but I believe that even in a Crate Bottles make sounds. 7: The client Needs to show a prof of the Documents sent to her in USA 🇺🇸 before they destroyed the alcohol. One Good thing about overseas is that the don’t joke will Mail ✉️ and Post, especially in matters like this. On the Clint: Your Huge Mistake was not calling back to quickly inform your dealer of the issues at hand and waited for more than a Month. Giving the facts that the Law authorities over there are holding you accountable, a video also was expected. 2: You had access still with your sister and so when your dealer wasn’t responding what stopped you from asking your sister to visit her shop ones more? Since when things were moving cool she was at her shop to inspect and deliver items to her. With this in mind; i feel the cost should be a shared value between them both. With the Dealer paying more of the percentage. In her own words in the First Video the dealer Mentioned that she had to clean 💰 some Hands, 5k,10k & 20k. As an accredited Exporter you have the whole documents and access of exporting the goods, since you have charged your Clients. The hands you washed what exactly was it for? God Bless you Your Honor! 'Hand-washing' is a big problem in Naija. Bail, for example if free, but you ain't getting out without 'hand-washing' or knowing some big shot. 'Receiptless' payments to officials everywhere.

One other issue that beats me is that whenever there are seizures by the United States Customs and Border Protection (CBP), more often than not, the package/luggage is opened in the presence of the recipient/owner. And all this happens after the package in question must have passed through their ultrasentitive scanners without the need to breach the lock(s) of that package. There are always surveillance monitors and closed circuit monitoring systems in and around the ports, so every detail is more or less captured for record purposes, lest anyone accuse them of planting the contraband item(s) themselves. When Mr. Bamidele Emmanuel mentioned that the US Customs had phoned to invite them over, it was on a Saturday, and they claimed that they had found alcohol in their container, to which the Emmanuels refuted. 0:28 and 16:00 It really would be unethical for the US CBP to breach the locks of a recipient's package, even when it's high risk without the presence of that recipient in question, and also, provided that the recipient hasn't gone into hiding/is on the run. But then again, I guess in some cases, they reserve the right to do so, especially when the recipient isn't within immediate reach. What the Transportation Security Administration (TSA) would normally do is to first break the locks and then, leave an official document with the breached locks attached, stating that they had carried out an inspection on suspicion of a contraband/illegal item(s). Well, I also want to believe that all this is based on the fact that the TSA have an already prescribed Guidelines and Procedures document clearly spelt out, in a bid to serve as a forewarning to would-be shippers.

The deal has already been broken when the plaintiff started buying things from other people.... Any other thing found in that container the defendant will not be held liable, cos at that point she no longer knows what is packed or not even if she repackaged some goods or not. Everyone who packed anything in that container should be held liable for the damage

This case is complicated o! I'm just wondering how justice will be served. Oretide loaded and should've inspected everything before loading knowing fully well that her name was on the documents. Those doing the packing should have called her attention because they know what to pack and what not to pack. It's her faults and that of her workers who packed without checking. The origin of the alcohol is GHANA . I checked it myself … club beer . When you had an initial agreement with the defendant , why did you switch half way ? All the suppliers that supplied goods loaded in that container should be sued as well . Upon receiving and opening your container why didn’t you make a video or picture . She knew the plaintiff could not use her FDA yet she made her get it. Why did you make her get it when you knew it's useless and you will still use your own? I think she loaded the alcohol that was why she refused to release her FDA. She knew it might pass or not depending on the inspection but would not take the risk with her FDA.
This case is very interesting and an eye-opener. 1. Oretide has mentioned countless times that she didn't source for the entire goods, in fact just 25% (She has a problem with that). 2. She couldn't convince her client not to load snail which she mentions is contraband in the US, thought it was eventually cleared. (She doesn't care). 3. Oretide was convinced that her client would need her FDA to clear the container, yet was not willing to release it at any point (a deliberate attempt to strangle it). I await the judgement on the ground of evidence even though I'm already convinced that Oretide knows something about the alcohol
Sounds to me like a set-up; all part of the entire game plan. There's a possibility that as a result of the resentment that Oretide had towards her client, she connived with the shipping company to have the container intercepted in Ghana and compromised with the contraband items just to sabotage the consignment, since the supposedly outlawed snails had been cleared and there seemed no other means to get back at the client for all the insults. To crown it all up, the client had paid Oretide in full, and the bone of contention here had been the Non-Export Proceeds (NXP) from the CBN, which Oretide claimed that she single-handedly took care of. But, all these would rest with the inquest of the legal team on the activities and involvement of the shipping company around the time of the incident.
The issue I have is that she agreed to load the container. She said she loaded every item including the ones she didn’t source. She even snapped pictures of everything that arrived, counted to make sure they were complete and reported back to the lady. She would have been last to close the container before shipping. I don’t know how she then wants to say she doesn’t know about the ones she didn’t provide. It is either her or the shipping company at fault. Who else would have access to enter the container
@@Yinksz That's where a pictorial evidence of the locks used for the container comes in handy/is key. If the locks tally with what got to the client when the ship berthed at the US port, then, Oretide might have succeeded in exonerating/absolving herself of any blame due to tamper. However, the onus would now lie on the shipping company to explain what happened to the container while in transit, because there are indeed few locks available on the market that cannot be picked/have proven very difficult for a bandit/wharf rat to pick. Let's not lose sight of the fact that the Club brand beer in question, made by Accra Brewery Limited, is only available and sold in Ghana. So, the onus now lies on the shipping company to prove themselves or their employees innocent. Employees of the shipping company may be running clandestine operations whereby they breach locks attached to their containers and then, squeeze additional items into them, only to be intercepted midway, or on immediate arrival at the seaport. The US Immigration and Border Control has staff members that are highly trained and skilled in intercepting narcotics as well as contraband and outlawed items, especially when they are not declared.
I pray Judge Fumni confirms the letter as I feel Yinka is lying and trying to implicate Oretide. Any normal person will shout immidiately alcohol is discovered on her container. She complained about honey and kept mute about alcohol for over 2months.
I'm an importer too, when you're faced with such challenge the first thing you want to do is solve the problem first bcos the container will be in demorage and continues to accrue fee daily

This case is deep but why not contact oretide earlier when they discover alcohol in the container,why contacting her after the destruction of the alcohol.the complainant is not being sincere.
For the fact that the US lady discovered what she didn't order for (alcohol), should have appeared strange to her, which was supposed to prompt her to notify the exporter in Nigeria immediately. They kept quiet until after close to two months,i suspect conspiracy to just implicate the exporter. Remember the exporter was already denying to load snails which she suspected could be a problem in US, talk less of alcohol. To me that alcohol was in that container to the notice of the US lady, only that she has spent more than she expected to clear d container because the exporter didn't release her FDA, I see this as a way to get back at the exporter after two months of drafting their plan to nail her. Exporter's only fault was she failed to check the last loaded goods due to inadequate time. But I strongly believe the US base knows about the alcohol for keeping quiet till two months. God will give you wisdom Ma, over this matter.

Doing business is not easy at all..God save us from messy mistakes. Oretide after this one please learn lessons and be strict and careful on your deliveries. Tell customers plainly that you won't accept external goods or you properly unpack and repackage. If you are truly innocent,may God give more wisdom to the judge.
If the alcohol was found by USA Customs, there was no way it could have been planted by the plaintiff because you don't have access to content of a container until it is released by customs. So the alcohol got into the container before it arrived in the US.

Yinka has no documentation from USA customs certifying they found alcohol , what was shown was a recycle document …. Go back and watch properly …. Also she’s meant to provide video or pictorial evidence in court …. Not destruction pictures

It was established by both parties that 1. Oretide loaded & shipped the container and had the keys to the container. 2. The email evidence from the US border control have confirmed that the alcohol was from the container and Oretide confirmed it was the container. 3. Oretide stopped picking calls because she was angry with the plaintiff. 4.Oretide started loading the container before the plaintiff’s Aunty arrived (on the day it shipped). I would like to think that Oretide would know that the plaintiff won’t be able to clear with their own # since she is more experienced. Who else could have a motive for planting the alcohol without Oretide’s knowledge? Could it have been the Aunty who dropped #1M on the first day she met Oretide and could she have had the keys to put not one carton but about 7 alcohol cases into the container? Oretide had the burden of care to make sure that the things she was paid to do were done i.e- loading and confirming everything being shipped, when does this burden shift? I guess Judge Funmi will decide based on the evidences provided. This is a really tough one, but we’ll follow the evidence of each of the parties.

I’m not an expert in shipping containers but I strongly believe the is border control that alcohol was in the container. How it got there? I’m not sure, but since Oretide had the keys and said she usually confirms each item she got with the plaintiff, I would like to think that the other suppliers did not put it there (I might be wrong) since it had to be paid for before they could supply, and when they supplied, Oretide would them check them to verify with the. Plaintiff. It could have been a mistake from Oretide since she also shipped alcohol to the US once before contracting with the plaintiff, we don’t know if she was also shipping another container that needed alcohol and maybe mistakenly loaded the plaintiff? For me, the time it took the plaintiff to complain is not as important as why there was alcohol and the confirmation of the alcohol. What motive would the plaintiff have to put in alcohol? Oretide may or may not have put in the alcohol intentionally, she has the burden of proof, since the plaintiff asserted and has proven. We need more evidence from Oretide…
Wow… Thank you for verifying. I would like to think that 19 boxes is visible in a container and Oretide saw it when shipping. We’ll see what Judge Funmi decides. I would be surprised if Oretide isn’t fully liable at this point, and at worst the destruction cost could be split between both parties-for the fact that the plaintiff did not notify Oretide on time about the alcohol.

But, I strongly believe that the shipping company has some explaining to do in light of this case, as to the role they played in the course of supposedly taking a detour to Ghana while en route the United States. Oretide can sue them and bring them to justice if she runs the risk of losing not just her licence, but also, credibility and clientele.
The problem with the plaintiff is that she’s clearly impatient and smart. The problem with the defendant is anger. This made her careless with the container inspection.
Treat every customer as if they're your first/last transaction. Oritide should have been proactive, until customer has received their goods. She could have inspected each item. Extra step to keep customers coming back. Plus referrals. Chop now/later.

As a first time exporter you will definitely run into issues like this but given the fact that she contracted Oretides service, she could have easily use her FDA as the procurement and export company while using the Customers name and FDA in USA as the Consignee… and as far as the NXP CBN just wanted to be sure you brought he money into the country in dollars and all you need to show them was invoice through your bank….. I’m suspecting something fishy with the Oretide lady.
For me this case is complicated, but oretide doesn’t sell alcohol and never mentioned to her to purchase alcohol, how then will she load alcohol inside the container, maybe those couples tried to punish her. They might get someone to bring them the email saying there was alcohol in the container, oretide even warned them against snail then why will she load alcohol. Because even she loads it, is not in her position to open stuffs the owner asked to be added to her container, and what name they call it carton of pack oil etc is what will be written down as what she received not minding what is actually inside... The plaintiff cannot rely in the weakness of the defendant's case to prove hers. This plaintiff has not discharged the burden of proving Oretide loaded contraband.

I have gone through all comment before I decide what to say, critically the Judge needs to ask few question and needed to be backup with evidence
1. Was there anything else in the container, parked with a BROWN CARTON and A GREEN GLASS BOTTLE, how was the HONEY PARKED?
2. Did Yinka's ant show up on the last day of loading or was she present every time they loaded the container?
3. Did Yinka/her Husband inform (date) Oretide when they learned that the shipment had arrived in the US?
4. When were they made aware that the package contained ALCOHOL? When did they learn that there will be shipping container examination?
5. When did Yinka or her husband (date) actually see the goods? Was it after the ALCOHOL'S DESTRUCTION? When did they inform Oretide that alcohol was discovered in the shipment? She also noted that the beans weren't separated and a BOTTLE of honey was gone, was it AFTER OR BEFORE YOU told Oretide about alcohol
6. Were Yinka or her husband ever seen the alcohol bottle weather images or video before they were destroyed, or were they just shown this image (of the broken glass bottle) shown in court?
7. Yinka: HOW MANY PARKS of ALCOHOL BOTTLES WERE FOUND? Did the US customs officer rearrange or offload the goods in the container for inspection? Was it discovered inside (at the back of the container), in the middle, or by the door?
8. Oretide: Did you completely fill the container with nothing no space left? Did you take pictures on the last day of loading to send to Yinka? Can you recall when and where you filled the honey bottle?
This questions will give clear picture of how this happened and question 7 & 8 tell us who loaded and how the ALCOHOL got into container.
If the questions are answered honestly and with sufficient evidence, neither Oretide nor Yinka need to tell us the truth because both of you will lose. For example, if Oritide can lose her shipping licence to the US, why would she load contraband? However, if Yinka is only losing some money for the destruction of the contraband ALONE, this reveals who is playing the game.

According to the defendant(from the first episode) the missing honey and branded stickers were reported 2months before the alcohol was reported. And that's so suspicious. She said she didn't want to disturb Oredite that's why she didn't report immediately. 🤨 so it looks like she's now ready to disturb 2🤷♀️

Lot of lessons to learn here
1. First, the problem started when different suppliers were asked to bring goods instead of Oretide alone. Had it been she was the only one who sourced for the goods in Nigeria, she could have easily been held responsible.
2. Second, what happened during the process of loading? Could it be that those who loaded the container did a mix up or something because this always happen in our everyday lives. Mix ups always occur in businesses that has to do with moving things.
3. Third, I think Oretide got vexed with their attitude at a point when she was checking the goods brought for her and that sort of affected thorough checking of other things that was brought from other sources. It such a pity 🤦🏽♀️

Yinka's aunty knows somethings, her body language shows it.
Oretide has anger issue, which is why they are smarter than her, why block ur client cos she is insultive, how many of ur clients can u block.
Yinka should know that u win some and loose some, don't try to be smarter than ur teacher, else he will use ur weakness against u and leave u halfway.
Finally, Yinka should let go of this issue cos she got everything, except that there was alcohol there, she should use this as a learning curve and forge ahead. As for Oretide, if u know u don't want to eat meat, don't use ur teeth to share it. Next time, if customers don't buy everything from u, warn the customers and let them know that anything that happens to their containers, they will bear the consequences. I pray Judge Funmi handles this case with wisdom.

Anger indeed is a small madness, even in my handbag business, I cannot have peace, until the client orders has gotten to them...
Part of the lessons here is that the services of lawyers should be developed in Nigeria. We often enter into agreements without legal considerations and backings. The result is that things get messed up and everyone gets bruised when things go wrong.
I think the shipping company has a big role to play in explaining how their ship managed to stop over in Ghana, whereby alcohol was loaded in an already laden container. They need to explain how the locks to the container were breached, and someone somewhere managed to load contraband items (which probably had already been singled out for destruction at the Ghana Sea Port) and perhaps, had taken out some legitimate goods and replaced them with the alcohol.
If padlocks were used to secure the container, Oretide, being the defendant, should be able to tell from pictorial evidence, any differences in the locks on the container when it finally arrived in the US.
The agreement for Oretide to load 90% of the goods on the container was already breached ab initio, and more or less voided the transaction. This alone could have brought about some degree of resentment in her towards her client, besides the subsequent insults from both Olayinka and her aunt. Any other transaction would just be fulfilling all righteousness.
The plaintiff, Olayinka Emmanuel alongside her husband and the Aunt cannot be blameless, as they all failed to sing out in time about having found alcohol in their consignment. It took them almost two whole months to reach out to the defendant, even when they clearly had the breakdown of the contraband items on paper, officially and also had along the line, gone ahead to pay for its outright destruction.
How would you destroy contraband goods without reaching out to the person who supposedly shipped them in the first place, simply because your relationship had already suffered some strain? If the husband still had open access to the defendant, Oretide, he should simply have raised a lot of dust while the case was still hot, except if they know something we don't, and don't want to reveal.
Both parties (the plaintiff and the defendant) in my opinion are being economical with the truth. They are only treading with caution, and just wouldn't want to assume full responsibility for any of their lapses and shortcomings, so that neither of them would eventually take the fall for service rendered unsatisfactorily.
May God grant Judge Funmi the necessary wisdom to unearth the truth about this case and bring it to a final wrap.🙏

What a case!! Very eye-opening. In this 2nd part, I believe the plaintiff and her family. Oretide admitted that she did not check everything that was delivered to her. She said how can she be checking everything? 17:55 24:00 She also said that once contraband is in the container and once everything is not sourced from her, she won't use her FDA, yet paper work was 100% in her name 13:20. In this 2nd part, I'm standing by the plaintiff. Oretide also seems to be angry that though they agreed for them to buy 90% of the goods from her, they only bought 25% from her 24:00. She has very poor customer service because she blocked her customer and her aunt 20:45 22:44. To me, Oretide is at fault. She has done this only once prior to the plaintiff's, yet before being asked her history with exporting to US, she kept on saying she knows the business. She's a newbie trying to appear like she's been exporting to the US for years 22:59. Can't wait for the verdict.

Judge Funmi needs to ask the woman that loaded the container for what we call the PACKING LIST. This is an official document needed to ascertain the contents of the container and it is compulsory to declare this . I live in Australia and this is what I have been doing for the past 6 years. I think she’s not telling the whole truth. I can even see that she’s a bit nervous.
She is just bitter that the lady did not source 90percent of the items from her as earlier discussed amd decided to be vengeful. She was paid to be responsible for the loading, which she admitted that she did not properly do. That is negligence on her part and she should shoulder that of the damages.
Yinka though should have learnt the business first by allowing ireti to do the first sourcing and shipping and then take it up from there but she was playing smart I guess to cut cost.

That’s actually incorrect. Her contract was not to inspect the goods. Nothing went missing from the order. She kept the plaintiff informed with everything that was delivered. She loaded the container. Plaintiff chose to use multiple sources. When you order something to be sent through DHL, they don’t inspect the good your delivery. They just ensure it’s delivered

The only verdict that can favor planitif is if there is full picture or video that link the container in question if not the case will be dismissed but the main problem still lies with the agent because she plays smartness with importer. Your Honor Good Evening! I am a Psychologist and have watched the whole Video now here are my observations.
1: The Dealer from Nigeria knew exactly the Field of Business in exports and was the only one with the Locks of the container.
2: The fact that she wasn’t the only one bringing in items in the container, would have made her check the packages more Carefully to avoid Wahala , if it was a case of drugs by now she will be having bigger issues.
3: There are chances of her wanting to cut a side deal from another client to top up the Gain on her own side since she knew exactly that the container was half way loaded.
Now the name of the Alcohol or origin of the alcohol isn’t a key point, simply because Many people export different goods to the overseas.
4: No other Person had access to the Container, when the container was been closed she should have video recorded the closing of the container.
She knew how she will avert the case when issues follows up simply because she’s in the game for Long.
5: From the records they both have alcohol wasn’t included in it, which could state in my view that the client is on a safe side because she wouldn’t magically put the alcohol in there.
What ever happened to that container could be from Nigeria 🇳🇬.
6: From the pictures in the video showed in court the alcohol was in a Bottles then packed in a Carton.

One other issue that beats me is that whenever there are seizures by the United States Customs and Border Protection (CBP), more often than not, the package/luggage is opened in the presence of the recipient/owner. And all this happens after the package in question must have passed through their ultrasentitive scanners without the need to breach the lock(s) of that package. There are always surveillance monitors and closed circuit monitoring systems in and around the ports, so every detail is more or less captured for record purposes, lest anyone accuse them of planting the contraband item(s) themselves.
When Mr. Bamidele Emmanuel mentioned that the US Customs had phoned to invite them over, it was on a Saturday, and they claimed that they had found alcohol in their container, to which the Emmanuels refuted. 0:28 and 16:00
It really would be unethical for the US CBP to breach the locks of a recipient's package, even when it's high risk without the presence of that recipient in question, and also, provided that the recipient hasn't gone into hiding/is on the run. But then again, I guess in some cases, they reserve the right to do so, especially when the recipient isn't within immediate reach. What the Transportation Security Administration (TSA) would normally do is to first break the locks and then, leave an official document with the breached locks attached, stating that they had carried out an inspection on suspicion of a contraband/illegal item(s).
Well, I also want to believe that all this is based on the fact that the TSA have an already prescribed Guidelines and Procedures document clearly spelt out, in a bid to serve as a forewarning to would-be shippers.

Why would it be alcohol only available in ghana
So Oretide would ship alcohol from Ghana with her own money and include it in the container knowing fully well that it'd be destroyed. She even explained contraband items to her and the plaintiff said would cut corners
Unfortunately it doesn’t work that way because she dosent sell alcohol.

There's no where beers could have entered the container which her knowledge and those working under her. Those doing the packing should have called her attention because they know what to pack and what not to pack. It's her faults and that of her workers who packed without checking. Nobody takes thing to the post office packed and they don't open to check what is inside. They always open to check in order to avoid any mixup What if it was bomb or cocaine that was brought to her to send to the US? Who did the final control before sealing the container?

She knew the plaintiff could not use her FDA yet she made her get it.
Why did you make her get it when you knew it's useless and you will still use your own? I think she loaded the alcohol that was why she refused to release her FDA. She knew it might pass or not depending on the inspection but would not take the risk with her FDA.
This case is very interesting and an eye-opener.
1. Oretide has mentioned countless times that she didn't source for the entire goods, in fact just 25% (She has a problem with that).
2. She couldn't convince her client not to load snail which she mentions is contraband in the US, thought it was eventually cleared. (She doesn't care).
3. Oretide was convinced that her client would need her FDA to clear the container, yet was not willing to release it at any point (a deliberate attempt to strangle it).
I await the judgement on the ground of evidence even though I'm already convinced that Oretide knows something about the alcohol
Sounds to me like a set-up; all part of the entire game plan. There's a possibility that as a result of the resentment that Oretide had towards her client, she connived with the shipping company to have the container intercepted in Ghana and compromised with the contraband items just to sabotage the consignment, since the supposedly outlawed snails had been cleared and there seemed no other means to get back at the client for all the insults.
To crown it all up, the client had paid Oretide in full, and the bone of contention here had been the Non-Export Proceeds (NXP) from the CBN, which Oretide claimed that she single-handedly took care of.
But, all these would rest with the inquest of the legal team on the activities and involvement of the shipping company around the time of the incident.
The issue I have is that she agreed to load the container. She said she loaded every item including the ones she didn’t source. She even snapped pictures of everything that arrived, counted to make sure they were complete and reported back to the lady. She would have been last to close the container before shipping. I don’t know how she then wants to say she doesn’t know about the ones she didn’t provide. It is either her or the shipping company at fault. Who else would have access to enter the container
@@Yinksz That's where a pictorial evidence of the locks used for the container comes in handy/is key.
If the locks tally with what got to the client when the ship berthed at the US port, then, Oretide might have succeeded in exonerating/absolving herself of any blame due to tamper. However, the onus would now lie on the shipping company to explain what happened to the container while in transit, because there are indeed few locks available on the market that cannot be picked/have proven very difficult for a bandit/wharf rat to pick.
Let's not lose sight of the fact that the Club brand beer in question, made by Accra Brewery Limited, is only available and sold in Ghana. So, the onus now lies on the shipping company to prove themselves or their employees innocent.
Employees of the shipping company may be running clandestine operations whereby they breach locks attached to their containers and then, squeeze additional items into them, only to be intercepted midway, or on immediate arrival at the seaport.
The US Immigration and Border Control has staff members that are highly trained and skilled in intercepting narcotics as well as contraband and outlawed items, especially when they are not declared.

I pray Judge Fumni confirms the letter as I feel Yinka is lying and trying to implicate Oretide. Any normal person will shout immidiately alcohol is discovered on her container. She complained about honey and kept mute about alcohol for over 2months.

I'm an importer too, when you're faced with such challenge the first thing you want to do is solve the problem first bcos the container will be in demorage and continues to accrue fee daily

Did you not HEAR Her say I WAS TO PROVIDE 90%. Of the goods but I ONLY SUPPLIED 25% of it which I believed was her Anger… that was my area of Observation. This case is deep but why not contact oretide earlier when they discover alcohol in the container,why contacting her after the destruction of the alcohol.the complainant is not being sincere.
Oretide shouldn't have been paid upfront for her to use Form NXP.
For the fact that the US lady discovered what she didn't order for (alcohol), should have appeared strange to her, which was supposed to prompt her to notify the exporter in Nigeria immediately. They kept quiet until after close to two months,i suspect conspiracy to just implicate the exporter. Remember the exporter was already denying to load snails which she suspected could be a problem in US, talk less of alcohol. To me that alcohol was in that container to the notice of the US lady, only that she has spent more than she expected to clear d container because the exporter didn't release her FDA, I see this as a way to get back at the exporter after two months of drafting their plan to nail her.
Exporter's only fault was she failed to check the last loaded goods due to inadequate time. But I strongly believe the US base knows about the alcohol for keeping quiet till two months.

Doing business is not easy at all..God save us from messy mistakes. Oretide after this one please learn lessons and be strict and careful on your deliveries. Tell customers plainly that you won't accept external goods or you properly unpack and repackage. If you are truly innocent,may God give more wisdom to the judge.
If the alcohol was found by USA Customs, there was no way it could have been planted by the plaintiff because you don't have access to content of a container until it is released by customs. So the alcohol got into the container before it arrived in the US.
Was that why it took her 2 months to tell the defendant about it ? Even after accusing her of missing honey ? Which was more important contraband or honey ?
Yinka has no documentation from USA customs certifying they found alcohol , what was shown was a recycle document …. Go back and watch properly …. Also she’s meant to provide video or pictorial evidence in court …. Not destruction pictures

@@Hajara318 the judge admitted a letter emanating from the US customs as evidence. It had the container number on it which Oretide confirmed as correct.
We need proper documentation directly from USA before we can believe the plaintiff.
Oretide seems not to be so experienced in shipping to USA. One thing about my people, if you are not experienced in a particular business do let your customers know instead of messing yourself up. Tough case here.

It was established by both parties that 1. Oretide loaded & shipped the container and had the keys to the container. 2. The email evidence from the US border control have confirmed that the alcohol was from the container and Oretide confirmed it was the container. 3. Oretide stopped picking calls because she was angry with the plaintiff. 4.Oretide started loading the container before the plaintiff’s Aunty arrived (on the day it shipped).
I would like to think that Oretide would know that the plaintiff won’t be able to clear with their own # since she is more experienced.
Who else could have a motive for planting the alcohol without Oretide’s knowledge? Could it have been the Aunty who dropped #1M on the first day she met Oretide and could she have had the keys to put not one carton but about 7 alcohol cases into the container? Oretide had the burden of care to make sure that the things she was paid to do were done i.e- loading and confirming everything being shipped, when does this burden shift? I guess Judge Funmi will decide based on the evidences provided. This is a really tough one, but we’ll follow the evidence of each of the parties.

I’m not an expert in shipping containers but I strongly believe the is border control that alcohol was in the container. How it got there? I’m not sure, but since Oretide had the keys and said she usually confirms each item she got with the plaintiff, I would like to think that the other suppliers did not put it there (I might be wrong) since it had to be paid for before they could supply, and when they supplied, Oretide would them check them to verify with the. Plaintiff. It could have been a mistake from Oretide since she also shipped alcohol to the US once before contracting with the plaintiff, we don’t know if she was also shipping another container that needed alcohol and maybe mistakenly loaded the plaintiff? For me, the time it took the plaintiff to complain is not as important as why there was alcohol and the confirmation of the alcohol. What motive would the plaintiff have to put in alcohol? Oretide may or may not have put in the alcohol intentionally, she has the burden of proof, since the plaintiff asserted and has proven. We need more evidence from Oretide…

Wow… Thank you for verifying. I would like to think that 19 boxes is visible in a container and Oretide saw it when shipping. We’ll see what Judge Funmi decides. I would be surprised if Oretide isn’t fully liable at this point, and at worst the destruction cost could be split between both parties-for the fact that the plaintiff did not notify Oretide on time about the alcohol.

But, I strongly believe that the shipping company has some explaining to do in light of this case, as to the role they played in the course of supposedly taking a detour to Ghana while en route the United States. Oretide can sue them and bring them to justice if she runs the risk of losing not just her licence, but also, credibility and clientele.
The problem with the plaintiff is that she’s clearly impatient and smart. The problem with the defendant is anger. This made her careless with the container inspection.
Treat every customer as if they're your first/last transaction. Oritide should have been proactive, until customer has received their goods. She could have inspected each item. Extra step to keep customers coming back. Plus referrals. Chop now/later.

As a first time exporter you will definitely run into issues like this but given the fact that she contracted Oretides service, she could have easily use her FDA as the procurement and export company while using the Customers name and FDA in USA as the Consignee… and as far as the NXP CBN just wanted to be sure you brought he money into the country in dollars and all you need to show them was invoice through your bank….. I’m suspecting something fishy with the Oretide lady.

For me this case is complicated, but oretide doesn’t sell alcohol and never mentioned to her to purchase alcohol, how then will she load alcohol inside the container, maybe those couples tried to punish her. They might get someone to bring them the email saying there was alcohol in the container, oretide even warned them against snail then why will she load alcohol. All I see in this case is just punishment and revenge, some received contain since December and and didn’t inform her about the alcohol until after three months. Judge funmi we Dey wait your judgement.

As long as she told her she can't use her FDA, by means of sourcing from other places will go a long way for her in this case... Because even she loads it, is not in her position to open stuffs the owner asked to be added to her container, and what name they call it carton of pack oil etc is what will be written down as what she received not minding what is actually inside... Her deafness even when told that some things she demanded her contraband and still decides for it to be added e.g snails shows she doesn't give a damn about receiving her goods successful knowing you are new to the business
But she was paid to check and load every item, so since they didn't buy everything from her she decided to sabotage them knowing fully well that they will not use her FDA

Now the owner changed plan and she only source about 25% of total goods, did she pay extra fees to open every package brought in my her various vendors.. she was only greedy thinking if she source the goods buying from her will be more expensive....as a first timer you must be read to spend to under the procedure more clearer and better.. a first timer but yet refused the advised of goods that could been seen as contraband
