Basically some shit of a lawyer got in touch with the company who owned the publishing rights and suggested they sue because they (and him of course) might make a lot of money. They tried to get 60% of the royalties on the song, but were awrded only 5% by the court - but that was still a lot as the song sold millions. I don't think it's true that they are not allowed to play the flute riff live - can't find any mention of that anywhere; whether they do or not, I've no idea.

The US festival in California back in 1983 was a 3 day "who's who" of some of the greatest acts ever...I was lucky enough to see all three days and will never forget it.

Went to a concert at Mud Island Amphitheater in the 80's in their prime. Great Show...…..small venue, and couldn't hear for 2 days after the show. Very heavy on the drums (loved it) Great show!!
