  • The plaintiff hired and paid the defendant, a real estate broker, for an apartment. The plaintiff claims the apartment wasn’t ready in time, and the defendant tried showing him additional units, so the plaintiff is suing for his money back. The defendant argues that the plaintiff took too long with his application, so he missed out on the original apartment.

    The defendant is a little smart-a** and I’m glad he lost the case. I bet he was trying to intimidate the defendant the whole time and didn’t expect him to come after him.

    A contract is a contract and dates do matter. I hate how the defendant brushed off 3 or 4 days like if it wasn’t a long time 😒

      Exactly! I suspect the ‘on or around’ thing, accounts for when the 1st of the month is on a weekend or public holiday, not for random clauses

      No, Milan messed up. 3 or 4 days is not unreasonable if it’s building construction. All sorts of delays can occur.
      The defendant is a broker, not a foreman on the construction site. He made with info that he had.
      And since the plaintiffs knew about the construction in progress, they could have made backup plans.
      This is on the construction company, not on a broker.

      Any way I like the plaintiff how he answered the judge M: "Who's the lady setting with you?"

    Brokers are scandalous. I hired a broker for my rental years ago and paid over a thousand dollars to find an reputable tennant and fi d out the tennant was horrible when they returned the home. Home was only 6 years old (newly built) and they damaged carpets (bleach stains), water damage on walls, killed both lawns, stole lawn equipment, had more people living there than were suppose to, dirty bathrooms then still wanted their entire deposit back. Just scandilous.

      Scandalous is perfect word. I hired a long distance moving broker. He told me it will cost $5700. Nope cost me $10k. Then moving company said they wont Be able to deliver my s h I t iin their storage unit for 30 days and will cost me $700 which in a normal world is $125. Pissed off doesn't cover it. I was ready to drive to their storage location in a different state and catch a charge. They called back and said well be there in 2 days. Being an a--hole pays off lol

    Never pay a broker. Go directly to a property management team. You can even call every property management firm and ask if they what you are looking for, then go with the one that suits your needs best.

      I live in Boston. Impossible to get an apartment in the city without a broker unless you can afford a luxury 5k+ apartment.

      Exactly!!!! I would never!!!!!!!! I even found my own house and then went through the realtor for purchase. I think most ppl get a realtor and allows them to show them different houses. I did the opposite. Won’t persuade me.

      @@moneka1030 great minds think alike! That's how I met my current property management team in 2013. I found a place I wanted to rent which lead me to them, and then they showed me something better! And now I'm in a new place. When I was ready to downsize from my house to an apartment, they found me the perfect one. I have a half acre backyard that I share with my downstairs neighbor. It's an old house, split into two apartments. I'm not someone who can live in a building with no yard space. And my neighborhood is also exactly where I need to be right now.

    If that real estate broker had a moral compass in him he wont even be bring these people to the landlord. That woman has been sued by 3 previous landlords. Whether she is going to be on the new lease or not is irrelevant any reputable broker would not rent a apartment to them but of course some brokers dont give a sheet as long as they get their commission

    That Lady has been sued by 3 different previous Landlords. Thats crazy. She is what we call a professional tenant. These are evil crafty tenants that have learnt how to get around the laws and live in peoples homes for free.

    He’s crooked and scandalous! He knew damn well he should have given the money back when the contract fell through. Those “on or around” lingo is such a grey area and he knows that can use that against people when they come back about the contract. He didn’t deserve the $1500 to begin with. So glad the plaintiffs won!!!!!

    The broker has probably run this play prior. An unexecuted lease means the contract has not been presented. The broker collecting the fee prior is not enforceable. The apartment was not ready end of story. This "on or around" is not just nebulous. It's so open-ended that it's not enforceable.

    So many companies offer a percent off of quoted price if you pay cash, that's why there isn't a receipt. I've had work done at my home and the discount for "cash" can be quite substantial. I don't do it but it is tempting when offered $100 or $200 "discount". I don't do it because I don't have anything to fall back on if something goes wrong.

      No, they offer a discount when paying cash to avoid reporting it to the IRS. Whether you're paying cash or card, discount, or not, you should still receive a receipt.
