It's absolutely ridiculous how RUclips handles things anymore.. creators get so very little now compared to what they used to and now it's so easy for people to just claim whatever they want.. And then they wonder why so many creators, and even viewers, have moved to other platforms like Twitch..

Result was easy: they lost coaches and their clients

Every musical artist that has ever sued Tunecore and won needs to band together and file a highly-publicized lawsuit, see it through to completion, and force the governing bodies of the country Tunecore is domiciled in to shut them down and permanently ban such behavior.

This EXACT same situation happened to me this year Malu when someone stole my song & redistributed it. I had to get a lawyer involved after MY original song got claimed. It's utterly ridiculous that the burden of proof isn't on the one making the claim. I hope you can get it all sorted out
Did you win? There should be serious legal consequences for that type of behaviour, if it's deliberate. It is utterly despicable behaviour to not only steal someone's content, but to then claim more rights to it than the person you stole it from! That is just ridiculous and totally unjustifiable. People like that should be named, shamed, and made to pay restitution. The cheek of stealing something from someone, and then claiming revenue from it's legitimate creator is reprehensible.

@@kinagrill Well despite all the claims of "civilized" western countries the fact is that most justice systems do actually work that way. If you have ever been in court you will know how much you have to fight to prove your innocence. Innocent until proven guilty is a bit of a myth. All the accuser needs is to show ANYTHING that proves it COULD be you and its possible you can go to jail. it happens in every country.

I've run into this so many times, sorry youre having to deal with it. I used to use my band's original music on my intros and outros, but after getting content IDs nonstop I had to quit and use some unreleased stuff. We've found a way around it....sort of...with a team of lawyers. But it shouldn't be that hard, or require retainer fees, to use your own music. If you dispute and appeal it should ("should" being a bit of a floaty term) be released for you.
I am in no way an expert, but I seem to remember someone mentioning that one solution, if it is your own original music, is to be pre-emptied about it by getting it registered into RUclipss copyright system, so that it is you who gets the claims on your own stuff. Although I have no idea of how one would go about doing any of this :P

This is definitely a fault of RUclips's since they make the process of copyright claims *way* too easy. There doesn't seem to be any vetting process where they determine if that place even owns the rights in the first place.. It's just all algorithms that do it and usually end up failing and just making life miserable for people it randomly claims. I'd go with contacting RUclips and going the legal route. Make sure RUclips is put on notice about this crap.. and even try to blow it up as big as possible.
@@Eventide215 The root of the problem is US copyright law, and how 'The House of Mouse' has bent it over and made it work for their benefit to the absolute detriment of so many others.
What I can say to this is: When you are providing a cover of a song, you are creating a derivative work. Which in terms of Copyright means that your distributing it exists at the suffrage of the original Copyright Holders. However, a derivative work holds its own copyright and any works BASED or reliant on your derivative work IS in violation of YOUR derivative Copyright. Trust me, as I have engaged in VERY similar battles with shady/unscrupulous Indie Game Developers over the years, YOU very much hold the higher ground herer in terms of Copyright Law. I would suggest you file counter-claims. More often than not they will run down the clock and then release it. There is a POTENTIAL that they will attempt to force it to a law suite (INSANELY RARELY) but IF they do, due to YT legal/operational systems, the governing legal body would be the state of California. Which again would mean you have the superior claim.
I also know several Intellectual Property and Copyright Law Attorneys that I can put you in touch with to help guide you if you feel uncertain (for general advice)
well tbh easy battle or not that doesnt really matter. What matters is the system is not good enough to reconigze Bullshit. I think google should do it like this. If you got a claim and you can prove it fair enough than you can absolutly claim it. But they have to prove it first might take many hours and such. But they could make a system with a legal team checking alot of claims. Than if they claim it they get to get the reward ergo you have to pay them than. But if you win they have to pay avarage view on your RUclips account. That would protect alot of shit like this from happending. Cause most do not bother to prove their case as you pointed out.
@@sebulller They cannot do that, if they do not follow the DMCA as written, they open themselves for a lawsuit can be made to paid if they lose. This is why things work as they do. RUclips also has signed contracts with big music labels so that music can be claimed and monetized by them and this is a softer option to full DMCA takedown. Sometimes with it is really really obvious that there is a copyright troll and the youtuber is large enough, they will cancel the DMCA takedown etc, but this is rare.
Just 2 days ago I saw a video getting a copyright strike from a company about a song, which was not even in the video. I wish youtube would care more about their roots than about the rich and their money..

I've dealt with something similar on the "Starmaker lite" app. I created an on the spot song, using nothing not even soundtracks or acoustics at all. Yet literally five minutes after literally creating the song from scratch. Some person commented, saying they loved hearing some woman create and sing this her original song. But it was commented on my song that I created minutes ago. So I know for a fact, that no one other than me created and sang the song. I myself created and sang, with just my vocals and some background sounds of nature.

Your songs rank extremely high on my most listened to on Spotify, and for good reason. Specifically, the "I Follow the Moon" album is amazing, it does something to me on a physical level; I can feel the serenity washing over me when I listen to it. Your music is very special.
I still remember watching The Dragonborn Comes when it was really new and showing it to my grandma at the time. I was really young, and she's no longer with us, but I'll forever cherish the memory of listening to it and feeling the goosebumps with her. A year or two after that, I was at a friend's house, and at some point in the night I ended up showing him your music. He immediately fell in love with your channel, and we sent a message to you on Xbox live; I didn't really expect anything from doing so, I just decided I'd say something nice and he wrote the message with me. The shock on both of our faces when you actually responded was legitimately palpable. Two kids suddenly reeling in shock because a musician they adored responded to some small message. I think we sent something back, but honestly, responding to us at all made our whole week (or maybe month, let's be real.) I had a lot of really, really rough and dark years in my mid/late teens in the years following. Your music would always end up in my playlists, bookmarked, or living rent-free in my head, and your songs were not infrequently my first choices to get me through the worst days of my life. Thank you for all of the memories and joy you've given me for the past 10 years, and I dearly hope the licensing issue here won't cause you too much stress; you don't deserve that!

Bogus copyright claims are certainly a thing. You might want to look into how to dispute them, though it's very understandable if you feel like that's just too stressful. Also, I am legit in tears from how adorable Thorpy is. The best boy.
I once licensed a video to A&E for use only, specifically said so in the contract, and they still copyright claimed it. The right hand doesn't know what the left hand is doing. Its incompetence. I had to explain it to them like a 5 year old as they didn't understand what they were doing. I got it fixed in a couple of days but its still unnerving that it even happened.
As an artist who has seen these claims on my other channels, I know exactly what you're going through. Dispute all of the claims, don't let go of your copyright at any cost. At the end of the day, everyone knows who Malukah is and what you do :) Sending virtual support from my side!

When I heard your rendition of Dragonborn for the first time, I was so impressed with it. And I still am. I hope you get through this absurdity alright, preferably in a way where it turns into a funny story with a happy ending.
The only way to circumvent this problem that I've seen is to do what the youtuber 'ymfah' did. Look up his 'how to break youtube' video. Basically, you have to make and register an original song that you can prove that you have the rights to, upload it and register it with youtubes internal content matching platform, and then put at least 10 seconds worth of the song into every video you make. That way. It will mean that your videos will always 'get copyright claimed', but it will be by your own company, so you still get the ad revenue one way or the other. But if anyone else tries to make a claim on the video then the revenue is 'frozen', or put to one side, until the dispute is resolved, and even in a failed dispute you'll still get a 50% cut. It's a hassle. But it might be worth it?

You tube seems eager to benefit for it's platform and it's contributors as it should but also it needs to look after the people that produce content for it. I also don't understand how their algorithm cannot simply compare upload dates and put a question mark behind the claimants attempt, since ANYBODY who's a copy cat, ends up uploading AFTER the original. Should be the simplest thing in the world. This would ensure that the original author has all the time in the world and their content is uninterrupted. Fucked up world.
I saw a VERY similar video about Indie left learning news channels. That nearly all the views were subscribers and he wasn't getting many random people (not getting recommended) even though he has a solid 3-10k views every video.

I thought this shit was finished with. I remember one of the songs done by 'TheFatRat' was copyright claimed, and the claimant was getting *all* the revenue generated by the music. YT is allowing theft to happen in broad daylight. A new alternative is needed for both content creators and viewers. The platform has so many problems such as unreasonable ad volume, shit pay for creators, creator favouritism, shadow comment deleting, and this garbage.

It's just all algorithms that do it and usually end up failing and just making life miserable for people it randomly claims. I'd go with contacting RUclips and going the legal route. Make sure RUclips is put on notice about this crap.. and even try to blow it up as big as possible.

What I can say to this is: When you are providing a cover of a song, you are creating a derivative work. Which in terms of Copyright means that your distributing it exists at the suffrage of the original Copyright Holders. However, a derivative work holds its own copyright and any works BASED or reliant on your derivative work IS in violation of YOUR derivative Copyright. Trust me, as I have engaged in VERY similar battles with shady/unscrupulous Indie Game Developers over the years, YOU very much hold the higher ground herer in terms of Copyright Law. I would suggest you file counter-claims. More often than not they will run down the clock and then release it. There is a POTENTIAL that they will attempt to force it to a law suite (INSANELY RARELY) but IF they do, due to YT legal/operational systems, the governing legal body would be the state of California. Which again would mean you have the superior claim.
Speaking from experience, this would be an INSANELY easy fight for you.
I also know several Intellectual Property and Copyright Law Attorneys that I can put you in touch with to help guide you if you feel uncertain (for general advice)

well tbh easy battle or not that doesnt really matter. What matters is the system is not good enough to reconigze Bullshit. I think google should do it like this. If you got a claim and you can prove it fair enough than you can absolutly claim it. But they have to prove it first might take many hours and such. But they could make a system with a legal team checking alot of claims.
Than if they claim it they get to get the reward ergo you have to pay them than. But if you win they have to pay avarage view on your RUclips account. That would protect alot of shit like this from happending. Cause most do not bother to prove their case as you pointed out.
@@sebulller They cannot do that, if they do not follow the DMCA as written, they open themselves for a lawsuit can be made to paid if they lose. This is why things work as they do. RUclips also has signed contracts with big music labels so that music can be claimed and monetized by them and this is a softer option to full DMCA takedown.
Sometimes with it is really really obvious that there is a copyright troll and the youtuber is large enough, they will cancel the DMCA takedown etc, but this is rare.
Just 2 days ago I saw a video getting a copyright strike from a company about a song, which was not even in the video.
I wish youtube would care more about their roots than about the rich and their money..

I've dealt with something similar on the "Starmaker lite" app. I created an on the spot song, using nothing not even soundtracks or acoustics at all. Yet literally five minutes after literally creating the song from scratch. Some person commented, saying they loved hearing some woman create and sing this her original song. But it was commented on my song that I created minutes ago. So I know for a fact, that no one other than me created and sang the song. I myself created and sang, with just my vocals and some background sounds of nature.

Until RUclips actually gets in trouble with their copyright system, this will continue. Ever since the system was introduced it has been abused in all manners of ways, and they've done absolutely jack shit to solve it. Hopefully you can get it fixed.

Your songs rank extremely high on my most listened to on Spotify, and for good reason. Specifically, the "I Follow the Moon" album is amazing, it does something to me on a physical level; I can feel the serenity washing over me when I listen to it.

I still remember watching The Dragonborn Comes when it was really new and showing it to my grandma at the time. I was really young, and she's no longer with us, but I'll forever cherish the memory of listening to it and feeling the goosebumps with her. A year or two after that, I was at a friend's house, and at some point in the night I ended up showing him your music. He immediately fell in love with your channel, and we sent a message to you on Xbox live; I didn't really expect anything from doing so, I just decided I'd say something nice and he wrote the message with me. The shock on both of our faces when you actually responded was legitimately palpable. Two kids suddenly reeling in shock because a musician they adored responded to some small message. I think we sent something back, but honestly, responding to us at all made our whole week (or maybe month, let's be real.)
I had a lot of really, really rough and dark years in my mid/late teens in the years following. Your music would always end up in my playlists, bookmarked, or living rent-free in my head, and your songs were not infrequently my first choices to get me through the worst days of my life. Thank you for all of the memories and joy you've given me for the past 10 years, and I dearly hope the licensing issue here won't cause you too much stress; you don't deserve that!

Bogus copyright claims are certainly a thing. You might want to look into how to dispute them, though it's very understandable if you feel like that's just too stressful.

I once licensed a video to A&E for use only, specifically said so in the contract, and they still copyright claimed it. The right hand doesn't know what the left hand is doing. Its incompetence. I had to explain it to them like a 5 year old as they didn't understand what they were doing. I got it fixed in a couple of days but its still unnerving that it even happened.
As an artist who has seen these claims on my other channels, I know exactly what you're going through. Dispute all of the claims, don't let go of your copyright at any cost. At the end of the day, everyone knows who Malukah is and what you do :) Sending virtual support from my side!

I have had two of your videos on my Playlist for going on 9 years now.
When I heard your rendition of Dragonborn for the first time, I was so impressed with it. And I still am. I hope you get through this absurdity alright, preferably in a way where it turns into a funny story with a happy ending.
The only way to circumvent this problem that I've seen is to do what the youtuber 'ymfah' did. Look up his 'how to break youtube' video. Basically, you have to make and register an original song that you can prove that you have the rights to, upload it and register it with youtubes internal content matching platform, and then put at least 10 seconds worth of the song into every video you make. That way. It will mean that your videos will always 'get copyright claimed', but it will be by your own company, so you still get the ad revenue one way or the other. But if anyone else tries to make a claim on the video then the revenue is 'frozen', or put to one side, until the dispute is resolved, and even in a failed dispute you'll still get a 50% cut. It's a hassle. But it might be worth it?

I really hope this works out for you. I can see how frustrating this can be. You tube seems eager to benefit for it's platform and it's contributors as it should but also it needs to look after the people that produce content for it. It will be hard for them to keep it's doors open when there are no more contributors to benefit from.

They are out to make money in the same old sociopathic way that so many large companies follow as an ethos. I also don't understand how their algorithm cannot simply compare upload dates and put a question mark behind the claimants attempt, since ANYBODY who's a copy cat, ends up uploading AFTER the original. Should be the simplest thing in the world. This would ensure that the original author has all the time in the world and their content is uninterrupted. Fucked up world.

A new alternative is needed for both content creators and viewers. The platform has so many problems such as unreasonable ad volume, shit pay for creators, creator favouritism, shadow comment deleting, and this garbage.
