    Ian Millhiser joins, diving right into the complicated task of reconciling the Supreme Court issuing to landmark - and wildly contradictory - decisions the last week, including the overturning of the Chevron Deference Doctrine - which drastically shackles the federal government - and the granting of presidential immunity for “official” acts - which (obviously) fully unleashes the president’s power to rule. Expanding on this, Millhiser, Emma, and Sam unpack the common thread of the self-empowerment of the judiciary, with the former decision essentially putting administrative choices in the hands of the Court and the latter presenting a central distinction (whether the act is “official” or not) that can only be decided by the Court. After tackling how the “immunity” decision changes the perspective on both former (e.g. Watergate) and ongoing attempts to hold presidents to account, and what these decisions tell us about the Courts fascist tendencies and general incompetence, Ian gives his take on how the Chevron decision might come back to bite the conservative Court in the ass, and wraps up with a brief assessment of the Supreme Court’s decision in Moody v. NetChoice.

    If the legislative branch can't meaningfully delegate to departments, and their laws are subject to judicial review, and the executive branch can do whatever it wants, what power does the legislative branch have?

      And can we trust the Legislature to craft robust, all-encompassing laws with no ambiguity? Legislation that is so clear that a judicial review would be unnecessary? I think not. Certainly not with people like MTG, Tom Cotton, and Nancy Mace in office. I'm honestly not sure if these conservative Justices even realize the full extent of what they've done here.

      Tell me again how America has a democracy. You don't practice one man one vote. You have lifetime appointed judges. Candidates are chosen by party elders instead of party members. Your politicians even instited term limits for the executive to stop another new deal. No other major position has term limits. American system is so undemocratic it hurts.

    That SCOTUS even had the power to confer this immunity in the first place is a huge problem. When were politicians - or any agent of any government - ever of moral standing high enough to just ignore the fact that the high Court, under certain circumstances, could easily be used to leverage and compromise checks and balances out of existence?

      I agree. One branch of government should not be allowed to grant immunity to another branch. But this is because the Constitution, which clearly prohibits this, is simply a piece of paper that ideologues will selectively "interpret" so "their side" (as Alito so clearly put it) wins.

    Emma is incorrect when she says that members of the military are obligated to follow unlawful orders. One of the chief differences between our military and that of other countries is that in the US military one may ONLY follow a lawful order. It's not even a choice. They stress the lawful part. In fact, I've never heard it even brung up without the intent being that you don't follow unlawful orders. I believe this is a direct result of the My Lai massacre, but goes further back to the Nuremberg Trials, and even before. Its a part of our military history and tradition.

    part of me thinks this is why the court was using the shadow docket so much in recent years in unprecedented ways; as a test run for a large influx of cases after striking down the chevron doctrine that they can easily churn through by flattening the decisions into legal ones within their purview and letting corps deal with the fall out as they see fit or just ignoring the cases and letting federal judges choices stand if it’s in favor of conservative politics.

      Biden NEEDS to be bullied out of the race. That is the only way to win against Trump at this point. People who are hitching their wagon to Biden are partially responsible for the loss of democracy as we know it if Trump wins. Most of us who watch this show are of the mind that we will vote for Biden regardless, but he isn't going to be convincing anyone new with his performance. He's trending down, and that's the opposite of what we want being down already. It doesn't matter who is president, but dems have to win the presidency, and you're high if you think Biden can do that.
