      Easier said than done, my dude. Many people are in different situations in life. Years ago, $500 would have felt like $100,000 when I was broke and struggling, and would definitely have had major life implications. Now, you could argue that someone in that situation shouldn’t be spending that money in the first place, but I’m not one for telling people what to do with their money.

    I'd contact the bank and start the refund process with them.
    If everyone who has spent even a dime on the 2024 festival goes after the banks, the banks will, in turn, go after the festival and the ones responsible.
    So get the banks involved, and then you'll see real movement and possibly criminal charges.

    As a former bank officer, here is what I suspect:
    1) The charge was authorized;
    2) Hold on the funds before the merchant collected;
    3) Hold released after ~3-5 business days because the merchant did not collect;
    4) Customer unwisely/unwittingly spent said released funds;
    5) Merchant later tried to collect spent funds.

    Thank you for continuing to talk about this. It’s important that people are held accountable or the industry will just devolve.
    My husband and I were able to get the money we spent on tickets/glamping (~$3k) for 2023 back through our credit card companies (AmEX and Navy Fed, if anyone is wondering), but that was still only around half of our total expense for that trip since we had to travel out from California. It sucks that we trusted them to provide a decent experience and they utterly failed. I would MUCH rather have been able to see the bands we went to see than be sitting here today with my refund, but I’ll take the lesson and hopefully avoid anything like this in the future.

    I have to say it because I do think it‘s important:
    THANK YOU very much for covering those topics and especially this BRRF topic in particular! I probably will never be visiting or participating the BRRF (cause it‘s a frickin journey from Germany) but I‘ve been visiting so many festivals in my youth and I always had a blast when the lineup was good and I had the chance of hanging out with cool people and friends and listening to the music acts.
    Best memories: Rock am Ring 1998 and 1999 😍😍😍
    Now I’m nearly 46 and have two kids and my festival visits are pretty much over but it‘s a kind of insanity IF BRRF really got money for tickets basically knowing there will be no BRRF in 2024, especially after the disaster in 2023.
    I really hope and pray that ALL people will get their money back and that, if BRRF committed fraud in any kind or form, people will held accountable for their actions!
    Thx again for covering this topic and caring about your industry, all the best from Germany 🇩🇪, Philipp 👋

    By the way, I can vouch that doing a chargeback with Etix will NOT lead to a ban from the service (3:20). USAA returned most of what I paid for BARF 2023, and then I bought a ticket through Etix for the Crypta tour in Greensboro last month, and it went right through and I was able to attend.

    I cannot speak about Etix specifically, but depending on the platform, doing a credit card chargeback rather than only going through the platform for a refund *CAN* get you banned. 1. You do chargeback with CC. 2. CC company withholds withhold the funds from platform or levies them a chargeback fee. 3. Platform doesn't want to deal with you potentially doing this again and bans you.

    The festival has always done "pre-sales", at supposedly an "early bird" cost. It is the lowest price point that the tickets sell for. Meaning, they sell the following (next) years tickets before the current year even happens. I know this because my daughter always purchases the pre sale tickets. She did NOT do the payment plan, she paid in full.
    My daughter has informed me that she DID receive a full refund for the 2023 festival year. The refund for 2023 finalized back in December. However, they have refused, and fought her, on getting a refund for the 2024 festival year. The request was for "services not rendered" and was declined; stating that the service has not happened yet so she can not claim that she did not receive the service she paid for.
    After watching all of your videos on this matter (thank you, BTW), I have instructed her to try again, to re file the claim with her credit card company. This time claiming "fraud", as they clearly stopped selling tickets.
    She also has proof of everything.

    • @TimPool.BeanieCivilWarlord

      They do not and have never sold tickets for the following year before the current year’s event. Last year was the earliest they had ever made tickets for the following year available and they made them available on either Thursday or Friday of the event.
      The event was enough of a shitshow and mess without people making crap up to paint them as even worse. There is zero need to spread lies.
      Also, a chargeback is not a refund and making bogus claims to game the system so you can get a chargeback is illegal. However, the most likely worst that would happen is your bank/credit card issuer terminating your account.

    We bought tix as soon as they went live as we were in the campground already. We bought VIP and camping tix. Did the initial down payment. We continued our vacation after the fest for 3-4 days. When we got home, we reached out to etix to cancel and get a refund with the reason of not feeling comfortable attending that event again. Was told no, so I swapped my cc info to an old gift card, I still get the failed payment emails every month.

    When I saw your original video about BRRF 2023 I could see the pain in your eyes that there was something that broken in an industry that you love working in. So I completely understand you still looking in to this and speaking about it. After 2023's absolutly Fuster Cluck of a festival Slye deserves prison time, he has skrimped and low balled on every aspect of the festival in order to pad his bottom line. That much is obvious, as for the whole communicating refunds thing being blocked by the insurance company...I don't beleive a word of it. Granted I am in the UK and our insurance industry is quite different but I have worked in it for not far off 2 decades and from experiance here we would 100% say to a client be clear and transparant with your customers and as an insurance entity we also have to be clear and transparant in order to be open for business because of the regulators of the industry. It boggles my mind that an insurance company would say "don't say anything at all, don't mention refunds, don't mention anything that looks like they are being done etc" because the only thing that it brings to my mind is corperate lawyers sat in a room saying "How much of the money can we keep? and how do we make it look like we are doing everything we can?" that may be my own tin foil hat part but it just stinks. Also seeing that people cannot get refunds for 2024s festival is just stupid.....I'm with a lot of chat, I would just do a charge back and risk getting banned from ETIX and then maybe contact Etix directly explaining the situation. With all the BRRF coverage, they would be the first to understand why a charge back may happen and if not....then they deserve a court case as well.

    If I had purchased tickets and my bank had any issues, I'd be pressing charges for obtaining money under false pretenses. I had to do this for an HVAC company 10 years ago I'd paid for a new system for my home and almost 3 months went by and we were getting into May in southeastern NC and the HVAC was the only thing we were waiting on to move in. The owner of the company had given us the excuse it was on back order and the dates kept changing and then he stopped replying so I contacted a local news channel that did a piece every week that looked into local business complaints for citizens, they also got no reply but other people in the area he had waiting also saw it and one of them knew more about the law than I did or my local sheriff's department and went and filed criminal charges with the sheriff's department in their county and I was contacted regarding my story and I went in and they took my criminal complaint as well as all the others and he was arrested and we eventually got our money back because the restitution was put onto his probation costs.

    I am old (Concert for Bangladesh and original Woodstock) and for the many concerts I went to I remember great times with bands and fans treated well (Woodstock was the only mess but performers were there and treated well). It just seems certain people and/or groups of people with great greed and little respect for music and performers go for the money and to hell with anything or anyone. Would be sad if fans were put off other legitimate festivals because of this. Thanks Tank! 😊💓

    I'm wondering if festival staff were dropping like flies for the previous 2 weeks before the infamous day Tank experienced at the show?
    I had spotty - but some - cell service heading to Blue Ridge as a camper, and during the unbelievable line from hell on Wednesday there was an alert on the Blue Ridge app that they apologized for the long lines, blaming call-ins and heat illnesses for the issues. Said half their staff wasn't there at the time (around 9 PM)
    We pulled up in a random field next to some porta potties, and I still remember being very satisfied after the shit show the night before that people actually cleaned the porta potties that morning. At the festival grounds, there was a small crew I remember seeing that were taking the trash, that were cleaning the area up, but they looked like they were in rough shape. They were about to pass out from heat exhaustion like the rest of us. Just looking at them, I remember asking "how can any of us do this for 4 more days?"
    They didn't.

    Was incredibly excited to go to the 2023 festival (rip Warped Tour). My S.O. purchased our two 3-day pass tickets (Friday-Sunday) which was nearly $600 (thank god we didn’t go Thursday and have to hid in a porta-potty or under a stage like many did. Was honestly appalled at how bad it was. 2+ hours to get onto a shuttle to get into the venue, $100 for the shuttle pass for the week (oh and no service at the shuttle parking lot so hope you had them in advance). The people at the gate didn’t really check the people coming in (fun fact, my band said denied for some reason and they let us in anyway), and despite all the rules online I saw people with all kinds of stuff that wasn’t supposed to be allowed (even saw fans with suitcases walking around). There was also people saying that there were multiple people flashing weapons during Friday nights performances. They claimed online that there would be something like 12 water stations if I remember correctly, but there was only two (one of which was VIP only, and the other was incorrectly marked on the map in the festival), but it was good that I didn’t drink the free water as there was many reports of people who did drink the water getting sick (it was some kind of food poisoning if I’m remembering correctly). The way they did band merch was a joke and a real pain in the rear for all involved. Ended up leaving early on Friday (wind was picking up, and there were some dark clouds rolling in and we were concerned that we would get stuck in a repeat of Thursdays events). Only to have Saturday and Sunday (the main days we really wanted to go to) be canceled entirely due to “weather”. Filed for a refund about 2-3 weeks after getting home from the trip, and have yet to hear a single thing back (despite follow ups). Also didn’t get back the $100 shuttle fee that was only used to go to and from the festival once. Almost forgot, none of the staff I interacted with had any clue what was happening. When we left they weren’t running the busses as the venue told BRRF they weren’t allowed to bring more people in (from what I was told anyway), and when we finally got back to the parking lot the staff asked us if we were getting turned away and was shocked when I informed them they they just brought us back, and that we passed 3 full buses going into the venue. I was truly appalled, frustrated, and disappointed by the event and I will shout from the hilltops to anyone that will listen to never go or give these people who run this show a penny. They wouldn’t even mention the two girls who went missing on their official pages to offer help and make people aware of the situation. I know one was found, but never heard about the other girl. Fuck Blue Ridge

    I take credit cards at my business a charge back can only be done up to 6 months from the transaction. The money is taken from the seller and given back to buyer. Idk all the laws and rules but this is what I was told from my merchant company. All I have to worry about for my business is someone saying they didn’t approve the transaction so I get a copy of their license they sign that and the work order so it’s not a huge problem for me to prove it.
    The tickets could be a different issue because they paid for something they didn’t get. I’m sure there is a disclaimer when buying tickets so it could be a civil matter. To be criminal it would have to be paying for something you didn’t get and not getting a refund when the disclaimer said you would in x amount of time or a law states the money needs to be refunded in x amount of time it’s not that simple but in general that’s how it works.

  • @k53847
    @k53847 Месяц назад

    The credit card company goes after the merchant if you do a chargeback, and the merchant knows who it was that did the chargeback because the credit card company asks them to explain why the charge is valid.

    I'm thinking @LegalEagle could take a look at this. Like, who is liable? What parts were legal? What parts were illegal? Does he think there is grounds for a class action lawsuit? Etc.
    I never went, but I feel for everyone who did go and had an awful time and got hurt by 2023 BRRF. Because it sounds like really bad management, it sounds like people who were supposed to do their jobs weren't or weren't able to, it sounds like zero communication was taking place between departments and bands. Not a business owner, either. But you'd think that having strong lines of communication would help with, “something went wrong, we need to fix this and adapt.” And it sounds like there wasn't enough preparation or work put into prep.

    A potential cause to why payments are not being processed is when banks get many of their clients to cancel charges via the bank, they will flag the merchant and block further payments unless it is overridden by the client calling the bank - even then they may not be able to release thee funds, depending on how many have canceled charge processing. I feel like this may be a big reason why payments are having a hard time processing and completely understandable because this whole situation is sooooo sketchy and has Fire Festival vibes.

    I get why people would buy tickets and weekend camping upgrades for festivals, but this is a problem with buying a year in advance. You never know what’s going to happen to possibly prevent you,from attending, and if you don’t pay for ticket protection you’re going to get screwed if you can’t go. Refunds will never be given freely, they’ll only be given once an event is canceled so for everyone who’s trying to do charge backs and get their money back it’s not gonna happen til there’s an official cancellation. Hell, I don’t go to festivals but I also don’t even buy concert tickets anymore until the week, or day, of the concert if I even remember to do so 😄 and if I feel like spending the money.
