      Prior to the trial, I thought that the conspiracy stuff was... exactly that.
      After being a trial-watcher for decades, this is the first time defense didn't just bring smoke and mirrors for 3rd party culprit.

      @@tiabiamama I can just about promise you that Higgins and Albert destroyed those phones to make sure they didn’t end up like Proctor. It may look really really sus, but it was better than nationwide shame and disgust. I personally believe Higgins had more means, motive, and opportunity than Karen ever did. I have so much I would like to say, not enough space.

    Brand new to this case. Just started watching about it the other day.
    From all of the info I've gathered, I have one question: wtf was wrong with that jury? This woman doesn't even have a motive for killing her boyfriend.
    There was no marriage, no life insurance policy, no kids to fight over custody...you're not going to murder your boyfriend because you had an argument ffs.
    But not just that...the evidence of this framing and coverup is so clear.
    I will never understand how this jury hung. What a travesty.

    40:03 this goes both ways, why would Karen kill her police officer boyfriend when she’s expected to be somewhere and that somewhere is the home of another police officer? Why would she leave his body on the front lawn of another police officer where she has to know there’s another police officer living on the same street!? It makes more sense that Brian Albert would leave him on his own front lawn because he is a cop and no one would ever think a cop would be stupid enough to do that! Clearly though; someone did this to John and left his body on the front lawn of a police officers house!

    It seems highly unlikely that Higgins would be going to the Canton PD to "move vehicles" &/or "do administrative work" after drinking whiskey for the better part of 12 hours that day into evening, & into early next morning?! Maybe longer than 12 hrs, considering they'd been to a wake/funeral out of town, then stopped for more drinks (and food) around dinnertime, then continued drinking booze on into the night at several more bars & residences~hillside, McCarthy's, Waterfall, Albert's house & his own house. That is a boat load of alcohol, & I don't care how well a guy holds his booze, Higgins was absolutely three sheets to the wind by the time he left the Albert's.
    My point is, something really unusual & out of the ordinary would have had to happen for him to go there that drunk~ wonder what the real reason was? First off, BEYOND against policy to be carrying weapons, driving police vehicles, & entering police facilities while under the influence like that~ no bueno. In his drunken mind, something was pretty darn important to prompt him to risk it like that...or, it was just more bad booze decision making. I suppose that could be it, but I doubt it. Imho, he was switching out his own personal vehicles, and/or items within one of them.

      Also it took him 30mins to 1hr to get to the station after he left, by his own testimony. The journey should have been 5mins tops, according to Buckenic's testimony. What was he doing that whole time?
      Was he so drunk that he drove round and round before he could find the station? If so, then as you said, why would he go and move vehicles in that state.

    The conspiracy about the Alberts and parties at the house existed long before the trial did! TB and company have been screaming it for years. If I was one of the people in that home like Brian Higgins or one of the Alberts I would do anything to prove my innocence! I’d give my phone straight to the cops and let them have at it if I had nothing to hide and wanted to clear my name! The fact that they got rid of their phones and not just got rid of, but destroyed them completely really makes you side eye them! What else did he have to hide?
    If he had to get rid of the telephone number all he had to do was go to his provider and ask them to give him a new number! Problem solved! Completely destroying a phone and SIM card makes no sense in that regard.

      Additionally no one saw his Jeep, except those in the house, not even Ryan Nagle who arrived before Higgins claimed to have left. We also know the time he said he left between 00:30 and 01:00, JO would have been there. He also should have made it to the station in 5mins, but it took him 30mins to 1hr to get back to the station.
      So many things are wrong with their own testimony. It raises too many questions and when you add them all together, it becomes difficult to fully ignore defense theory, no matter how ridiculous they may seem.

    The ME and 2 Feds experts said injuries weren’t consistent with being hit by a vehicle. That is what changed my mind.

    You’re missing the point with Brian Higgins the only messages he actually turned over was messages. He knew the defense would have. He knew they would have Karen‘s messages and he knew they would have John’s messages. Other than that everything was destroyed. He only kept what he knew they would getfrom the other side

      You may understand something I am confused about, so help me out please... Did he turn over those messages? Or did he pull them off his phone to hide them? Meaning, does the FBI "machine" keep or destroy the messages they pull off?

      ​@@juliao1255he used Federal tech and hardware with another fed to remove the messages with John and Karen. He turned those messages over.
      Then he destroyed the SIM card and phone and threw them away in two separate dumpsters on a military base.

    Why would Higgins "plow the Albert's driveway" if there was only a light dusting of powder that hadn't built up yet?
    Was Higgins trying to lay out a narrative to explain something just in case an eyewitness comes along to say that he saw Higgins drive up on the driveway some time that evening with his snow-plow?

      My theory is when Lucky came forward and was interviewed by FBI and said he saw a ford edge, they changed story to say Higgins Jeep parked in front to discredit him and why Lally asked him if knew difference.

    Colin told the prosecutor in redirect that he was a sophomore when he made the threats, but AJ pointed out on recross that he'd previously testified that he was a junior or senior.
    As I remember it, it was one of the Alberts who traded in their phone in for an upgrade the day before getting the letter telling him to retain it. Brian Higgins got rid of his phone before he received notification that he was allowed to - he never got that notification, and he said he'd heard that there'd been a ruling and so he got rid of it.

    There is no reason to sell Karen as an archangel just because she didn't hit John with her car. People need permission to think she is a jerk and that she is not guilty of these charges at the same time.

    I think it’s rather telling when Brian Higgins goes out of his way to VOLUNTARILY and SELECTIVELY produce evidence from his phone he knew would be damaging to Karen Read, BUT when the preservation order comes down suddenly there’s no phone to preserve anymore. This is a guy who works in law enforcement and knows the system. He’s not operating in ignorance, and I vehemently disagree with giving either him or Brian Albert the benefit of the doubt here. It’s not believable to me in both the timing and manner of how their phones disappeared in relation to the preservation order. I think based on the circumstances it’s far easier to believe they were not only tipped off but also thought they had a need to dispose of their phones due to something directly connected to the case and/or something directly related to their conduct as members of law enforcement.
    I think it’s very possible here that for some of the Commonwealth’s witnesses perjury may actually apply. We know for a fact Michael Proctor perjured himself when he testified on the stand that he had no connection to the Alberts, only to find out on cross-examination that he not only knew them but also employed one of them as a babysitter. That, and the Alberts openly discussed bribing Proctor for his handling of the investigation. Jen McCabe couldn’t or wouldn’t willingly answer a single question on cross without demanding to see a copy of her witness statement first, as if, like Trooper Paul, she couldn’t answer anything without a coaching aid or a leading question. Not a good look for the closest thing the Commonwealth had in terms of an eyewitness. Details like these lead me to believe Jackson more than these witnesses.
    Also, I have butt dialed before and have been butt dialed. It requires a pretty large leap of faith to believe these phone calls were butt dials. I think an application of Occam’s razor gets us to the truth on this matter.

    In the letter announcing them removing Proctor it is clear that he was being looked into because of his testimony in court and was not being investigated before that.

    He said someone got his number through “open source” and if true, wouldn’t there be a possibility they could get his new number in the same way? Destroying the SIM and ridding the phone seems so drastic and unnecessary - unless you wanted to ensure data stored on the device itself wouldn’t be forensically recovered.
    Why not just call your carrier and have them assign you a new phone number?
    This is wild.

      I've been trying - because Lee brings it out in folks, darn it - to see both sides, but there's still reasonable doubt - even sans third-party issues.

    Well, I love this channel now. All legal analysis have a diff perspective (i watch all the Attys) but i have learned much more and gotten much better understanding from this channel. So Higgins arrived bf there was 1/2 inch of snow and strange he would truly drop his heavy metal plow to scrape up their driveway ....

    I'm curious about the bruising on John's hand, if he had no pulse and wasn't breathing and had been there since 12.30...how could his hand bruise? All blood flow would cease. So it couldn't be from cannulation. The last place to try would be the hand because a) the patient was hypothermia, so there would be no blood flow or very little to the extremities. There first thing they'd do is put in a central line to get vital drugs to his heart. So what caused the bruising to his hand. Interesting that it just happens to be his injured arm.

    I have read BH is in re-hab..what went on with the Jury..we need to know the split..did they actually believe the lead investigator MP..did they miss all the things he didnt do..would they not at least find that to be more than suspect..wonder what they are thinking now when they can read everything?

    Lee pls point out: Its not important that he lost photos etc on his phone. No one mentions that he threw it away ON A MILITARY BASE where as a law enforcement officer HE KNEW the local and state police wouldnt be able to search federal property.

    I have decided that the McAlberts don’t care about John, they care about their image. If they all loved him so much then why did they let either of them drive after drinking together at the bar.     My theory is…John O’Keefe was at the house waiting for the Alberts to arrive. Brian Higgins drove up in his jeep with the plow and O’Keefe confronted him about his interest in Karen. They got into a fight and Higgins was angry, he managed to cause John to become unconscious he then moved him with the plow and covered up his body. The injuries would be consistent with that scenario.
    That is the only way I can make this compute in my mind

    I love your methodical approaches to cases and the clear, well organized visuals. I wonder if you'd consider doing a breakdown of the ARCCA testimony, or at least highlight in more detail the points you thought were weak or omitted. I think it would be extremely helpful to hear a walk through of at least some key selections of from an intelligent non-hostile person who still has questions about it. I heard the answer you gave in the moment, but it almost seemed to imply burden shifting which I'm sure is not what you intended,. Thanks!

    Lee~ another channel here on RUclips, "Truth Revealed" has some very interesting analyses/theories on this case, specifically Higgins potential involvement. He is a former federal investigator/interrogator I believe. He has spent a significant amount of time on the witness testimony, especially the language & word usage from each of them. I think you might find it interesting.

      That is the right word for sure. With what the prosecution did between the undisclosed inverted video and Lally's closingt statement "mistake" misrepresenting the evidence I would not put it past them to get someone on the jury to vote guilty.

      Sadly, I CAN believe there were idiots who thought the case was actually PROVED beyond a reasonable doubt. This is why I don't think much of our legal system. Anyone who thought the case was PROVED is just not very smart. I think one or two of the jurors took a dislike to Karen for some reason and decided that no matter what she was guilty. They probably just decided that they "felt" like she was guilty and therefore just ignored the lack of evidence to prove it. And if it was 10 "guilty" then there were TEN IDIOTS!

    This whole 'romantic kiss' leading Brian Higgins on just doesn't convince me. I might be convinced if BH was 14, but he's a divorced man in his 40s (at least). If he's so pathetic that he would base a vendetta around a bit of a flirtation then I think he's probably batty enough to set the person who slighted him up to take the fall.
    At this point, the only person whose story I find believable is Ms Read. With one exception....why did she tell Paul O'Keefe's wife "let’s just remember the bad times and I'll never see you again" - or words close to this. That's a bit squirrelly. Why would she tell a woman she has been friends with to 'just remember the bad times"?
    Re the ARCA report. Didn't the Judge limit what they could testify on? Judge Cannone didn't want to allow it in in the first place. Then recanted but with provisons, just as she did the with the Dr who testified about the dog bites - despite her being eminently qualified to testify on all the medical evidence.

    Hi, Lawyer Lee, have you seen videos by Sergio Dinaro, Truth Revealed? I don't know how good his credentials are-his analysis and opinions seemed to make a lot of sense to me, something finally. And especially explaining what happened AND that John O'Keefe could have been injured without ever getting into the house(not by KR though).
    I'm not sure if the timeline is perfect, maybe it's actually better?
    I think it makes more meaning of Higgins actions than anything else I've seen.

      Can you tell me which video that is? I’ve watched many of his videos but don’t recall one in where he discusses this. Not sure about his exact credentials but he does explain in one of his videos. I forgot which one it is now but he did some type of analysis in law enforcement.

      Oh and I have also thought there is a possibility that JO was injured by another party prior to entering the house that wasn’t Karen. Who it was, I’m not sure! I’d love a solid timeline written out of everyone who was at the house and when they arrived. How do we know there wasn’t someone following them or another drunk driver? Still I don’t believe John was hit by any car. 3 witnesses including the ME and 2 FBI guys said that his injuries are not consistent with being struck by a vehicle. That is pretty powerful

    Have I been convinced beyond reasonable doubt that Higgins did it? Of course not. This wasn't the venue for that. And he might never face consequences either, even if he did do it.
    But it certainly left me thinking that there was no way the house shouldn't have been entered and searched.

      There was no reason to do that because: a. John was found covered with 4-6 inch of snow, but under his body no snow with pcs of glass & tailight on him , his shoe ,phone found around the scene which indicated the incident occured outside b4 snow started sticking.
      B. Everyone in & out of that house including Karen said they did not see John enter or in the house. I think they did prove he did not enter the house with his cell phone lockingdown @ 12:35 am at the location he was found. Prosecution on retrial should focus on that fact ,which would debunk all third party claims.

    Next time, they need to include the backyard as a potential crime scene. That corner of the backyard behind the gate by the drive (the third gate, that was never mentioned) was not visible to people in the house. It eliminates the need for a broad conspiracy.

    I think BH was covertly asking JOK if he was going to the Alberts because he wanted an opportunity to hook up with KR again. He didn't care about JOK going there, he cared about KR going there. Its ridiculous to believe BH would kill JOK because he wanted KR. KR showed interest in BH first, not the other way around. There's easier ways to get the girl then murdering the bf, esp if the girl has already initiated interest

    Ya know, just for the sake of argument here....and I'm in the camp of JOK getting sucker-punched by Collin (and more, after seeing his knuckles...) - what would've been so awful about a fight breaking out and calling ambulance?     It seems clear to me that something happened to John in that house. The testimonies of people at the home were pretty bad in my opinion. There is so much evidence that something else occurred. And a cover up for sure. I think that Karen yelled that she hit John was because her brain was in panic and trying to come to a logical explanation. She found him where she left him. So, those were the facts as she saw them at that moment. Imagine this story without all of the police shenanigans. That's a different one. What are the people who think she's guilty doing with the shenanigans- in their minds.
