As Interest on NRE deposits is tax exempt and Form 26 AS do not include the details of NRE deposits,
a) Is it proper on the part of banks to
show NRE deposits ,as time deposits in the SFT form (which includes deposits of NRO and NRE fixed deposits as TIme deposits)?
2. Income tax department will not
distinguish which is tax exempt b
and recently many NRIs got notice
submitted to income tax as NONFIlERS.?
3 Why the IT department will not modify the SFT to show NRE deposits clearly?
4 As per the CBDT circular instructions on guidelines , it is clearly mentioned that these tax exempt deposit details need not be mentioned in SFT, but banks treat all deposits as time deposits due to
lack of clarity.
5.As AIS /TIS are extension of Form 26:AS , why there is no clear directions issued to financial institutions on whether to submit details of NRE deposits and make mandatory to inform details of tax exemption duly mentioning the interest earned on NRE deposits, to
NRI customers in a specific format like formb16/16 A?

Hi, I am an NRI from Germany. I have question regarding paying tax on indian investment in Germany. stocks capital gain tax in germany is 25% so under DTAA after paying STCG/LTCG 10/15 % in India rest 15/10 % respectively I need to pay here in Germany. So I am looking for an option to do Indian investment under some other entity like HUF/ company, so I don’t need to declare this entity here in Germany and no need to pay extra 15/10% tax in Germany. Can you please provide more Information on that ? Do you have idea about it ?

Although interest income from NRE deposits is tax-exempt, We always advise our clients to file ITR in India if their total income exceeds the basic exemption limit.
