  • If you fly an RC plane or a drone then you are no doubt aware that the rules and regulations have, for many, taken a lot of the fun out of the hobby. One option for dealing with this is to simply ignore the rules. Is that really an option?
    In this video I not only demonstrate how bad my thumbs are at the end of a long day but I also talk about the importance of placing safety before compliance. I hope this video serves as a catalyst for discussion within the wider hobby community.
    There will be a second part to this video which discusses when it's okay to ignore the rules and when it's not. It will also discuss how to avoid getting caught and punished for what are merely "technical" infrigements of the regulations.
    Regulators must recognise that if the rules are not fit for purpose (ie: a sensible balance of freedoms and responsibilities) then they will lose the compliance of those they seek to regulate.

      Rules are followed by fools but wise people use them as guidelines. A variation on the famous phrase by Harry Day, a WW1 flying ace who said "rules are for the obeyance of fools, and the guidance of wise men".
      So rules exist for those who don't understand the context or have little experience. But the rules are guidance for those who understand the context and have a lot of experience. Those two points mean that its known what the rule is for and why it can be broken since the context means it's not appropriate or necessary.

    I once used a visual observer who didn't talk. I saw in the FAA rules that the spotter must be close to me but I never saw in the FAA rules that they have to actually be able to speak to me.
    True story.

      there's nothing in the rules says your visual observer can't be a dog and if they dispute it say duck hunters use dogs as visual observers all the time

    You're a living Legend, Bruce. Even if we get ignored, your efforts to rally the troops and stand up for hobbyists will not go unappreciated or be forgotten.
    I also fly noncompliance, but I also try to champion safe and responsible practices to anyone that will listen, since NOBODY knows what's even legal in Canada.
    I've had a few run-ins with the police, which have all been pretty relaxed. Only one of those three cops though had any knowledge of the rules, and because of that he agrees with me that the blank approach by lawmakers does not take into consideration people that fly fpv.
    I was lucky that he turned out to be a pretty cool guy and my neighbour, and a few days after we had our first run in and settled on an understanding that I will continue to fly there and be safe about it, he came back to the field a few days later, off-duty, with his new mavic Mini that he bought at Costco. We spent several hours together while I taught him how to fly it and took him for ride-alongs with my 5in freestyle. It was awesome.
    That being said, things are starting to get a little more tense as knobs are picking up DJI camera drones and flying them like morons in my area. It's definitely going to impact me...probably as soon as this summer.
    I'm really paying close attention to what happens in the USA, because we almost always just look at what they're doing and follow suit a couple years later. I love this hobby more than anything I've ever done with my life, and I'm really afraid that it's going to be taken away from us.

    Yeah speeding is also breaking the law but as we all know many do it...every day!! Lol 😅 I feel that the current regulations are so strict that if you were to adhere to every rule you would not even be able to enjoy the hobby. Excellent demonstration Bruce I appreciate all you do for our hobby. 🤟👍

      Speeding is a bad example: 85% of all road deaths are directly related to someone speeding.

      @@vonSchwartzwolfe I made that example because it's one of the most broken laws in my country and it has significantly way more risk than BVLOS and yet most Police will turn a blind eye unless it's very extreme.

      @@georgejones3526 As I'm sure that you are well aware Emergency Vehicles (Fire and Rescue/Ambulance/Police) MUST be given clear priority on all roads (when under lights!) and are free to use whatever speed their TRAINED drivers consider appropriate. The normal traffic laws are framed for the average yobbo driver.

      Absolutely...the FAA safety Org can not keep manned aircraft safe, how can they keep our toys safe and better yet the Huge Commercial drones that want to unleash on the country and with rights to do as they please inspite of everyone else

      These drone rules for us recreational users are all about shutting down the hobby, so commercial operators have full access! Mass non compliance is the only answer.

    Hi Bruce, as you know, I have been in this Hobby for 50 years and I have not registered. Not because I want to get away with breaking the rules, I try to fallow them, but the way they are written is wrong. Thanks again for the video and information.

      That is a good point. There is some data to suggest, that especially with men the willingness to follow rules and procedures of others decreases with age. This information was given to me by a hobbyist who was a commercial pilot and is a Flight Safety instructor and FAA certifier. He did a survey paper of mandatory retirement of British Commercial pilots as his final requirement.

    Very good Bruce. I very much agree that there are times when our governments are out of line that we simply must not comply. This is true with model aviation and any other aspect of life. If the last three years have shown us anything it is that our governments can go completely off the rails and overstep their role.

    Nice one Bruce!
    Clearly showing how over regulation is unnecessary and makes people less likely to comply!
    Let's have some sensible rules that are less complicated, easy to follow and promote safety!
    Here in the UK the CAA have made the drone rules so complicated they're tripping over themselves and don't seem to be able to make sense of the rules themselves!

    Well said Bruce. I myself have always used just good old commonsense when it comes to my flying. And sadly, using commonsense and acting responsibly is not enough for the authorities any more. So even though I fly very safely, I am no doubt breaking rules each time i fly. And I am not going to change a thing. If I was going to fly my quad around backwards, where i could not see where I was going, or if I was totally death and could not hear aircraft approaching, then no doubt I would use a spotter every time i flew fpv. But i can hear, and i fly forwards, and by using commonsense, I can fly fpv very safely without any spotter. Fly where it safe to do so, fly in a place where you will not be annoying other people, and fly responsibly. They are all the rules i need.

      Good for you but these rules are made for the segment of flyers that don't. And if you removed all the rules most would remain safe, but probably more would not since there is no consequences. Or do you believe safety has nothing to do with or without rules? You do not have freedom to cherry pick which rules are onerous or sensible, you can have an opinion, but your liability doesn't change.

    I'm all for organisations/governments making groups of people aware of non obvious risks, but I hate the binary right or wrong rules they try to crowbar in place on situations that really need a graduated scale of current risk Vs appropriate precautions. These "Go"/"No go" rules leads people to do things that, while technically within the rules, aren't safe or smart.
    As an example. Here in the UK, you can drive on a motorway at 70mph, and a good car (In good conditions with an alert driver) could probably do 100 all day without any significant additional risk. BUT the limit is 70, so that's what you have to drive at. The problem is, people start to think "70 = safe", so they get a false sense of security through being within the rules, and don't actually use their own judgment. So when it's -10'c, foggy, AND it's snowing, you'll still have some people zipping past who seem to think "The limit is 70, and 70 = safe" dispite the people who are thinking for themselves deciding that 40 still feels a bit too quick, so they're dropping to 35.

I have been doing this for sixty years as well, and I don't intend to let this age of hysteria stop me. I would send flowers if they could fit through the USB port.

    To best of my knowledge the only incident in Canada involving an aircraft and drone involved an RCMP drone flying into an aircraft.

      The Canadian police did it *TWICE*. They flew a drone into a Cessna and before that they (the RCMP) flew a drone into their own helicopter. They lead the world in proving that being safe is not always the same as slavishly following rules.

    I will continue to say it, as the rules are currently written none of us can comply . Because every time we fly we break those rules. be it fixed wing or quads ( all drones btw ) NO ONE if being safe can keep their aircraft in LOS throughout the entire flight as the rule states .
    The Observer/Spotter who also has to follow that same rule also can not ( if doing their job) can keep the aircraft in LOS throughout the entire flight and also be co-located with the operator. They are not allowed to use anything but their own eyes, can not use binoculars , a walkie talkie, cell phone etc to communicate with the operator . SO IF the observer is watching the skies and the area for people, animals, whatever they are NOT watching the drone throughout the entire flight .
    Not even in a FRIA ( Club field ) does a pilot watch the aircraft throughout the entire flight they can not and be safe, because other aircraft are also flying there and even people walking about and people calling out what they are doing, a human being looks to see, watch other aircraft etc because THEY MUST to stay Safe and keep their own aircraft in one piece.
    Thus also BVLOS is also being broken by all and especially FPV operators who fly BVLOS the second the goggles are lowered over their eyes and the way FPV is flown the Observer also again Can Not keep that aircraft in LOS throughout the entire flight....BUT we had NO ONE setting with the FAA/CAA whomever to simply stand up and tell them IT CAN NOT BE DONE , nope they we will bow and give in approach and later we may address a few issues....that ideology was and still is Maddening .
    Now it is the weight/size demand to raise from 250 grams to 1 kg . Something me and others addressed in the NPRM awhile back , also other means already in place like the LAANC system to also comply both in controlled and even in uncontrolled airspace and in fact in that NPRM the FAA stated that Congress tasked them to use that system .Then the RID module yada yada, BUT it also could easily be complied with IF the current system was used by everyone, but here we are with the call the Reps, write them , also something we did before . SO as I said on JB's video, I am a half glass empty type, I can hope, but I do not hold my breath about it.
    BUT all of this could have been avoided if we just had people who would simply stand up and did what we suggested from day one . The Courts showed registration was illegal and Unconstitutional, so the commercial lobbyists and their paid off Congress people slipped it into a defense bill...BUT instead of taking it back to court ( as it was already adjudicated) NO ONE would do that SO here we are with an illegal registration mandate and then the RID itself also should have been appealed to a different court because it was the DC Court that ruled the registration illegal and then the Dc Circuit ruled RID is legal ( a total contradiction to hundreds of other cases ) ..but again Brennan is MIA and his legal team SILENT and the majority of the YT guru's just obeying and telling everyone else to do the same....and now telling everyone about what me an others talked about a long time ago about the weight limit rise and contacting Reps , we did that then as well and here now they are screaming gto do the same...very maddening to me
    But now the commercial people are screaming about this BILL in Congress www.congress.gov/bill/118th-congress/senate-bill/157/text?s=1&r=38
    and demanding everyone step up and do something to help speak out about it. What i find ironic is those commercial minded little sell outs who claimed to speak for the hobby as it was being restricted and regulated away in the FAA meetings and committee's and groups and ones like Vic Moss and Kenji who sat and did nothing to address the real issue, they now are facing one of their own that could potentially put them out of their commercial businesses.
    SO wonder how they now feel ...LOL
    Right now noncompliance is the only way we can fly. We can put on an appearance of complying while not complying because the FAA is clueless of reality and how this hobby works. Simply stay away from the morons and you will have no issues for the most part and STOP posting videos on YT that show your illegal actions

    I make sure that I am in an area that is legal. I make sure it’s not close to an airport. I make sure from the online webpage that identifies go no go places. When I fly it’s mostly in daylight and if it’s somewhat dark, I make sure that I have navigation lights on. Still, I suggest all to go ahead and get your 107 in the states. Oddly enough we need to recognize this as nothing more than a tax. If the goal was to deter using drones as a Weapon, the requirement will not stop that from happening. There is no way to stop that from happening. Thanks for the video and I would love to see your latest model aircraft build!

    I'm the same way. I hate making trouble, and I hate being a bother to others. If I go to the local park to fly, I generally check to see where people want to be and avoid the space. If I fly far, I never linger over the roads, avoid homes, and check local hazards beforehand. (migrant birds, cropdusters, incoming rain, and red flag warnings) To this day, the most dangerous thing I've done is crash a Mobula 7 into my own head. My disgust at the regulations does not make me an idiot that dive bombs strangers, spies on neighbors, and trespasses as he pleases.

    Ironically, the only two RPAS collisions in Canada have been done by police. One was hovering off the end of a runway and hit a Cessna on takeoff. The other was a collision between a police drone and a police helicopter.

    I'm just wondering who cares? Does anyone pay attention to these current or proposed rules. I have been flying for well over 20yrs in Rc planes drones gas and electric and have never had anyone say one word. So, I would say just relax and enjoy your flying. Thanks Bruce love your Videos.

    In Europe they have become totally crazy. I appreciate safety and am very risk-adverse, but I fully agree with the message of this video. I fly within Visual Line of Sight, am cautious to the bone, but often fly without spotter. My heavier 5” quadcopters I often fly in areas with fences around or in areas where another person doesn’t have a reason to be normally. In the cold winters I keep flying to maintain my flying skills, a safety-aspect often overlooked.

    I have been flying models for more than 40 years, is a commercial fix wing pilot.
    I have gone undeground with my model flying as the rules have become ridicoluos, much more burocracy and politics than actually improving flight safety.
    Much of this is made by people who have very little actual knowledge of model flying.
    I know because I have been involved in the process and have left, having lost my faith in the system.
    I am very aware not being a burden to others, and certainly not doing anything that can endanger others by my model flying.
    I simply refuse to blindly follow rules that make no sense.

    Thank you for presenting the logical facts and good behavior. Most responsible adults are good, sane, prudent law-abiding citizens (until recently, say the last 2-3 years). I will also say I tried this logic when I was pulled over in my BMW-340i for driving responsibly 95mph on a high occupancy vehicle lane with literally no other vehicles around .... the officer (good natured) asked "what were you thinking?" ..... I informed how often I did club racing on the track, in a very safe car .... still earned a citation.

    Should every pilot comply with local rules/laws? I think that’s up to each to decide based on their own personal situation. Should every pilot fly safely? I absolutely think so. Personally, I “break” the rules here in the US almost every time I fly by flying BVLOS. Have zero concerns about it because I ALWAYS know where my drone is, I ALWAYS have FPV video showing the drone surroundings, and I strive to keep the majority of my flight time over unpopulated woods, fields and water. I will ALWAYS fly this way. Forthcoming Remote ID this September is a non-event to me. Fly safe!

    Where I live I'm surrounded by uninhabited countryside yet the f35's from an airbase 40 miles away choose to fly over this inhabited area to do dogfight practice even swooping low below 1000ft occasionally. I don't understand why they can't do that over the uninhabited areas. Why fly over populated areas and create noise and risk? Yet if I fpv a drone over an uninhabited area I'm dangerous somehow.

    Thanks Bruce, l completely agree with your views on the subject.
    Flying on my own land, in a valley, staying below ridge top level, half a mile away from my closest neighbour poses no risk whatsoever to anyone or anything.
    I shall continue to fly RC with my best mate exactly as we’ve done for decades.
    Stuff ‘em, the whole thing is bloody ridiculous.

    Great video Bruce! It's also about probability: I keep track of my flights and crashes. I have around 98% chance of landing my aircraft planned (records over 15years and thousands of flights). This means only 2% are maybe problematic. Now if I look at these 2%, 99% of them were far away from dangerous situations (like people or property nearby). And yes, even with my 60hp little old Mercedes I managed to get a speeding ticket ;)

    Totally agree Bruce. I have a 25kg drone licence and full size pilot licence to lose but I will be non compliant with Remote ID and registration (when it comes to Australia) for my model aircraft and camera drone anyway. i agree completely - Fly in such a way that it does not draw attention to itself.

    The rules are there to prosecute you, "at their discretion' . And drones are easy target to boost statistics

      Funny thing is, all the cases of drone pilots doing something to get prosecuted was they were already doing something illegal in the first place, so they thought putting more laws in place would make it better, lol

    Completely agree, civil disobedience is the only way to fly these days. 514h of flight time, still haven't crashed a single time or damaged absolutely anything. I'm a photographer, I've been taking photos for the past 17 years (2 years with drones) and drones are the best camera for landscape and architecture, and I'll keep using them no matter what. RID, fines, karen apps, aeroscope, throw at me whatever you want.
    Does anyone think we spend 2.000€ or more to crash them on somebody's head? No one has died in the entire world by a drone accident of any size. A

    I got a fpv goggles etc during lockdowns, not really knowing the rules at the time, just some basics of 101 with the tree line thing etc so mainly fly around my place keeping around the trees not going too high, if I hear a aircraft I stop and go low or land,
    The most I have done is went down to a local quarry that is no longer in use and some people use it for walks and swimming etc, when I was flying with the headset there, I always looked around with my drone to make sure it's clear before flying to a spot, if I see someone I fly the other way keeping my distance, I do hope they change a rules in a good way but who knows, the rules do scary me a little not wanting to fly the drone much outside my place, and looking at 102 is also bit scary for me but I'm glad there are people like you who keep fighting for the right thing,

    Well that's good regarding safety and the CAA in NZ. Some not so common sense.
    How I see these rules ( not all ) is they are a raised big stick , just depends who has hold of that stick.
    Confucius say " Man with noisy whoop should not comprain about noisy chain saw" or he would have !
    Am over 60 myself and use my drone to save myself a lot of walking up and down muddy hills on a large farm to check various things out , often at over a 3/4 K . No one there , No harm done.

    In the US its more about if a prosecutor can get a feather in their hat conviction than if anything was unsafe or it makes sense to go after people. The other main driver is if the gov can make money off of it.

    Great video Bruce. I'm in Canada and currently enjoy flying my 250 gram drones with a large amount of freedom as this is the ONLY one that applies as you also mentioned in the video:
    "900.06 No person shall operate a remotely piloted aircraft system in such a reckless or negligent manner as to endanger or be likely to endanger aviation safety or the safety of any person"
    I hope the Americans are successful in raising the recreational unregistered class from 250 g to 1 kg as there have been a few great videos on how unscientific the 250 g 'folklore' number was derived. As Transport Canada has often followed FAA, perhaps someday soon I can fly my less than 1 kg drones that are sitting on the shelf.
    It's all well and good that I or any other individual can choose to non comply and fly what/when ever they want (not suggesting that I do). However, organizations and educational institutions don't have the option to non-comply and it becomes really important especially for young pilots.

    I think cars are the best example case. No matter what you do, there will be those who break the laws, but never have i seen or heard a person kill someone breaking the rules. Death or injury happens only if they become unsafe when doing so.

    I fly mostly non compliant in a field near my home. Almost all people that pass by are enthusiastic to see me flying. They love our hobby but are not aware that there are people that want to kill it when I explain what is going on

    I would have to spend at least a couple of hours training a spotter on how to operate my FPV Arduplane FC planes, its modes, how it handles in each mode and how to fly it, including min stall speeds when on approach etc. Then they would have to be willing to endure an hour long flight at the least and possibly more if thermals are involved, just being bored but ready to take over at a moments notice. I'm in a club of 30 members and NO ONE wants to spot me or do ANY of that. So they are happy to just let me sit in the corner and fly, always staying away from them, without any issues whatsoever.

    in Canada we have had at two drone strikes causing damage to aircraft, in both of the instances I know of the drones were operated by police forces , one in Ontario and one in British Columbia.

    As someone who has zero speeding tickets or parking tickets against him in nearly 50 years of driving I am perhaps an unlikely advocate for non-compliance. However, there is no doubt that governance has now moved into a new realm of restriction that, thanks in part to the availability of technology to make enforcement possible, is accelerating at an alarming rate. I think few of us would, at the start of the Covid outbreak, have believed the extent to which our leaders would warm to the idea of restricting the most fundamental freedoms we would all have considered beyond touch outside of an extreme totalitarian regime. But now we see the start of implementation of restrictions of movement towards creating mass penitentiaries called 5-minute cities.
    High time we cleaned the stables and rid ourselves of the traditional political parties that have shown themselves all to ready to dispense with the freedoms of the electorate they purport to serve.
    Unfortunately, we are all too willing to ignore the encroachment of law on the freedoms of others so long as it does not impact on something we want to do. Since most hobbies are indulged in by a minority our political leaders have found it all to easy to pick us off one by one without raising general protest. Indeed there are many who get a great sense of schadenfreude from reading about the latest governmental dumping on some enjoyable pastime.

      Yes, safety trumps slavish compliance with poorly designed and written rules *EVERY* time. Just look to the Canadian police force for evidence of this. They would not break the rules, would they? Yet on two occasions now they have flown their own large/heavy drones into manned aircraft.
      Rules for thee but not for me?
      Safety first and use the rules as helpful guidance rather than a straightjacket.

    I have been with you for years, Bruce. I love this hobby and the wonderful folks you meet in it, but regulation has choked us out. I have not flown in a long time, but this spring is different. A friend of mine wants to learn and fly so I think we will find a nice spot and just do it!... Safely. It's only illegal if you get caught, right?

      So true. To be honest, even *I* am staggered by the number of people who have stated that they're no longer focused on "compliance" and will instead simply use good judgement and commonsense as a way to ensure safety. The regulators really have now lost a great deal of compliance from those they seek to over-regulate. I suspect they're unaware of that fact but eventually the penny will drop.
