- The plaintiff was hired to seal the defendant’s driveway. He claims the defendant was happy with the work but hasn’t paid him for his services, so the plaintiff is suing. The defendant says the plaintiff didn’t use enough sealant in the cracks and potholes, and it looked like an amateur did the job.

I think the problem was the hoa president thought the coating would fix the cracks and it was cheaper. But it didn't. He only was quoted for the coat. Not anything else. That is why the other company charged more.

While I agree he did a crappy job the next company charged nearly double. So of course they did a more professional job.
That's like paying Maaco $800 for a paint job on your car and complaining about dents being painted over or flaws in the paint. When a decent shop would have charged you $2500 or more.

Problem with this, dealing with HOA.
Seal coat doesn't fill in the cracks. He wanted a new parking lot on a beer budget. HOAs will try and screw over every contractor and it ends up costing them more calling in someone else. Even this guy said the other company charged them 1300 for second coat.

That job looked like crap. The plaintiff didn’t fill the cracks or pot holes or do the striping and it will probably cost more than $200 to fix all of that.

The Defendant was trying to get off cheap by not getting the expensive tar & seal. The Plaintiff sounds like he's used to the type & does the job they pay for. In the middle of the job, the Plaintiff saw the seal wasn't going to be enough but still trying to work the cheap route. I agree with the Plaintiff. Defendant wants him to do more but, you haven't paid for the initial job. Plaintiff ain't no fool.

@shaydaslays I personally don't think it's about race the man was white he mentioned he was Italian,,second he was coming out of his podium so she told him go back she mentioned that she new his pain meaning that she understood because Latin people speak with their had in particular she said she was Cuban which is not a race it's a culture. In the USA people confuse race with culture. In the Hispanic community we have blacks ,white,even Chinese, my friend's husband was born in Cuba and his parents are Chinese. I'm Cuban and the 4 grandparents of mine are all from Europe 3 from Spain and 1 frim France I'm white with green eyes.I personally don't think she was referring to race

Written contracts? The judge doesn't seem to realize that people run for Condo and HOA board positions precisely because they want to make decisions for the organization without restraint.
Pay 700 under the table and charge condo owners an additional 500 each to cover parking lot repairs.

2:55 That CANNOT be true. $700 included painting the lines. So recoating the lot would paint over the lines. It sounded like he wanted him to do a second coat of sealant before the lines.. which would be less than $700.

A sealcoat is not filling in potholes. They're two different things. The sealcoat needs to be sprayed on too. I've never had an asphalt company do such shoddy work. The contractor doesn't know what he's doing. And as for the condo, get a property manager who knows what they're doing. All this stupid stuff could have been avoided.

The condo president should be fired as he does verbal contracts for the other members & doesn't own a phone to take pictures. Who would vote him into the office as a person you expect to be responsible? Does he personally have receipts for the other work done for the condo members? Are any of his relatives doing work for the association? Is his wife the treasurer?
