I'm not sure I buy the cubic pod shape idea as innovation. It's just another shape that does the job and only time will tell how it weathers the storms. As an alternative I have seen 3D Y shaped breakwater shapes that have been for more than 40 years at the same spot and they still look pristine. Those Y shapes take far less concrete to make and if you are worried about CO2 you should use those instead. But those can't be patent protected, the shape is free for everyone to copy

Legal battles with big monopolies over petty interpretations trying to stifle the smaller competition bringing their product licences to market are a reality as well. My guess is that the Dolosse is more complicated and time consuming, and thus more expensive, to manufacture due to its more complex shape. For a product that is needed in the tens of thousands, that's an important factor to consider.

Copyright and patents are the pinnacle of capitalism in my opinion. Not sure what to say on this one. It is great when those ideas are shared, in a way they actually are. Only somebody is able to reap those benefits from that invention. Some inventions, not all, take also a huge investment in order to realise it. Patents will invalidate over time. They drive the world forward. Personally I don't mind somebody is reaping some benefits. What I don't appreciate is silly patent war and people patenting melodies are stuff like that. All and all it's difficult discussion and everybody will something different on it. It basically is Capitalism vs Communism.
