जजों की नियुक्ति पूरी तरह पारदर्शी ही होनी चाहिए। वर्तमान व्यवस्था वैसे भी सक्षम नहीं है। इनकी नियुक्ति के लिए एक भर्ती परीक्षा और साक्षात्कार अवश्य होनी चाहिए और इसके लिए निष्पक्ष और कानून का ज्ञान रखने वालों की एक कमिटी होनी चाहिए।
जिसके भी परिवार का पहले कोई जज बन चुका हो उस परिवार का दूसरा कोई भी व्यक्ति जज ना बनाया जाए।
पिछले 50 साल से कमजोर गठबंधन सरकारें बनती गई और कोर्ट की शक्ति बढ़ती गई।

कोलेजिउम् सिस्टम को पुर्न् रुप् से बन्द् होना चाहए दक्ष्यता आधार पर सर्वोच्च पद जज का नियुक्त होना चाहिए
जजों के चयन में बदलाव की ज़रूरत है।ज़्यादातर बुरे अपराधी लोग सुको से राहत पा ही जाते हैं।

इस देश के बुद्धिजीवी न्यायपालिका में परिवार व मित्र मंडल (कोलेजियम ) द्वारा जज नियुक्त किये जाने पर चुप रहते है। पर चुनाव आयुक्त के चयन की कमेटी में CJI को न रखने पर रोना गाना मचाते हैं । इस दोगलेपन की मिसाल शायद ही किसी देश में हो।
आपके विचार सही है.! लेकिन CJI और उनकी बिरादरी वो विचार नहीं मानेगी और सौं प्रतिशत विरोध करेगी, उसके लिये रस्ता क्या?
जजों के चयन में बदलाव आवश्यक है सबसे बड़ी बात उनकी ईमानदारी की मनोवैज्ञानिक परीक्षा व जांच आवश्यक है
हमारे देश में ऐसे ऐसे व्यक्ति जज बने बैठे हैं जो, एक याचिकाकर्ता के यह निवेदन करने पर कि उसके खिलाफ देश में दायर सभी याचिकाओं को एक ही जगह सुनवाई के लिए एकत्र कर दिया जाए, उस पर बरसते हुए कहते हैं कि उसने देश में आग लगा दी है। विचारणीय बात यह कि क्या वस्तुतः वह जज बनने की योग्यता रखते थे?
न्याय व्यवस्था मे एक नही बहुत सारे बदल करणे कि आवश्यकता है.
न्यायपालीका पर देश का जनता का भरोसा उठता जा रहा है , बदलाव की शीघ्र आवश्यकता है तथा कोलेजियम सिस्टम पूर्ण रूप से समाप्त होना चाहिए ।

सरदानजी आपने सही विषय उठाया है जिस प्रकार से मेडिकल में अलग अलग डिग्री अलग अलग विषयों में मिलती है,जैसे प्लेन एमबीबीएस सभी बीमारियों का इलाज कर सकता है लेकिन वह किसी भी बीमारी के विशेष इलाज नही कर सकता जैसे जहां सर्जरी की आवश्यकता है वहा अलग अलग सर्जनों की आवश्यकता होती है उसी प्रकार दिल की बीमारियों के लिए भी अलग अलग डॉक्टरों की आवश्यकता होती है कोई केवल दवाई से इलाज करता है कोई स्टेंट डालने का ही कार्य करता है और कोई दिल का आपरेशन करता है कहने का मतलब यह है कि अलग बीमारियों के लिए अलग विषयों का जानकर होना चाहिए उसी प्रकार जजों की भी अलग अलग विषयों में उच्च शिक्षा (जैसे मेडिकल में डीएम कार्डियोलॉजी, डीएम गैस्ट्रो, डीएम, न्यूरो आदि) होनी चाहिए और फिर वो उसी विषयों के केस ले जैसे क्रिमिनल मे उच्च शिक्षा प्राप्त जज को क्रिमनल केस, सिविल वाले को सिविल केस, फाइनेंस वाले को फाइनेंस वाले केस लेना चाहिए, सरकार या संसद को कानून बना कर इसे लागू करना चाहिए
चयन चाहे जजों का, नेताओं का ऊँचे औरतों यानी फ़ौज, पुलिस औरसीकयूरटी एजेन्सियाँ , सभी के चालचलन पारदर्शी और जवाबदेह होना चाहिए

लॉ डिग्री के बाद 4 साल का सेंट्रल इंस्टीट्यूट के अंदर में जज बनने का सघन कोर्स होना चाहिए मिलट्री ट्रेनिंग जैसा और उसके बाद फिर एग्जाम के बाद जज बनने चाहिए और हर स्तर पर निजीकरण से दूर रखना चाहिए साथ ही जज और उनके परिवार की संपत्ति और संबंधों पर हमेशा निगरानी होनी चाहिए
The present process of selecting judges is totally bised. The collegium system must be repealed. The central government must make law for appointment of judges .

हाईकोर्ट और सुप्रीम कोर्ट में जजों कि नियुक्ति कॉलोजीयम न हो कर निचली कोर्ट के काबिल जजों में से भी अच्छे जजों को चुना जाए, अच्छे वकीलों में से जज चुने जायँ इसके लिए हाईकोर्ट और सुप्रीम कोर्ट की निगरानी में एक प्रणाली विकसित किया जाय

जजों के चयन व नियुक्ति के लिए योग्यता ही प्रमुख मापदंड होना चाहिए। जब आई ए एस परीक्षा पास किये बिना कोई व्यक्ति जिलाधीश नहीं बन सकता तो क्या जजों के लिए भी जुडिशियल प्रतियोगिता पास करना आवश्यक नहीं होना चाहिए?

लोकतंत्र में कानून बनाने की व्यवस्था लोकसभा को है सर्वोच्च न्यायालय के न्यायाधीश मिलकर कोई कानून कॉलेजियम का नहीं बनासकते अतः न्यायालय में सुधार की बहुत अधिक आवश्यकता है बदलते परिपेक्षमें न्यायाधीशों की नियुक्ति विज्ञापन के द्वारा वह भारत की आवश्यकता को देखते हुए यदि किया जाए तू न्यायालय में सुधार भी होगा न्याय अच्छाभी मिलेगा

Sir very good insights, it is clear that Judiciary does not abide to NJAC which is a law made by parliament. If they don't how do we push this through the judiciary and make them accept? We can give 100 points how NJAC is better but they don't listen.
Recently, I came to know that Mr. Kailas Nath Wanchoo was appointed as CJI, in 1967. Mr. Wanchoo was just an ICS officer but not having the knowledge of law because he was never been law student.
What is law?
Law is codified commonsense reduced in writing and duly passed by legislature. Law graduates knows only code that is section number.

This is highly objectionable process is going on for selection of Judges. Therefore our government must take immediate action for juciary reforms to make the selection process of Judges for high courts. Parliament is always suprior. There must be advertisement, must be written exam and interview like UPSC selection.

परीक्षा उत्तीर्ण करके ईमानदार और योग्य कर्मचारी (जज) मिल जाएंगे आवश्यक नहीं है, सरकारी सेवाओं में चपरासी से लेकर आईएएस तक सब परिक्षा पास कर के आते हैं परंतु कितने ईमानदार है सब को पता है।
जिसके भी परिवार का पहले कोई जज बन चुका हो उस परिवार का दूसरा कोई भी व्यक्ति जज ना बनाया जाए।
जब सिविल सेवा के कर्मचारी फसते है तो फिर उसी कालेजियम का सहारा लेते है!
It is correct that competent persons must be selected for posts of judge. It is the responsibility and duty of appointing authority to ensure this and as President is appointing authority, President is responsible to ensure it. The supreme court will always object to any change in the present system as many of their wards are in waiting. To say that judiciary should be independent, is myth, as judiciary is dependent on beurocracy for execution of all is oders and for their salaries and financial matters. The best way out would be to make an alternate system which is more effective , easy, and transparent and make the SC redundant only for constitutional matters.
