Pokémon GO has been under scrutiny since launch simply because of the massive amount of people playing. Now some are taking action against Niantic, claiming that Pokéstops are a form of trespassing. Let's talk this out.

How is placing an object that doesn't exist on a certain location trespassing in any way?
If these companies don't want more business, that's their own fault. Why can't they just contact Niantic and request a removal of a pokestop/gym? That's what my school did with a pokestop on campus that actually had something to do with the school.

It's not everyone, just the snowflakes who can't deal with anything that goes against them in any way.
It's not just companies though, it's also private property, graveyards etc. Not saying they're right to sue, but there are legitimate reasons to be upset that the game is bringing unwanted visitors.

I agree completely. Even if a virtual object can be said to be real and fall under existing laws (which it is not, and therefore does not), Niantic didn't physically come onto the property to place it there, so if anything, it would be Littering - not Trespassing. Now, does Niantic encourage loitering and trespassing? Yes. But there is no real world monetary or other actual incentive to this game, so I fail to see how Niantic is culpable for anyone's actions.

Tamih I DISAGREE because If someone dose not want a pokestop/gym on there property Niantic should remove i is live in a rural area so if a dog fox deer or something like that is on my property I shoot it. if people come on my property I kindly ask them to leave if they show up uninvited I get that if there is a pokestop on my 10 acres of land people will want to come on my land but not everyone stays aware of there surrounding so I think what some of these city states are doing.

You should do a behind the scenes video. I know how much effort you put into your shots, I'd love to see how you place your camera and walk away and come back, retakes, and bloopers. Even the way you match up catches with the scenery. I'd like to see the creative process!
what annoys me was it was all there for years before with ingress, yes alot less players with pokemon go, but its not pokemon gos fault, ingress player like myself submitted 'portals' of land mark and iconic buildings.... to make the game what it was... a adventure, go find new shit in your home location. but no.... blow ups about pokemon go, like that guys whos house is a church.... its a church, a land mark, it was a portal years before it was a pokemon go stop, and poss even before you owned the house/church ( i dunno on this but im guessing..) get over it, people are/were getting out and about...
Its about foot traffic, not pokemon go. If ingress produced as much user as pokemon go, it would be the same issue. Also doesn't matter when he started living there. Its his property and he should have a say. If someone trespasses on his property and they are shot, bitten by a dog, or just hurt from being on his lawn. Who is at fault? Owner, the trespasser, or niatic?

drink15 niantic isn't responsible for ANY actions from its players whatsoever. Suing niantic for tresspassing is as idiotic as suing Rockstar because a mass shooter used to play GTA before going to jail.

Which exactly what clickbait is, badly wording title which make user need to watch it to confirm what is in the video. Whats wrong using more clear title like, NIANTIC GETTING SUED, thats more clear and only cost couple extra alphabet.

it's hardly niantic's fault they constantly remind us not to trespass. if getting a dragonite would require me to trespass(I don't have one yet because I don't live in California and I don't hack) then I would not go and get it.
Doesn't matter whos at fault, its if you can prove it in court. A reminder means nothing except they know people are trespassing because of their game.

when, looking at a city wide scanner, rare spawns will almost always spawn in locations where you either spoof or traspass.

I haven't been able to get on Pokemon go since the last Android update (7 days ago)! it just says "cannot download data from server" Does anyone know why please???

I had this problem on my android too, so I deleted the game, went on apkmirror.com and downloaded the previous update. Trust me, it's way worth it until the next update

Lately, my town has been more strict about pokemon go. They started putting gates up at night so you can't enter the park where our only nest is. They also have cops constantly patrolling the area now.
What do you have with 100,000 lawyers at the bottom of the ocean? A Good Start...

So, like the girl who was allegedly hit by a car while playing Pokemon Go and her parents threatened to sue Niantic for making their game so dangerous? Honestly, if private properties don't want their places to be a Pokestop or a Gym, can't they contact Niantic to take it down like my school and a few cemeteries did? This just seems like a them problem that doesn't need to be taken to court. This issue can be easily fixed by a few emails or phone calls?
They refuse to remove gyms and stops unless its in a dangerous location. If they allowed anyone to request to removed them, then the only places that will have gyms and stops are stores.
drink15 Not true. Nick has said that some cemeteries had talked to Niantic to remove the pokestops/gyms, and there was a Pokestop at the statue of my school when the game launched and by the time school started in August it was no longer a Pokestop.
Ok. Add maybe schools and some cemeteries to that very short list.

The Fire King I know a similar example. A few people sued McDonald's because a pair of kids were obese. The case was dismissed because the people couldn't prove that McDonald's made the kids obese. How are these parents going to prove that Pokémon Go was the reason she got run over?
I just want to say that your videos have become soo well made. I have been watching almost every day since this summer and its become sort of a tradition while I eat my breakfast in the mornings before work. They way they are filmed and editied are truly on a professional level and its a joy to watch so thank you for all the hard work.^^

I live in milwaukee, and I just want to let everyone know that it isn't milwaukee county that doesn't like Pokemon go. It is the people that live in the houses that are separated from the lake by lake park. They feel as though it is "their park" (even though it is a public park). They complained to the county and the county handled it by contacting by Niantic.
Sincere Whaleysmith but it is a public park..... Do they complain about other people going there and playing other games? That's just stupid. Parks are open 24/7 unless stated other wise by a sign. Private parks also have signs that say no trespassing. If none are there, then everyone is welcomed. The county failed in their actual jobs in realizing that parks are open for all.
Nick, please don't start with the misleading titles and "click-bait" that almost every single other Pokemon Go youtuber does. It's one of the huge reasons you have the fan base that you do have, because you're an honest and informative content creator. Don't ruin it with these misleading titles. "Numerous lawsuits against Niantic" would have been a more appropriate title.

there's one gym n town that's right next to a house I parked on the side of the road one house away from it and the dude still walked up to me. wasnt on his property or anything.

I went out there and caught Pokemon on that pier when I was in Long Beach over Christmas! I rented a bike and rode all the way up and down that beach, it was so much fun, especially since I'm used to only east coast Pokemon. I caught so many Sandshrew lol.

In Christchurch, New Zealand we have quite a few pokestops which correspond to buildings which aren't here anymore, due to a series of large earthquakes.

I thought the entire premise of where pokestops were placed was on areas that are accessible publicly, at least during certain hours and assuming people are complying with whatever rules/fares exist. If Wisconsin wants to crack down on pokemon Go players playing Pokemon go in Public areas, aren't they just cracking down on their own "public?"

Here from the east coast I can't say for every park but the most widely known Pokémon Go park will attract. Easily 200-300 people on a beautiful sunny day. In the beginning the park rangers were confused and bemused by all of us and there became a time around September where they were mad because of the foot traffic damage. They enforced the park rules with everyone from simple stay on the path ways and having the Rangers communicate with the players. Now I'm April they have provided more bathrooms and picnic tables at the high stop places in the park for the players to use.
Someone was smart enough to realize having people there wasn't the problem it was their lack of knowledge about the park that was the problem. They were able to educate their players to the point players will monitor other players they see. A better case of players vs parks but one I wish happened more often.
Well I live in a little hipster town in Wisconsin in the Chippewa Valley and for anything, i noticed our town definitely took advantage of the business it brought to our downtown area, but thats only a little spot of Wisconsin and haven't seen many other city's takes on it.
I hate how people are ungreatful for paras, where I live, all I get are larvitars and it's so annoying.

Dean Ramsey I wouldn't power it up. The best move set for alakazam is Psycho cut/future sight or confusion/future sight so if you have shadow ball as a special move, I wouldn't bother. Yes you may have psycho cut which is great! But your special move set is not the best compared to the alternative.
