ACC Claims They Have "No Incentive, Less Than Zero Percent," To Settle With FSU and Clemson

  • A source told Brett McMurphy from Action Network that the ACC has “no incentive to settle” with Florida State and Clemson in court. They added, “less than zero percent.” Clemson and FSU are suing the league in an effort to break the Grant of Rights and leave the conference. Will ACC commissioner Jim Phillips and conference lawyers be able to keep the fight going and hold them off in court?
    Hosts Alex Donno and Kenton Gibbs point out the likely posturing in the ACC’s stance and Donno points out that if the ACC starts losing in court, their incentive to settle could change quickly. Last year, seven ACC schools held meetings to discuss the Grant of Rights. Is there a possibility that this “Magnificent Seven” could rekindle their talks and look to break away from the current ACC to form their own league? Ross Dellenger of Yahoo! Sports has pointed out that for FSU, Clemson and others to join the Big Ten or SEC, schools in those conferences would have to agree to a lesser payout to add new members.

    FSU did not declare. They asked the courts to consider them withdrawn IF and Only IF the courts decide the ACC has breached the contract. Judge Cooper has stated that FSU request was not a formal withdrawal and the ACC attny’s agreed.

    The FSU AD didn’t lie. FSU has not officially notified the ACC that they are leaving. They have in their filing that if certain things go their way then they want that retrospective date to serve as their official notification. But those things haven’t happened. Obviously they want out. But there has absolutely not been official notification that they ARE leaving. You have to ask the right questions to get the right answers. Wanting to do something and doing something are not the same thing.

    Also Phillips about 2025 option: "they just have a 'look-in' and we have a few issues to work out"
    Do you see the contradiction. I know you're smart enough to see how the first statement is PR and the second is slip up confirmation undermining the first statement.

      I am not a member of the ACC nor am employed by ESPN, but I know one issue they need to work through: $. ESPN can basically say, “I have an offer you can’t refuse.” ( Don Vito Corleone) and Phillips will take ir, otherwise the ACC will end up like the PAC,

      That option was supposed to be signed in 2022! However, the ACC AD gave ESPN an extension on that option til 2025! There was no vote or discussion about it! We all know, FSU, Clemson, Miami, VT, NC State and UNC would have said no. Do you want the option, you do it in 2022 not in 2025! In 2022, it was clear, the B10 and SEC were signing new tv deals, that would pay them 40 to 60 million per team more than the ACC.

      @@timothyhinkle1395 ESPN will not terminate because keeping the ACC intact until 2036 is worth more than ?2.5 Billion for ESPN. And ESPN also CANNOT terminate as long as the ACC has ANY 15 Teams in it (or more).

    The ACC is silly if they think they don’t have any reason to settle. ESPN has a lot of good reasons to not renew the ACC contract in 2025. Plus, the ACC hasn’t acted with the parties’ best interests and discovery will be damaging for them.

      People are focusing on the judicial aspects of the case and appear unaware of the political aspect. FSU has a lot of goodwill and friends in political circles. The ACC does not. If the NC legal system declares that the State of Florida does not have sovereign immunity in NC, the Florida legislature could pass a law stating that any case brought against any state entity by a private party for the purpose of potentially laying claim to state property, has to be tried in a Florida courtroom. That is not unconstitutional in Florida law. What is a court in NC going to do? They can appeal it in the federal courts but if it does not violate the Florida constitution, then it will be upheld. Do NOT be surprised if this matter becomes political.

    The ACC is just posturing, which they should. The reality is as soon as the FL courts authorize public discovery of all documents and communications between the ACC and ESPN, this will be settled the next day.

    I wouldn't settle either if I were the ACC. No ACC team can say that they're 'under duress' when they keep signing the ESPN paperwork and no team has gotten to the playoffs this decade. FSU cannot say that ESPN is paying them unfairly when in 2024 it knowingly signed the 2026 ESPN playoff extension where it would get 17% but the SEC would get 29%. Furthermore, the Big 12 is getting 15% less than the ACC and no team is suing ESPN.

      News flash! No ACC school who cares about CFB and wants compete at high level, they would never approve or vote of extending that option 2022 to 2025 for the tv to go to 2036! None of them! Why? It was clear in 2021/2022, the B10 and SEC new tv deals would be giving their schools per year 40 to 60 million more than the ACC schools! Your talking about 40 to 60 million more til 2036.

    It's not about disbanding the league, but mutually agreeing to split the league. The key inflection points incoming are (1) the ESPN decision on their option and (2) NCAA settlement for athlete compensation. These could provide the needed political cover to split the league along the fissure between private and public school.

    If the contract changes the GOR is much weaker because the GOR is written and says it is to secure the rights needed for the ACC to fulfill the very specific ESPN agreement as amended in 2016.
    The ACC cant agree to.more.money, or less money, or any change in terms. It is take it or.leave it. Np changes

    It may be weird to a miami fan that clemson and fsu are involded in talks about the future of the conference, but in reality....
    1. Neither school has officially declared they are leaving, the document in context shows they are wanting that to be the date IF the courts side with fsu.
    2. FSU and Clemson are the future of the conference, just as they have been the water baerers of the conference.

    YOU GUYS NEED TO ACTUALLY DO SOME RESEARCH INTO THE THINGS OF WHICH YOU SPEAK
    This is pretty simple. FSU has not issued an "official notice of withdrawal" as required by the ACC Bylaws. FSU's contract does not state what McMurphy writes. He misrepresented the actual language. It stated that *"if"* the Court finds that the grant of rights and exit fee penalties were **both** void and unenforceable, that FSU gives notice on that date. It's conditional. And I'm not sure a judge/court can even retroactively apply that date. I'm sure you two will argue that's the same thing as FSU announcing it's withdrawal, but it's not. It legally is not the same, and the ACC must agree because they have allowed FSU to continue to participate in conference matters such as the spring meetings last week.
    As far as FSU/Clemson not adding value to the P2, we all know that's a load of 💩. They are at least as valuable as the average P2 school, and I think almost everyone would agree they're *more valuable* than average. I cannot believe how many journalists repeat this line when everybody knows it's nonsense. And in the case of ESPN, they could simply recoup any additional expenses caused by FSU/Clem moving to the SEC by terminating the ACC deal in 2027 and renegotiating a new deal from 2027-36 for a reduced price. ESPN could easily come out ahead via that arrangement.
    But I agree with Kenton. If the "Magnificent 7" secure an 8th or 9th school (Duke, GT?) to dissolve the conference, there is no longer keeping *any* of those 7, 8 or 9 schools from seeking their own landing spot in the P2. EVERY MAN FOR HIMSELF! The ACC would be dead - THANK GOD! But that doesn't mean the "Mag 7" would ever form their own conference.
    The ACC is dead either way. The only question is the precise order of the dominoes to fall.

    There is no incentive for the ACC to settle. Half of the damage has already been done. The ACC's Brand, harmony, and longevity has already been viciously attacked by FSU's media proxy bot campaign.
    FSU & Clemson leverage was in threatening to sue. Not by actually suing. Now it's a fight to the death.
    As For UNC. A faction wanting ....more money period. That doesn't equate to the school even thinking about suing. It's already a political mine field for the Tarheels in North Carolina.

    Those who knew already expected the look in. There was always to be expected increases. Presumably all of the schools are bound together. The FSU strategy against the ACC is to damage the GOR & reputation of the conference so much that ESPN doesn't increase, or even renew the contract.
    The reason FSU and others wanted to leave asap is because they needed to sabatoged the conference 1st as directed from co-conspirators from B1G-SEC.

      FSU wants to sabotage the ACC? Really? All they want to do is leave. In what possible way does that sabotage the ACC? After FSU leaves, the ACC can do whatever they want. The ACC is going to have to find another way to replace the $80m a year that FSU puts in while only receiving $39m back, but that’s the ACC problem, not FSU’s. I am sure that the ACC can find another megastar to replace them.
