Secondly, Under precedence many convicted felons who have held high status or favorable public status were sentenced framed in the idea of setting an example of them, regardless if it’s their first conviction. It’s been deemed that those who enjoy high public status are expected to treat such status as a public trust and behave accordingly. Those to whom much has been given, equally much is expected. Thirdly, the fact that he is a former president and currently president elect does not escape me. I served 36 years in the military 13 as an officer and I am fully aware of the repercussions of convictions and sentences upon high ranking officials, the President being THE Commander in Chief, and how such will resonate precidentially and what it would do to the need for “good order and discipline” within the ranks (ie you can imagine how all young troops convicted of breaking only one of the same laws in a state could ask for unconditional discharge based on the example set by THE highest ranking commander in chief 🤔). Personally AND professionally speaking, I would prefer to see a “suspended sentence” not an unconditional discharge. To me THAT would be a more equitable outcome parallel to a person with no previous convictions. The purpose of the suspended sentence is to put the convict on notice that any future illegal behavior of any kind could immediately impose the current sentence upon them in addition to any future sentence. Even a cursory review of past cases will reveal that this is the typical action taken upon first offenders. And the Supreme Court decision does rightfully make mention of the fact that the “normal” appeals process is capable of handling whatever sentencing that is made. We shall see what the outcome is and its collateral repercussions following.
