I pray pray pray with all my heart they win. Too much government overreach and too many "so called " professionals that anyone with that type of love could dare get questioned. It is plum sickening! Bless this poor family's hearts!
God Bless this child for her strength and power to overcome. As an adult with chronic pain, some days I think I have less than half the constitution Maya has. Stand back world and take note, Maya is a very powerful Woman! Her power I attribute to her Mother. I too am a Motherless Daughter. The doctor, Sally Smith, has no idea the life long pain and anguish her actions have been the cause of Maya's distress. She will not have her mother to consult for recipes, baby questions, life questions. It's the small things when we miss our Mom's the most. We've come to except that they won't be there for our weddings and children. I hope there is a powerful woman to mentor her though life.
I wish Mr. Whitney would've asked Dr. Smith how she had conclusively verified that Maya was not experiencing actual pain when she claimed to have been. How did she verify that Maya wasn't experiencing either pain, a reaction from "fear of pain" due to CRPS as Dr. Hanna explained, or experiencing actual photosensitivity when she wore eye covers? In light of Dr. Hanna's discussion with her regarding the "fear of pain component" within Maya's responses to touch, there's no concrete evidence Maya or Beatta's statements regarding Maya's diagnosis, pain, or symptoms of CRPS were untrue. When Maya wore eye covers and claimed the light hurt her eyes, Dr. Smith didn't believe Maya - she chose not to confirm the photosensitivity and concluded the child was probably faking it. When Maya was tachycardic, which indicates she may have been in pain, Dr. Smith ignored that & indicated "there were no abnormalities" noted during the exam. Rather than giving Dr. Hanna privileges to be part of Maya's treatment team, he was denied any contact with Maya. His history with the family and his expertise were disregarded. Maya's emotional needs regarding her family relationships were also disregarded. Much to Dr. Smith's shagrin, Maya did not get up & walk on her own during the covert video surveilance. Rather than interpreting that as evidence against MCA, Dr. Smith instead scraped the "bottom of the barrel" to come up with flimsy support for it based on Maya's movements & behavior in her bed over the course of the 48-hour surveillance period. Throughout the time Maya was at JHACH between 10/16 and 1/17, the patient & her family were denied the benefit of the doubt. When data could either be interpreted as either evidence of CRPS or as evidence of MCA via the child lying, the default was always to assume the worst of Maya & her family. Dr. Smith stated she was looking for evidence that could be the basis of a diagnosis of medical child abxse. She simultaneously discarded, ignored, or creatively explained away any evidence that refuted MCA/supported CRPS. This is, as Dr. Newberger said, a violation of the Hippocratic oath to do no harm. I am horrified to think of how many other families have been destroyed by this group of conspirators over the last 2 decades.
Read that it was the family who not settle unless they got the whole 25 million. They already got 2.5 from Sally Smith. They are looking for the whole families retirement fund.
Who would employ this Dr. Smith as a pediatrician? A hippopotamus has more emphaty as this woman! She would be more fitting as a pathologist were she wouldn't have any contact with living patients, or in research, and in the worst case as a surgeon were patients are mostly a sleep. I can't imagine her being competent to interact compassionately with any patient, let alone with the most vulnerable innocent kind of patients, namely kids!
No wonder Sally Smith had to pay up, (or the company that employed her in any case). She admitted in her deposition that she went against the advice of doctors, didn't faze her a bit, she was more righteous than everybody else and knew better.
This woman was a lawsuit waiting to happen, her conduct is completely unprofessional and unacceptable. It is incomprehensible how doctors with more medical expertise and qualifications came to rely on this woman's judgement rather than the clear medical history being presented with specialist diagnosis and recommended treatment plans all endorsing the mother's insistence on continuing with the same treatment plan that had worked in the past. How this woman came to hold so much power in such an esteemed institution as John Hopkins All Children Hospital is incomprehensible.
Nurse said she was recorded to track her sleeping activity, then the cps dr said it was to check her movements when no one was around to check if the girl was basically lying or not about her pain. Dr Cowardice

Yeah great prop for jury sympathy considering Jack & Beata were seperating before this mystery ailment manifested and Beata was going to take Maya and leave Kyle with Jack. Beata was devastated that she might lose her American dream even though she had little to do with the care of Maya which Jack had testified to and Jack and Maya were very very close. They already had seperate rooms and the wheels were in motion. Do some research or maybe chat with the same friends of theirs I did.

I understand this Father's not being able to sleep after such traumatic events. I've lived through too many traumatic events myself, and my brain doesn't shut down either. If I get 3 hours of very broken sleep a night I'm lucky.
Maya could not be released home because there was a court order to keep Maya and her mother separated. I believe she took her life, to remove herself from the equation. It wasn't totally rational, but the stress was obviously devastating. That doctor and social worker were targeting her.😕
As a mother, I completely understand why Beata did it. Her baby was being held prisoner and being neglected and she knew what she was up against. They had it out for her and they were not going to let her go. I think Mrs Salisbury had it right, Beata likely offended someone because she was also a medical professional who knew more than most doctors in that hospital about CRPS. They weren't going to take the urgings of a nurse.
The hospital need to remove this entire heartless and cruel staff. This is simply one case that has come to light...how many more similar cases are just like these..those families should come out and speak up.

I really don't see how that was relevant to this case. Yes, the initial testimony of it, for his first aid experience. But to bring it up again is like, eh, whatever man. I spent 5 years of my teenage life in a volunteer firefighter program as well
Other hospitals suspected Beata of Munchausen by proxy too. Wait to hear the defence's side before making a judgement. The hospital really didn't do anything wrong.

Don't you love how they refer to her as "the patient" and not Maya? It's more important to distance themselves than treat her as a human being. They're disgusting.
She actually did document a lot of stuff in the hospital. The hospital itself gave her a journal for that purpose. But i believe they only allowed one page of it to come in, and that was even a struggle to get in front of the jury. But for good reason, it is technically hearsay
It sounds to me like Jack was a hands off parent. He relied too heavily on Beata, even for their health insurance, pay the bills, their health surveillance. That must have been a heavy weight for her to bear.
I'd say a lot of women do life admin for the family, nothing abnormal about that at all. It's usually whichever partner is best at it and interested in doing it. I also don't think Jack is terribly intellectual and that's no disrespect towards him

Plus, just dealing with Mr Andersons(Mitt Romney's), tactics of not giving the defense his witness list for the next day, or exhibits he plans on using until either midnight or the morning of. He's completely unprofessional, misses very important questions, doesn't know how to ask a question that doesn't allow objections, and then he also doesn't know how to object properly when defense is up there. He's lucky he pulled this case off, but i don't be surprised if he opened up the defense's case for appeal
I suffer from RSD and unless you live with it every second of every day you will never understand what it feels like. This so called pediatrician is making me sick to my stomach. She has an opinion on what isn't evidence of RSD but then says no I don't know anything about RSD.
Jack is spot on when he said being accused changes your life. Every single thing makes you second guess. You are always on edge thinking any knock or call is dcf or police. Terrified of doctors making another false claim. Even having something on video happening you still have those thoughts thinking they will twist it or claim its fake. I couldnt imagine the added ptsd of beatas passing and the hospital pushing her to that ontop of it. My kids were younger so they dont have as much issues like i do...but maya and kyle were old enough to have the same fears...and increased as they were children going through it. Heartbreaking.
I'll also add in my case the state came back years later and said we never had the evidence to take your kids for years in the first place...having the truth out there hasn't really helped the ptsd
That DCFS Head should start dating Dr Spiegel from the Johnny Depp trial... they have the same 'I always know better' attitude and about the same amount of charisma. Perfect match.
Actually not really. If you watch the whole trial he has also gotten testy with the defense and rules against them. This judge seems pretty fair all things considered. There are things that can't come in because they are part of the dcf case. When the judge rules against the plaintiffs it's because they can't re-litigate that dcf case or it could be overturned on appeal. He is trying to keep the record clean to avoid mistrial or appeal.
FYI - Civil suits do not "prosecute" anyone, therefore there is no prosecutor. The family as the complainants are legally known as the Plantiffs. Their attorney is the Plantiff's attorney. Plantiffs come before a judge/jury with a complaint against one or more parties, otherwise known as defendants. While they have not necessarily violated a law as set forward by the legislature as criminal, they are being accused of failing the plantiff by way of breaching their contractual obligations, in this case by not upholding the standards of care set forth by their credentialing bodies whether that be by the state licensing board or their professional credentialing bodies who set the standards for medical care. These standards are both for the doctors individually and defined for the hospital in the contract known as "Patients Rights."
I think this is the same judge that refused the hug for Maya, or to let the family speak when declining to have the trial until punitive damages were decided. Perhaps he's embarrassed or feels guilt for this.
What Human being in it's right state of mind will remove a child from it's mother. All the people involved need to pay their cruelty....it's them who committed child health cruelty.

I don't know if Maya will ever be able to have children in her condition. Couldn't imagine her having a relapse while having a baby in her womb. I pray pray pray with all my heart they win. Too much government overreach and too many "so called " professionals that anyone with that type of love could dare get questioned. It is plum sickening! Bless this poor family's hearts!
Smith's angry and permanent frown would scare the $hit out of any child...retire yourself and save many families the heartache 🙄
100%
Doctor Smith’s facial expressions would turn the milk sour.
I feel sorry for any child or mother who deals with this evil evil woman or equally evil Kathy Bedy.
Why don’t they just settle the case!! They F’d up and ruined this families life.
AGREED
Because the other families would be able to come after the hospital. This isn't the first time this has occurred at All Children's Hospital.
I think it's more about holding them publicly accountable rather then it just about money, I think it's more then money imo
Read that it was the family who not settle unless they got the whole 25 million. They already got 2.5 from Sally Smith. They are looking for the whole families retirement fund.
@bobroberts8082 why the lack of understanding?
Who would employ this Dr. Smith as a pediatrician? A hippopotamus has more emphaty as this woman! She would be more fitting as a pathologist were she wouldn't have any contact with living patients, or in research, and in the worst case as a surgeon were patients are mostly a sleep. I can't imagine her being competent to interact compassionately with any patient, let alone with the most vulnerable innocent kind of patients, namely kids!
Wow so pathologists only deal with the dead? Ok well there's a lot of dead people walking around out there lol.
This is the kind of staff that's in charge of children's health and well being? This is scary.
I have so much respect for Mr. Anderson. I wqs unsure about him...but my God he won my heart today!
Same he’s really growing on me
Nurse said she was recorded to track her sleeping activity, then the cps dr said it was to check her movements when no one was around to check if the girl was basically lying or not about her pain. Dr Cowardice
I really like this young attorney for the plaintiff, prepared, effective and great manners
You spoke about the child. Don’t make me vomit lady, the child has a name. Her name is Maya, she knows what she is doing and we are all ruling for her. Go Maya, eat them up.
I get so annoyed when people don’t think children have any say in things. They do and they most certainly should be heard.
If she says it one more time this beach, I will lose it.
Awesome job Judge. Sally Smith lied and Judge told Jury disregard question and answer. The Judge is on top of this case.
He still gets under my nerves. The way he speaks to Mr. Anderson compared to Mr. Hunter is unbelievable. He tries to cover up his bias
Completely agree it’s such a different tone with the Plaintiff vs the defense team.
@@emilyiss33 I don't see the Judge being bias. I'd rather he not talk so much but it's part of his job....
I still think, right or wrong, that Anderson’s unorganized nature is what’s “annoying” the judge bc he has to make sure the trial remains efficient and effective which Anderson is making it hard to do!
The way it looks Maya's family is NOT the only family John's Hopkins hospita in conjuction with Criminal Doc .Sally Smith has destroyed! They're INHUMAN ..I pray they lose their licenses. Protect innocent kids and families 😢❤
Agreed. It's children's hospitals and cap teams all over doing these things tho too which makes it even more terrifying
I think Maya's dad wears Beata's hoop earring on his tie. This brings tears to my eyes. 😢
@@sharonhoward884what happened to Jack's first daughters mother?
I work with doctors, and they certainly are different. Dont get me started on nurses.
Ooh my 😢 how did Dr Sally Smith became a pediatric 😢 she's a criminal not a doctor. I pray Maya's family win...thou they lost the mum 😢
That hospital need to close 😢😢😢 full of criminals

Jack referred to a doctor as having a cigarette voice. Can't imagine who he was talking about 😂
I understand this Father's not being able to sleep after such traumatic events. I've lived through too many traumatic events myself, and my brain doesn't shut down either. If I get 3 hours of very broken sleep a night I'm lucky.
These 2 depos being read in are powerful.
I’ve warmed up to the judge, he is very accommodating to jury and has a sense of humor
$165,000 for that doctor's testimony! I hope the jurists don't think the plaintiff paid for influence.
Good point! The judge only said it was a previous deposition. Was it from the lawsuit that they settled for 2.5 million?
@@talksoftly402 I don't know but that makes sense!
I seriously doubt they will make the mistake of thinking the Kowalskis have more legal resources than JHACH does.
That's crazy right?
at least they got what they paid for; his assessment was such a spin that a professional spin doctor would be dizzy reading it.
Such as loving and kind father Jack is.
My heart is aching and in pain for Jack, Maya and Kyle.
In the Netflix documentary, lots of parents at the end explained how Sally Smith did the same thing to their family. Makes u wonder
Money won’t bring mother back, but set kids up for life hopefully. Hospital should pay 200 million .
Maya could not be released home because there was a court order to keep Maya and her mother separated. I believe she took her life, to remove herself from the equation. It wasn't totally rational, but the stress was obviously devastating. That doctor and social worker were targeting her.😕
Beata sacrificed her life, for her daughter. She wanted her home, no matter what.
If I saw this person walking toward my child, I would grab them and run!
Little girl in the middle of defense table needs to be removed from, court her smiles and shaking her head is out of line
The victim should be removed ? That is interesting concept
The hospital need to remove this entire heartless and cruel staff. This is simply one case that has come to light...how many more similar cases are just like these..those families should come out and speak up.
The Netflix documentary stayed accurate from everything that's come out in the trial.
Um ok, except it is one side of a very complex story, one in which you will find shocking as the defence begins its testimony. So many lies from a little girl whose testimony should not be considered reliable.
Kyle honey...you are such a beautiful young man. Sending you so so much love. From Australia darling❤
Has there been any disciplinary action taken in Mia’s case?
Or is the hospital denying their errors and protecting their employees?
I don't believe there was
I’m sure the answer is NO bc they would be admitting guilt
No, and there have been no policy changes either.
@@IliketocommentonshitThat was the scariest thing about today's evidence. One would think that after this happened, they'd make some serious policy and operational changes. It would have been in their best interest to give the family a very large settlement, or at least try. Instead, they billed them! Now their dirty laundry is spread across the globe. If I lived in that area, I would never take my kids there. I'm glad almost all of them are grown, but I have a grandson who will most likely get some type of injury at some point.
Sally Smith is still there at the hospital. Why anyone already in the employ of CPS is based at the hospital baffles me.
Loved the line...."no propensity for scholarship"....major burn. 😂
AT 54:57 DEFENSE asks the witness: "You made a note that Kowalski didn't contest shelter at that hearing" (a question that was forbidden by the court to ask) and the witness gives NO ANSWER while the objection from the lawyer plaintiffs comes in.
1. After this the lawyers have a discusion with the judge about this question.
2. Judge asks the question to be read back by the court reporter and than he asks if the witness gave an answer which the court reporter said that the answer was "YES" by the witness. THIS IS WRONG! the witness gave NO ANSWER!
Yes she did i heard her
She did so. She said it at the same time "objection" was said. I love how you think you know more than someone sitting directly in front of her. 😂
NO! SHE DID NOT ANSWER! LOOK AT 55:00 when the objection is made! VIdeo is showing this, you can't choose to say otherwhise just for the show here!

The money experts demand for testimony is obnoxious
It’s insane how much $ these experts get paid!
Simone tell the defence too stop 🛑 just stop it's too much its gross how badly they have tried to stop the truth this world is horrible 💔
This women should not hold a license full stop
It breaks my heart 💔 hearing the heartache of Kyle and Maya's testimonies of not having their mom and knowing JH Hospital were responsible for all their heartaches.
How is this woman an advocate? Doesn't seem like she did a very good job advocating for maya!
Was so worried that no one was going to mention that Jack was a fireman today but they managed to eek it in right at the end with Mr. K's testimony. I am sure that the volunteer fire department he worked at is proud of him.
😂 👍
I really don't see how that was relevant to this case. Yes, the initial testimony of it, for his first aid experience. But to bring it up again is like, eh, whatever man. I spent 5 years of my teenage life in a volunteer firefighter program as well
My heart is breaking for this family, bless them all,
She was only looking for evidence that fit her narrative not the evidence of Crps. I hope she still isnt the medical director
Other hospitals suspected Beata of Munchausen by proxy too. Wait to hear the defence's side before making a judgement. The hospital really didn't do anything wrong.
She is and is still based at the hospital.
@@AfterTheRainsShe is not the "medical director" and never was based at the hospital while she held the role with CPS. She has now retired and focuses on her private pediatric practise. Despite all the hate shovelled on this woman she has been a respected pediatrician and medical evaluator for more than 35 years. Does it seem strange you that if she was that bad she held the role until SHE was ready to retire. If a bit more logic was applied here you'd see that this is a personal social media vendetta against Dr Smith and Cathy Bedy, NEITHER of whom are parties in this case.
@@sharonhoward884 Sorry you are unable to see what most have. You didn’t hear her say she wore an ID badge with the hospitals name on it? That was because she was most certainly based at the hospital and had hospital privileges. If she was so right and so innocent then why was her case settled for $2.5M. Also, why have so many been wrongly blamed by her, just like the man who spent 300 days behind bars and confronted her on the way into court.
@@AfterTheRains Sorry you weren't watching Sally Smith's testimony under (not her recorded depositions) where she explains her "badge" per say is what ALL doctors including those who have staff privileges are issued to wear/carry. This badge is also used to swipe into the building and for entry to specific areas where the general public are not permitted to enter. There was nothing out of the ordinary with her having a JHACH badge.
That woman for the defense needs to sit down and stay there , the lawyers for JH are rude and prob well over paid , because of the way they were treated this girl lost her mom , but nobody talks about the Sacrifice the mom made to get her daughter home
You must be wired into my thoughts on this matter. I have told my husband that I felt the same way about the woman and her need to not ever enter back into the court room anywhere ever again. Its very sad that more people are not able to understand that this mother god rest her soul will have my utmost respect as a mother, wife, nurse, woman ect. She knew by mothers intuition she was the one that had to make the decision for mayas welfare especially since the hospital was not. She was correct in every way.
Don't you love how they refer to her as "the patient" and not Maya? It's more important to distance themselves than treat her as a human being. They're disgusting.
Jacek I so sorry 😢stay strong for your family.
She should have documented all conversations in this case and what was discussed.
Thank goodness Beata recorded some of the phone calls!
@@talksoftly402she was very intelligent
@@FinnBrooks Yes, she was! 🤗
She actually did document a lot of stuff in the hospital. The hospital itself gave her a journal for that purpose. But i believe they only allowed one page of it to come in, and that was even a struggle to get in front of the jury. But for good reason, it is technically hearsay
My heart breaks for this family.
Love Kyle’s haircut.
I also don't think Jack is terribly intellectual and that's no disrespect towards him
1:06:34 LIES! THEY PUT FORWARD FOR A MISTRIAL A FEW DAYS PRIOR TO THIS. THEY WERE TRYING TO FIND A WAY THAT WOULD MAKE THE PLAINTIFF MOVE FOR A MISTRIAL. THIS IS SO SLIMY AND DISGUSTING BY THE DEFENSE. OMFG. 🤬🤬🤬🤬
I saw a fee negative comments about this judge. I don't see it! He seems decent to me
I think he's more than fair, considering how many times Mr Anderson has tried to sneak in evidence and testimony that is not allowed.
Sally smith seems to be agitated and aggressive when confronted or questioned 🤔 no wonder Beata was her target she was probably more intelligent
Every word Smith says is so calculated...she's yet another ick aligned with JHAC.
if only all testimony was from depositions, look how many hours were saved by not having constant objections
That DCFS Head should start dating Dr Spiegel from the Johnny Depp trial... they have the same 'I always know better' attitude and about the same amount of charisma. Perfect match.
The heavy nose breathing into the microphone….side note!😊
If the do one more sidebar, I’M declaring a mis trail and will not watch anymore of this!

Bravo to Judge for not shaving his hair off!
Shapiro is SUCH a slime
He sure did. That was disgusting!
They are being victimize even more by the defense team, continually interjecting BS to this child.
This is so heartbreaking
Seems like the judge is way more lenient towards the defense. He takes more advisement from Mr. Altman than seems appropriate.
Wonder why ?
Actually not really. If you watch the whole trial he has also gotten testy with the defense and rules against them. This judge seems pretty fair all things considered. There are things that can't come in because they are part of the dcf case. When the judge rules against the plaintiffs it's because they can't re-litigate that dcf case or it could be overturned on appeal. He is trying to keep the record clean to avoid mistrial or appeal.
I'm becoming concerned about Anderson's use of time. How much do they get and does it include closing? 😬
The way the defense spoke to Dr Newberger in the deposition videos was so disgusting and disrespectful.
The judge seems to be bias! He's very impatient as well more so with the prosecution.
Lol when you finally see the dr after 2 depositions it reminded me of Myst when you finally get to see the father in one of the books.
What Human being in it's right state of mind will remove a child from it's mother. All the people involved need to pay their cruelty....it's them who committed child health cruelty.
Sad the Mom felt she had to die, horrible hospital , horrible "caregivers "
If Beata had a disease why was Kyle left there
Exactly the social worker was jealous of the mothers relationship with her child and her husband she wanted to destroy the family I am a so gal worker for 20 years I have seen horror stories
I am having huge issues with the plaintiffs case, I am. Obviously I am ruling for them. But like the judge, I have to remain partial. As any good judge will say, wait till you hear all of the evidence. So yes, that is what I am doing. Waiting.
Most sensible comment in this entire trial. The Plaintiffs always go first. The defense has a lot of truth to bring forward yet.
The sleezy john Hopkins lawyers tried to throw a curve ball by throwing in the question or statement about the Kolowsky's not contesting the DCF rulings regarding the supervised visits.
Shenanigans with the whole defenses claims… i cant hear!
2:14:00 I hope this evil woman’s face is recognized everywhere she goes! I hope her neighbors shame her and her children are repulsed by her.
Yep sally smith just won the case for Maya WOW !!!!!
Aren't the kids almost 18? I think that should help with the fear that the kids may get taken away. IJS.
I don't know if Maya will ever be able to have children in her condition. Couldn't imagine her having a relapse while having a baby in her womb. But, in the event she either adopts, or is able to have kids, or even Kyle, i imagine they will be highly skeptical of taking their children to any hospitals
