      I thought that they must be greedy and unreasonable when I saw what they were asking for. Plaintiff wasn't 1/2 thru their case and I thought they should've added a zero to the ask!!!!

    This doctors testimony put the final nail in the coffin of jhach. Sadly money will never give these children their mother back . Laws need to change to protect children and families from these over inflated bureaucracies and govt oagencies . All institutions need to have a high level of accountability.

      All of the JHACH doctor's arrogance, impatience, smugness, and just plain crappy attitudes in their depositions on Day 12 and Smith today made me angry. Dr. Newberger nailed JHACH incompetence, lack of empathy, and blatant disregard of "due no harm." He was paid a lot of money for his testimony. I hope the jury paid attention to his testimony.

    I’m appalled by the actions of these “professionals” and their inability to admit any wrongdoing, it’s everyone else’s fault and apparently there is no accountability. This is why there are many people suffering from chronic pain who refuse to go to the hospital due to the inappropriate treatment and the preconceived notion that the patient is drug seeking. It is truly unfortunate that those meant to heal have caused so much suffering and broken their oath to Do no harm.

      The difference was, Mr Anderson kept trying to admit the notes into evidence the jury will see, when what he should have been doing is what Shapiro was doing, and just use the notes to refresh the memory of the witness to get the testimony in front of the jury, since the notes are hearsay. Not saying Shapiro is a good lawyer, he is scum, for certain. But Mr Anderson, it marvels me how he managed to pass the bar exam. The Kowalski's should have gotten a better lawyer

    At ad litem FAILED at her job which was to protect Maya. She cozied up to the hospital. Money talks. She knows her inaction was to protect Maya were wrong wrong wrong. Guilt all her her face and body language. She in no way should be part of CASA which is a wonderful organization that I support. She’s lucky she is in the Georgia as if she was in California where I am I would ensure she is fired.

      I loved that the judge called Shapiro out today. It’s not the first time he’s crossed the line. His attempts to apologize and say he was “humbly sorry” 🙄 puhleeze!!! None of were born yesterday Mr. Shapiro. Made me sick!

      @@DeeKay-66I know the defence team are all employed to assist the hospital in covering up their inadequacies in Maya’s care and the Hospital’s medical insurance company is likely paying the defence to avoid a massive payout. However, I am screaming at the screen at the underhanded manoeuvres and tactics they are using. Yesterday Mr Hunter looked near to a coronary in his efforts to keep out evidence and was apoplectic when he couldn’t.

      @tasst2674, I agree with most of what you mentioned, but you confused me a bit with the "plaintiff opening the door." In this case, the plaintiff brought up that the defense opened the door by presenting a document by waving it "openly" around. They were instructed beforehand not to do that! Defense "thought" that the plaintiff's opened the door on that sometime earlier, which is bs! They knew very well that's not the case, but tried it anyway because they were hoping it wood lead to a mistrial requested by the plaintiff's. Maybe you are talking about the same, I just might misunderstood you.

    Dr. Smith would frighten any child with her abrasiveness, aggression, and complete lack of empathy. She hands down lacks any bedside manners that patient deserves and expects. Maya is so incredibly strong for enduring such hellacious pain while being kept away from her family by mostly abhorrent “professionals” around her. It is no wonder that she has developed such immense PTSD as a result of what JHACH put her through. I rally hope that their family receives the justice that they deserve. 🙏🏽

      I work in the health field in Australia and sadly it is a big part of the culture - huge egos and God complex amongst many doctors, not all, but enough to be detrimental to the system and patients.

    God Bless this child for her strength and power to overcome. As an adult with chronic pain, some days I think I have less than half the constitution Maya has. Stand back world and take note, Maya is a very powerful Woman! Her power I attribute to her Mother.
    I too am a Motherless Daughter. The doctor, Sally Smith, has no idea the life long pain and anguish her actions have been the cause of Maya's distress. She will not have her mother to consult for recipes, baby questions, life questions. It's the small things when we miss our Mom's the most. We've come to except that they won't be there for our weddings and children. I hope there is a powerful woman to mentor her though life.

    I wish Mr. Whitney would've asked Dr. Smith how she had conclusively verified that Maya was not experiencing actual pain when she claimed to have been. How did she verify that Maya wasn't experiencing either pain, a reaction from "fear of pain" due to CRPS as Dr. Hanna explained, or experiencing actual photosensitivity when she wore eye covers?
    In light of Dr. Hanna's discussion with her regarding the "fear of pain component" within Maya's responses to touch, there's no concrete evidence Maya or Beatta's statements regarding Maya's diagnosis, pain, or symptoms of CRPS were untrue. When Maya wore eye covers and claimed the light hurt her eyes, Dr. Smith didn't believe Maya - she chose not to confirm the photosensitivity and concluded the child was probably faking it. When Maya was tachycardic, which indicates she may have been in pain, Dr. Smith ignored that & indicated "there were no abnormalities" noted during the exam.
    Rather than giving Dr. Hanna privileges to be part of Maya's treatment team, he was denied any contact with Maya. His history with the family and his expertise were disregarded. Maya's emotional needs regarding her family relationships were also disregarded.
    Much to Dr. Smith's shagrin, Maya did not get up & walk on her own during the covert video surveilance. Rather than interpreting that as evidence against MCA, Dr. Smith instead scraped the "bottom of the barrel" to come up with flimsy support for it based on Maya's movements & behavior in her bed over the course of the 48-hour surveillance period.
    Throughout the time Maya was at JHACH between 10/16 and 1/17, the patient & her family were denied the benefit of the doubt. When data could either be interpreted as either evidence of CRPS or as evidence of MCA via the child lying, the default was always to assume the worst of Maya & her family.
    Dr. Smith stated she was looking for evidence that could be the basis of a diagnosis of medical child abxse. She simultaneously discarded, ignored, or creatively explained away any evidence that refuted MCA/supported CRPS. This is, as Dr. Newberger said, a violation of the Hippocratic oath to do no harm.
    I am horrified to think of how many other families have been destroyed by this group of conspirators over the last 2 decades.

    Who would employ this Dr. Smith as a pediatrician? A hippopotamus has more emphaty as this woman! She would be more fitting as a pathologist were she wouldn't have any contact with living patients, or in research, and in the worst case as a surgeon were patients are mostly a sleep. I can't imagine her being competent to interact compassionately with any patient, let alone with the most vulnerable innocent kind of patients, namely kids!

    No wonder Sally Smith had to pay up, (or the company that employed her in any case). She admitted in her deposition that she went against the advice of doctors, didn't faze her a bit, she was more righteous than everybody else and knew better.

    This woman was a lawsuit waiting to happen, her conduct is completely unprofessional and unacceptable. It is incomprehensible how doctors with more medical expertise and qualifications came to rely on this woman's judgement rather than the clear medical history being presented with specialist diagnosis and recommended treatment plans all endorsing the mother's insistence on continuing with the same treatment plan that had worked in the past. How this woman came to hold so much power in such an esteemed institution as John Hopkins All Children Hospital is incomprehensible.

    Nurse said she was recorded to track her sleeping activity, then the cps dr said it was to check her movements when no one was around to check if the girl was basically lying or not about her pain. Dr Cowardice

      Yeah great prop for jury sympathy considering Jack & Beata were seperating before this mystery ailment manifested and Beata was going to take Maya and leave Kyle with Jack. Beata was devastated that she might lose her American dream even though she had little to do with the care of Maya which Jack had testified to and Jack and Maya were very very close. They already had seperate rooms and the wheels were in motion. Do some research or maybe chat with the same friends of theirs I did.

    Maya could not be released home because there was a court order to keep Maya and her mother separated. I believe she took her life, to remove herself from the equation. It wasn't totally rational, but the stress was obviously devastating. That doctor and social worker were targeting her.😕

      As a mother, I completely understand why Beata did it. Her baby was being held prisoner and being neglected and she knew what she was up against. They had it out for her and they were not going to let her go. I think Mrs Salisbury had it right, Beata likely offended someone because she was also a medical professional who knew more than most doctors in that hospital about CRPS. They weren't going to take the urgings of a nurse.

It would have been in their best interest to give the family a very large settlement, or at least try. Instead, they billed them! Now their dirty laundry is spread across the globe. If I lived in that area, I would never take my kids there. I'm glad almost all of them are grown, but I have a grandson who will most likely get some type of injury at some point.

    AT 54:57 DEFENSE asks the witness: "You made a note that Kowalski didn't contest shelter at that hearing" (a question that was forbidden by the court to ask) and the witness gives NO ANSWER while the objection from the lawyer plaintiffs comes in.
    1. After this the lawyers have a discusion with the judge about this question.
    2. Judge asks the question to be read back by the court reporter and than he asks if the witness gave an answer which the court reporter said that the answer was "YES" by the witness. THIS IS WRONG! the witness gave NO ANSWER!

Despite all the hate shovelled on this woman she has been a respected pediatrician and medical evaluator for more than 35 years. Does it seem strange you that if she was that bad she held the role until SHE was ready to retire. If a bit more logic was applied here you'd see that this is a personal social media vendetta against Dr Smith and Cathy Bedy, NEITHER of whom are parties in this case.

That was because she was most certainly based at the hospital and had hospital privileges. If she was so right and so innocent then why was her case settled for $2.5M. Also, why have so many been wrongly blamed by her, just like the man who spent 300 days behind bars and confronted her on the way into court.

      @@AfterTheRains Sorry you weren't watching Sally Smith's testimony under (not her recorded depositions) where she explains her "badge" per say is what ALL doctors including those who have staff privileges are issued to wear/carry. This badge is also used to swipe into the building and for entry to specific areas where the general public are not permitted to enter. There was nothing out of the ordinary with her having a JHACH badge.

Its very sad that more people are not able to understand that this mother god rest her soul will have my utmost respect as a mother, wife, nurse, woman ect.       She actually did document a lot of stuff in the hospital. The hospital itself gave her a journal for that purpose. But i believe they only allowed one page of it to come in, and that was even a struggle to get in front of the jury. But for good reason, it is technically hearsay

    It sounds to me like Jack was a hands off parent. He relied too heavily on Beata, even for their health insurance, pay the bills, their health surveillance. That must have been a heavy weight for her to bear.

      I think he's more than fair, considering how many times Mr Anderson has tried to sneak in evidence and testimony that is not allowed. Plus, just dealing with Mr Andersons(Mitt Romney's), tactics of not giving the defense his witness list for the next day, or exhibits he plans on using until either midnight or the morning of. He's completely unprofessional, misses very important questions, doesn't know how to ask a question that doesn't allow objections, and then he also doesn't know how to object properly when defense is up there. He's lucky he pulled this case off, but i don't be surprised if he opened up the defense's case for appeal

    Jack is spot on when he said being accused changes your life. Every single thing makes you second guess. You are always on edge thinking any knock or call is dcf or police. Terrified of doctors making another false claim. Even having something on video happening you still have those thoughts thinking they will twist it or claim its fake. I couldnt imagine the added ptsd of beatas passing and the hospital pushing her to that ontop of it. My kids were younger so they dont have as much issues like i do...but maya and kyle were old enough to have the same fears...and increased as they were children going through it. Heartbreaking.

      Actually not really. If you watch the whole trial he has also gotten testy with the defense and rules against them. This judge seems pretty fair all things considered. There are things that can't come in because they are part of the dcf case. When the judge rules against the plaintiffs it's because they can't re-litigate that dcf case or it could be overturned on appeal. He is trying to keep the record clean to avoid mistrial or appeal.

      FYI - Civil suits do not "prosecute" anyone, therefore there is no prosecutor. The family as the complainants are legally known as the Plantiffs. Their attorney is the Plantiff's attorney. Plantiffs come before a judge/jury with a complaint against one or more parties, otherwise known as defendants. While they have not necessarily violated a law as set forward by the legislature as criminal, they are being accused of failing the plantiff by way of breaching their contractual obligations, in this case by not upholding the standards of care set forth by their credentialing bodies whether that be by the state licensing board or their professional credentialing bodies who set the standards for medical care. These standards are both for the doctors individually and defined for the hospital in the contract known as "Patients Rights."

      I don't know if Maya will ever be able to have children in her condition. Couldn't imagine her having a relapse while having a baby in her womb. But, in the event she either adopts, or is able to have kids, or even Kyle, i imagine they will be highly skeptical of taking their children to any hospitals
