As a citizen of Malaysia, i see that this country operates a two tier legal systems, one for the elite/politicians and the second for normal citizens. The elites/politicians seem to enjoy a lot of preliviges provided by the power that governs the legal system. While the normal citizens and peasants always tend get the raw deal of the Law 😒

Whatever the legal issues, how can a person facing so many court cases be even considered for a pardon from the Agung? Shouldn't he first face all the charges and the sentences meted to him by the justice system, and then apply for pardon? Pardon should be granted only once. Which other inmates are granted this? 30 feet around his house and once a week he is being permitted to have guest does that mean every once in a week he can have a bbq party in his home garden? Other than this case I have never heard of the concept of house arrest. So how does it work? The prisoner is in his own house right? Hows the security then? The Prisons Dept deploy wardens and guards to ensure the prisoner does not leave his house? Is the prisoner free to communicate via phone and Internet?
Under the current practice, 'house arrest' do not apply to convicts like Najib. It's meant for minor offenders like those convicted for stealing milk/bread to feed their families, etc. They will have to wear a tracking device where their movements could be monitored by the authorities.

Prof, nobody is talking about a serious issue in this Addendem case. This is about COnflict of Interests. One question is why the Pardon Board only met towards the very end of the previous Agong's reign. I speculate that the Agong was very hesitant and even reluctant to chair this meeting. This is because Najib is very close to him personally and also in relation to the Pahang Sultanate. If the Agong chair the meeting, would it be possible for him to act in a neutral manner because of their relationship! We have seen how Najib and Rosmah had protested and got numerous judges removed because of Conflict of Interests. I believe the Agong is fully aware of this. It was clear that the Agong was being pressured by many quarters. The rumour that the Addendem was not signed is one vital sign of this. For all we know the Addendem was written by someone else.

Because of authorities generosity to a jailed person, it will receive this reaction when it shows him excessive face and provides him with preferential treatment. Things might not have progressed to the point where he demands that everything go his way if he had been treated strictly the same as other inmates from the start. THE pardon must go through te pardon board. The addendum was included in the pardon board board deliberation. IT was addwd after the pb sitting and be planned by NTR’S lawyer. Other than this case I have never heard of the concept of house arrest. So how does it work? The prisoner is in his own house right? Hows the security then? The Prisons Dept deploy wardens and guards to ensure the prisoner does not leave his house? Is the prisoner free to communicate via phone and Internet?

Under the current practice, 'house arrest' do not apply to convicts like Najib. It's meant for minor offenders like those convicted for stealing milk/bread to feed their families, etc. They will have to wear a tracking device where their movements could be monitored by the authorities.

Prof, nobody is talking about a serious issue in this Addendem case. This is about COnflict of Interests. One question is why the Pardon Board only met towards the very end of the previous Agong's reign. I speculate that the Agong was very hesitant and even reluctant to chair this meeting. This is because Najib is very close to him personally and also in relation to the Pahang Sultanate. If the Agong chair the meeting, would it be possible for him to act in a neutral manner because of their relationship! We have seen how Najib and Rosmah had protested and got numerous judges removed because of Conflict of Interests. I believe the Agong is fully aware of this. It was clear that the Agong was being pressured by many quarters. The rumour that the Addendem was not signed is one vital sign of this. For all we know the Addendem was written by someone else.
So...there isn't any specific law on house arrest in Malaysia.

the 1994 amendmentt by mahathir. only for states must go through the pardon board. for federal terratories, ydpa does not have to. the thing is, we don't have any "house arrest law" yet.

The 'house arrest' is not clearly mentioned in our Perlembagaan. The letter brought by Nizar (Najib son) and handed over to the lawyer is ambigous. Entire world is looking closely!!!
Because of authorities generosity to a jailed person, it will receive this reaction when it shows him excessive face and provides him with preferential treatment. Things might not have progressed to the point where he demands that everything go his way if he had been treated strictly the same as other inmates from the start. Simply follow the law; if he is offered preferential treatment, he will want more and more like what is happening now.

THE pardon must go through te pardon board. The addendum was included in the pardon board board deliberation. IT was addwd after the pb sitting and be planned by NTR’S lawyer. I believe the gov didnt know at the time when the addendum was submitted to the PB. Of course the Gov couldnt comment when the news was known to the PB.
