First Stormy, what a mess! Now Cohen? Alvin and the prosecution are a mess. Megyn and what, 10 attorneys on her show, including Andy McCarthy and Alan Dershowitz, have been calling these cases a mess and a travesty for months. Love seeing these cases, and prosecutors and judges come undone.

A real jury would. Manhattan jury, I don’t think so.
The payment and the reimbursement: It seems like Cohen did make this payment himself, without consulting Trump.
If he'd simply paid it and gotten paid back it would have been a loan. That payment would have been EITHER a campaign contribution from 1) Cohen, despite getting reimbursement (illegal because it exceeds the statutory limit) or 2) Trump, because it was a mere passthrough via Cohen (legal because one can make unlimited contributions to one's own campaign) OR a legal payment by an agent for an NDA for personal purposes (avoid harm to his reputation and family). According to many campaign finance experts this is not a campaign expense because the expense certainly, provably had a personal use and only at most a partial campaign use (the bought suit example).
However, Trump did not just reimburse Cohen. Instead, he "grossed up" the payment so that all taxes would be covered (ie this was paid as income to Cohen). That would seem to suggest that Cohen did NOT run this by Trump and that Trump was not happy with this move, wanted to disassociate himself from Cohen's action. Trump paid over $400k to Cohen rather than simply the $130k because this was paid out as income to Cohen, not a loan repayment. Trump really didn't want connection to this decision, and Trump had paid for NDAs in the past. This may also be the source of the split between Cohen and Trump: Trump was furious and Cohen felt like he should be getting thanks. Cohen was getting cut loose for his mishandling (according to Trump) of this situation.

Megyn, I want to challenge you on one point: you said the jury isn't stupid. I've attended countless jury trials, professionally. The old joke is: juries are comprised of 12 of the dumbest human beings within the jurisdiction, that couldn't figure out how to get out of jury duty. To think that the jury isn't stupid is potentially giving them a lot of credit, that may or may not be deserved. Most intelligent people would not want the pressure of potentially angering ~50% of the population on their shoulders and would likely seek to remove themselves from the jury box, which, frankly, isn't terribly difficult to do in most cases. Who knows, they might all be very bright, we honestly don't know. What I do know, is that I've seen some juries make some idiotic decisions and completely overlook facts that should have been staring them in the face.
I used to be in corrections mental health services and occasionally eat lunch in the courthouse cafeteria. Occasionally, I would eavesdrop on jurors' conversations. Overall, Jurors made me feel sorry for our system....
P.S. ... Remember the O.J. SIMPSON case? case closed!😢

I agree with Frei. These jurors can't acquit Trump and then face their friends and family in New Yawk. They would be eaten alive. Hopefully I'm wrong. But if I'm not, perhaps there is at least one person with courage who won't take the partisan path.
Finally, Holloway brought up exactly what I've been thinking. Every commentator I've listened to has said this trial is over because the jury can't find Trump guilty. But Holloway makes the point that this jury is against Trump, probably hates him, and is just itching to find him guilty. I hope that's not true but I guess we'll have to wait and see.

Excellent point. Wondered the same thing myself, but then I realized that the remedy for violating attorney-client privilege is disbarment, and Cohen has already been disbarred for perjury. So, he has nothing left to lose except his soul, and he doesn't seem to be too worried about that!
