    This is an excellent video detailing what and how impairment ratings work. It's videos like these that help workers who have been hurt to gather the knowledge that they need to get justly compensated for their injuries.

    I have a herniated cervical disk ready for surgery.
    Also shoulder capsulatis also ready for surgery “ frozen shoulder”, same arm right arm “I am right handed
    Caused for same accident.

    I reached statutory MMI 30th May 2013 I saw a an impairment rating doctor and he gave me an impairment rating of 15% he told me the lawyers would dispute the rating but thus far I have heard nothing. Since the insurance company sent me a letter stating that I was found at 15% rating and sent me a check for back pay. They also stated that I would be receiving payments for the next 10 months. Is there anything else I need to do on my end to ensure that I protect myself?

    Wait it out. Unless there are other impairment ratings out there, you don't have to do anything. You do need to familiarize yourself with supplemental income benefits. These benefits can be paid after your impairment benefits are paid out, but you have to apply for them and there are a lot of requirements.

    Husband sustained injury last year, still on light duty work restriction. Has had MRI that supports injury claim. Therapy did no good. Have no legal representation at this point. Was sent for a MMI examination. The designated Dr. only asked my husband to show him how far he could bend his arms, there was a gal there that used some sort of measurement. Took a whole approx. 15minutes??? Now the TDPI wants to send him to the Functional Capacity Evaluation place to determine disability?

    Why is it the doctor who did the impairment rate said I was going to be compensate for 18 months but insurance only paid 6 months? /Thks

    my wife had a lumbar discectomy last fall and the insurance company kept pushing us to see a doctor other than her surgeon for the impairment rating. we did it, to speed things along, thinking that she was at mmi and wanting to get the whole process over with. the company doctor gave her a 0% rating after a 10 minute visit in a seedy office building. what should we do?

    i had a neck injury shoulder injury and hands and lower back , the dr told me he did a 5% on my neck wiht 2 bulging disc and RFA on c4/5 c5/6 and c6/7 bilateral. seems odd since i will have to repeat this every 6months to a year till i die. Or am i not thinking correctly here

      Gary Hempel neck injuries are usually rated at 5%, though some can reach 15% if there is atrophy or a loss of reflexes. MMI is usually the real reason to dispute these. I review impairment ratings for free. Just give us a call at 972-644-1111.

    I suffered a low back injury at work here in Texas, which resulted in a L2-S1 fusion surgery and my 2-year MMI is approaching. Can you give me an idea as to what a typical impairment rating for this type of injury/surgery/recovery may be?

      In general, you can never expect to guess what an impairment rating will be.. for a low back injury there are many factors such as; was there a fracture of the lumbar vertebrae, radiology findings, examination findings, symptoms exhibited, etc.. as for the recovery it depends but in general a person with a L2-S1 fusion can expect: limited mobility, muscle strength issues in the lower extremity, possible numbness/tingling, trouble with walking and/or standing for over 15 minutes, trouble with bending, and other possible issues.

    This goes with Hustonprincess1....The Designated Doctor has NOT provided the letter of report findings. Not counting the recent holiday or weekends, today is the 7th day deemed by Texas Admin. Code 130.1 and 130.6 in which he was supposed to have done so.

    Appreciate the information. I just received the MMI information from the DD. All as you described with the initial DD 10 minutes with a hurry up I will miss my flight back to Houston, filled out the paperwork quickly checks over and says I need an eval. Eval done and it comes back 2% on my right elbow which is dominant hand and the MMI is dated 10 days prior to the DD eval. The doctors I have seen throughout this process have all said at one point or another because the Sedgewick took so long to approve the surgery (which was based on a prior DD eval) that this is as good as it will get and that I should get a lawyer... This was said after the surgery and 16 weeks of PT. I am not one who normally would consider this but since I am unsure what to do and I cant use my arm properly my right arm is a full inch less than the left, based on what the DD said I cant do I dont know how I am going to go back to that job. I still have pain, nerve pain that shoots up and down my arm at sporadic times which I often drop things I cant wash, shave, or much else due to the limited range of motion of the elbow. SO I guess since I have never experienced this or had to get a lawyer for anything what I am to do... Is there a cost to talk about this?

      If you are still in treatment, then you definitely need to see a lawyer. If he placed you at MMI before you finished your treatment, that could cost you a lot of benefits and treatment down the road. You might also consider asking your doctor for an opinion on MMI and impairment to see if there is a reason to dispute the DD that you haven't considered.

    AME made me MMI and the. shorty after my shoulder claim was accepted. I’m now having surgery done. I haven’t received any TTD but in the AME reports it’s stated if surgery was done then that my benefits will become active as of the last date I received. Are they back paying me for the two years??

    Why is a slip and fall considered a person injury and a 2nd degree burns is workman's comp.Legally they are both person injury so why can't I bring a personal injury claim since both are legally personal injury

    I was given an impairment rating in March of 2022 however I received a letter from the sate of Texas telling me that they had given an impairment rating in August of 2021. I called Maria Romero of my adjuster and she would not return my calls. So I received a letter from the state telling me I am done and that I will only have medical benefits..

      Gabe, In Texas an MMI doctor can see you in March of 2022 and can give you an impairment rating based on an MMI date in the past, such as in August of 2021. When determining MMI, a doctor is looking for a date to where your injury stabilized and further treatment after that time would not be expected to improve the condition. Therefore, a MMI doctor can legally see you on one date but determine that your MMI date was in the past, where it appeared that your injury stabilized.

    I was giving two different MMI dates, one was for a cervical and right arm sprain. which was giving a 5% I had surgery on my cervical spine and he stated I am not at MMI yet so no IR could not be issued at this time. What does that mean for me. Will I continue to receive benefits?

    My case in my opinion and the opinios of 100 hundred people that have known me for many of years especially orthopedic surgeons, neurologist and non speciality doctors that worked side by side in the operating rooms looked at my injured hand that does not look good, this is after two surgeries. I have been seen by another hand surgeon and recommended another surgery. My surgeon, the physical therapist and my International Pain Management Specialist diagnosed with chronic pain syndrome and nerve damage.

    Just reached my MMI today with 5% impairment to my right shoulder, also i have been diagnosed with a neck injury related to the shoulder. I had a surgery on the shoulder, workers comp sent me to 2 doctors who determined that the neck injury os related to the shoulder injury, but workers comp is fighting that and says that is a pre- existing injury. My lawyer sent me to a third doctor who also determined that i have 2 bulging discs on neck, and he gave me 28 percent impairment on neck.

    I got injured on 11/7/2014, back injury, I was prompty getting income through the WC Insurance, after their doctor did a peer review based on my records all income stopped, on February 19,2015. Although my records show injury of disc pertrusion and injury from L1 to L4, S1 their Doctor stated it was a muscle strain from pre-existing conditions, I have never been injured or on WC ever. I then saw the DD and he is recommending further treatment. What happen next and will my income be reinstated, I have not yet been back to work, the company let me go prior to being released.

    Any impairment rating is considered to be permanent impairment. Disability is a different question and doesn't have anything to do with the impairment rating. There are benefits that you may be able to get after impairment income benefits if you have at least a 15% impairment rating. That might be what you are asking about.     If the designated doctor has not completely reviewed the information prior to the exam, the examinee will not receive a fair or accurate IR or date of MMI.

    If the designated doctor is the one doing the FCE then that buys more time for the report to come out. The short exams are the norm. That is part of the problem with this model. Some guy you've never seen is going to spend 10 minutes with you and give the most important medical report in your claim? That is crazy.     I spoke with an attorney from the Dallas are and all he did was lead me on after I had submitted the paperwork authorizing him to represent me. I spoke with another lawyer out of West Texas area and he talked about himself and his family , kept on the phone for 2 hours. At the end of our conversation I told him I a litter of rats and they stink real bad and that I am determine to call them out.

    I was informed that if there a rating of 13+ then that meant it was considered a permanent disability. Is this true or how is that looked at?

      I am going to be getting an impairment rating soon. For my broken arm and dislocated elbow. Had surgery and my arm still hurts every day. Does the fact that I had surgery make a difference in my impairment rating? If my arm and elbow are still hurting daily can I get a fair rating?

      How can you justify an almost $5000 bill? The adjuster said that was high for the amount of work you did. You don't care about ethics complaints? My shoulder is worse now than before surgery. How could you ignore the signed statement from the Forman stating the hours I would be working? How could you, or your employee, say the judges decision, couldn't be disputed? Come to find out, you had 15 days to file an appeal. So you won't give me a waiver of fees or take my case back? Noone will take my case with a lien and you know it.
