    I think I failed my Migraine C & P Exam..want to know why and how. Check out the video
    Veterans Compensation exams can get very tricky.. You try to explore so many options to make sure you are doing the right thing and then you have the internet and every single person out here, seems to know it all..But what I have found lately is that free information comes with a catch at the end.. This catch normally has a link from the creator to a another company or individual that will charge you anywhere from $500 to as much as $15000 to help you get your compensation..
    These are the companies that I try to stay away from
    This is called the bait and hook game, that I will have no part of..
    In this video as with most of my video's. I will always try to give you the information that I actually receive at one of my C & P Exams

    If you have migraines and vertigo, keep them separate .File vertigo secondary to migraines. Key symptoms to vertigo are dizziness and staggering. Do not mention these symptoms with migraines. The VA will combine them to one 50% rating instead of 50% for migraines and 30% for vertigo. On another note, if you dont know what your C&P exam is for, call the contractor that is performing your exam and ask them. Bonus advice from someone who has done 12+ C&P exams tell the VA contractor you prefer a female doctor. Trust me on this, they are more understanding and do a better job documenting your symptoms. This is just my experience.

    Good afternoon, great video. I was rated for migraines. I would hold off on sending the migraine buddy log on this particular claim and let them adjudicate your claim with the submitted evidence. If denied. I would file a supplemental using the log, ct scan and neurological report as new and relevant evidence.

    This has really been a help to me, I've been diagnosed with headaches in which I was going to fill out a claim for migraines but now I know to just do it for headaches, because that's what's in my record. Thank you very much!

      Glad I could help..They pulled a good one of me.., but I learn more and more each day..Be sure to read all of your medical records.. my C & P Examiner gets into all my records, then does a word search of ducuments, and that is what she based her findings on..I had headaches mentioned but no migraines.

    I just got approved for 50% migraines. The key words are. I miss work or lay down for headaches/migraines. When you talk to your VA doctor. Always say you are missing work and laying down for migraines.
    I just received 100% P&T. I went from 10 % to 50% to 80% to 90% to 100% in 3 years. You can do this without giving your hard earned money away. I did all of this 15 years after retirement with 10 % rating on my own. Be aware of the youtubers who referred you to their teams for a profit.

    • @LarrySbrusch
      @LarrySbrusch  8 месяцев назад +2

      Yes I see a lot of youtubers referring people like myself to their teams for huge profits. They are breaking the bank. I am not one of these guys who are looking for something free. I am only looking to receive what I am entitled too after 35 years..I am also doing all this by myself..hopefully the information I gain and learn will help others to do all of this the honest way. If a veteran is entitled to it, go for it..but be honest..I see a lot of youngsters that just got out and are trying to milk the system. That is not right..Good luck and appreciate the comment

      Same, 50% Migraines.
      1. diagnosis
      2. meds or device
      3. nexus, primary or secondary.
      4.
      a - Paper trail, make sure your doc is writing what you tell them. whatever the cause is.
      b - VA gov message app. WRITE the cause while complaining to the doc. Say x is causing Y. Say you had to lay down and missed work 2+ times per month. It goes into your medical record 48 hrs later.
      5. Right after a migraine, GO TO THE ER and say the same above stuff! Go at least 2x in past 2 months. Stack those diagnoses from different docs. ER will give you more paper trail.... meds and diagnosis sometimes.
      6. Take all of that and give it to an IMO (Prestige medical ..etc etc) and have their PA write an IMO for you. Pay for it. Now you can counter any negative C&P exam with your own positie one, plus the other stuff above. Tie goes to the veteran worst case.

    yes if you dont have prostrating where you miss work, duck out of work, or miss family events, the VA will not approve it. for people to tell you no need to send in logs. as you found out really bad advice. remember current symptoms. current diagnosis, personal statement, buddy letters, NEXUS linking it to service connection, and LOGS!!! if you have all of this you have a solid case.

    Been to 4 C&P exams so far, 3 of the 4 were absolute train wrecks. One turned in for racism, one admitted she failed to fix her known incorrect DBQ which the VA made a decision on so too late for her to rescind and one only took 10 minutes and we didn’t even go over DBQ questions (she was more worried about complaining about VES. This last one was fine though. I just think it’s sad the VA will base decisions on a Nurse Practitioner who has no standing medical relationship with you versus a Doctor who is actively treating you for the claim topic. Not to mention, the VA isn’t using DBQ from personal docs which goes against M21 and 38 CFR regs.

      Thanks for going over the DBQ! I am about to print one off and go over it. For Pact Act, if you are Tera conceded, you should be good to go. I’m a Desert Storm/Shield vet and it’s crucial to have that already in your records for those types of claims. Hope things work out for you!
      Oh, and yes. I fired my VSOs, went from 0 to 80 all on my own. It’s important for vets to know the 38 CFR and M21 regs to see what the criteria is and also the process for any higher level reviews.
      The VA website mentions any “relevant or new” information when doing a supplemental claim. What isn’t clear, is that doesn’t have to be just medical evidence. In the above issue with a bad BDQ that the examiner uploaded, I did a supplemental and added her emails only stating she messed up. Just an FYI for anyone that isn’t aware. Otherwise, you may do a higher level review without needing to, like I originally did and had to retract.

    I have mine on Monday secondary to tinnitus . I have about 3 years of medical records from the VA . All those records doesn’t show anything that I mentioned about tinnitus . They don’t believe it causes headaches .

    • @congoparrot
      @congoparrot 8 месяцев назад +1

      yes they do, it's why it is secondary to Tinnitus.

    • @francislee5918
      @francislee5918 8 месяцев назад +1

      I have sent multiple tinnitus medical notes to VA Neurologist, they never add Tinnitus if you go to the VA. Never, for two years straight, until recently as I asked the doctor directly at myhealthyvet. All of my non-VA Neurology doctors always have added "tinnitus" as a migraine problem. I suspect it's a legal way VA has potential admissable evidence to request a RFU or even a potential CUE. Be careful here. My primary at VA has added it multiple times due to my non-VA doctors. Be extremely careful when going to VA docs and don't be afraid of requesting ammendments + recording appointments. The big key, in a popularity contest, an MD will always win legally against your word if you don't have ANYONE to back up that your tinnitus really affects your migraines. Always have a backup non-doctor and eventually ask yourself if you really have a legal contract to go to the VHA every year like in a regular military contract, or if it's just an option if you've plenty of non-VA doctors already treating g you. You might get surprise here. You welcome!

    • @LarrySbrusch
      @LarrySbrusch  8 месяцев назад +2

      From my personal experience, I would not file until I had as many medical records as I could get reflecting that specific issue and make sure whatever doctor you are using includes that in the medical reports. The more the better. It helps make a more solid case and should help your claim overall. I jumped in without reviewing all my records. Something I wish I would of never done. Keep a migraine log as well..give it to the c & p examiner
