    First story: sounds like a European contract. Some contracts have stipulations that you have to pay a fee for training if you leave earlier than the end of your contract. It’s because the company put in hours and resources to train you.

      In the USA there are companies that will pay a new employee a signing bonus with a provision that the employee must complete an X-year contract. If said contract is terminated early the employee is required to repay the signing bonus.

      Computers are easier to monitor and control for the administrator and therefore their employer, while phones are your private property which no one can access except you + a phone is way easier to hide and has full access to all kinds of applications, while most work pcs are usually restricted to a few important work related applications.

    My friend used to work at a high price restaurant. He worked there for about a year before he found out that several employees were having their hours modified to get less pay. He didn't have the money or time to sue them, so he organized a walk out on valentine's day. Three quarters of the dinner shift walked out at 5:30 PM, and the manager actually locked the door and tried to force them back to work. Obviously twenty people aren't gonna listen to one guy, and he ended up getting cornered until he unlocked the door. The company also tried to press charges on the employees for corporate sabatoge, but it never went anywhere

    7:20 French labor law kinda works like this. But since during their notice people usualy won't do a good job, you can have an agreement with your boss for not coming to work during your notice but still be payed as if you did. Unfortunatly if your boss wants you to work during your notice you can't say no and if you refuse to he can sue you for it.

    First story; don't know which country the person is from but I can explain how Switzerland does it: you always ALWAYS have a contract (either oral or written) before you can start to work, no matter what profession. In that contract you also have a notice period. It depends from work place to work place but a month is a minimum so that the worker has a month time to find something new and the work place to find a new worker if they fill the position again. If you leave before the notice period has ended, you have to pay up for the worker they have lost, so to speak (hope this makes sense) and it is bound by law.

(By the way, I worked in Switzerland and I'm aware that it is consideredvalid by law, but the employee will never get reason in front of the law without written proof, especially in a country where employees rights are non existent such as Switzerland)

      Yes, also in Germany, but you can enter into a termination agreement (Aufhebungsvertag), in which you can negotiate with your company under what circumstances they agree to terminate your contract immediately e.g. your overtime and paid vacation would be forfeited

    In France we do have the same notice clause as OP from the first story. But it works both ways :
    - You either work your full notice and get paid
    - You can chose to not work the full notice but you have to pay the company the salary you would have made
    - the company can tell you to not work the notice but then they have to pay you anyway
    Also 3 months is the maximum notice time in France... could be here.

    In the US, you can be sued for breach of contract for quitting without notice. It almost never happens because it wouldn’t be worth it, but for very high paid employees it can be. Sometimes the contracts have clauses like this to settle that issue.

    6:50 - Brazil has a law like that. If it's not a just cause(dismissal by a grave issue, like stealing or causing a huge loss), whoever rescinds the contract has to pay the other party. Like, if the employer fires you, the employer has to pay. Same thing if you break up the contract.

    I have a worse condition in my contract
    if I quit before the contract is over or without and agreement the penalty is 2 months salary, so I have to finish 2 years of work or pay 2 month
    jokes on them, if I want to suck at what I do, I can fail in a spectacular fashion, I killed a production server and I WILL DO IT AGAIN lol

    I'm from a country with similar labour laws. The law says that for certain positions (high-skill, management) you're to give up to 6 months of notice, less for other roles or by agreement. Key takeaways, assuming someone working full-time, for more than 1 year on the job:
    - You get paid 11 months of work
    - You get 1 month of paid vacation (2 days per working month) and you get paid double for that
    - You get 1 more month of bonus (called christmas bonus)
    - This totals to 14 "months" of your monthly salary
    - After your first year, the company must set aside another full month's pay, yearly, until the day you leave from the company ("severance pay")
    This means that if you quit, or are fired with a valid reason, you give up your remaining vacation, christmas, and the "severance pay." You've to pay the remaining days if you quit earlier too.
    It protects the company by preventing bad behaviour, and/or having people that quit causing issues with customers. You might think this is a very right-wing position, but labour laws are way stricter than the US. You can contest your contract; if the company fails they must give you the "severance pay" they had set aside, but more importantly: the laws also works in reverse… to fire you with no justification, they're forced to give you all that money too.
    So it kinda works both ways. As a worker on a contract (not as a self-employed worker) you get job security so long as you do your job, and in exchange the company gets stability. If you get pregnant (both mother/father) get paid time off, same if you get sick, get married, or someone in your direct line dies.

    I live in Bulgaria and the rule in the first story applied in full force in my old company, which was an outsourcing company (call center).
    If you want to leave early, you are required by law to pay an early termination fee of two gross salaries.
    If you work till the very end, they keep paying you your salary (your net salary that is).
    You are entitled to a bonus that you may get from overtime or good performance, but that depends on the way you work.
    If you slack or screw up, not only you will lose your bonus, but will be entitled to a penalty fee which will be taken from your salary.
    There are two ways to spend your remaining two months - by using your accumulated leave days, which is encouraged, or work until the very day and get a hefty bonus worth of all days of unused leave.
    This is what I actually happened to me, when I left to pursue a better life by returning to university. My work hours were 40 per week, but I worked for 4 days per week, because I had three 12-hour shifts. We had 21 days of paid leave, but could not use it always, because we had a limited amount of slots and it was basically "take it or leave it", meaning that I had to plan my Christmas holidays 9 months in advance. Since I had a lot of leave, but could not utilize it due to this rule, over the matter of 2 years I had accumulated over 30 days of unused paid leave, which was about 2 months of pay. The final check also includes all partial overtime, which was a result of phone calls lasting after working hours, as well as night pay (our shifts lasted until midnight), which also accumulated about 2 weeks in overtime. Needless to say, I left the company with nearly 4 times my regular salary and applied for unemployment, which was quite generous over the course of the next few months.

    As a person that lives in a country with 1 and 3 month notice period and a question 'what could possibly they do to you if u don't work on your last days/weeks' - you can receive an formal punishment, that will be visible forever to every employer out there. This can lead to situation that someone simply will not hire you and you may have problems when looking for a new job in a future.

    When I was a newspaper deliverer in the USA in 2012 everyone who was a deliverer had to sign a contract saying you would give at least one month’s notice or they would keep your last paycheck.

    In Australia there is a two way notice period based on how long you've been with the business starting from 1 week for one years service up to 4 weeks for 4+ years. If an inadequate notice period is given for resignations, the additional period not worked can be taken out of any unpaid leave entitlements. For example if someone has a notice period of two weeks and walks out without giving notice, the company can hold up to 76 hours worth of leave accrual (for a full time employee). Similarly (and excluding redundancy or serious misconduct dismissals) an employer must provide the same notice periods (or funds as a compensatory measure) for terminations, adding an extra week in some instances if the right conditions are met. These are the stock standard minimums (National Employment Standards) in place across the employment base. Some enterprise agreements or awards have extended conditions in place, depending on the industry. Some people in particularly specialised areas may also have extended provisions written into their contracts.

    I definitely have heard of that happening here in America. My best friend had a job in Ohio that she couldn’t leave until her contract was up… and it wasn’t military/police anything like that. It was for a school and she had to work there for a certain amount of time or pay them to leave.

    I worked for the past year as a delivery manager. I just asked for the "Senior BA" role in my annual review. I got a raise, which was nice given the Covid year, but I just wanted the title. I'm starting a new role on Monday for nearly twice my annual salary. My current client team isn't accepting someone else from my company.

    My job has something similar with that one story you read. If you get hired on, you have to sign a contract stating you will work for the company for 2 years before you can get any advanced training. So, if you quit before that time, they'll make you pay $400 a month or they'll take you to court and sue you for thousands.

    The 3 months notice is very similar to french contract. In IT consultant companies, they prefer keeping the employe doing nothing for 3 months in a shity office, rather than having the employe working at its new job.

    It is possible that this happened in the Philippines.
    I work for an offshore account, and its popular here, and companies that handle that usually has those rules. This is also why AWOL in our industry is pretty common. Because many companies will make you suffer, even find a way to get you fired, if you send your resignation letter especially if they know you have a beef on them or they are self-aware that they mistreat you or everyone generally. And because of that "____ months notice" they have plenty of time to screw you over.
    And Americans/westerners are so impressed with Filipinos working over there. Because we are so used to being used, overworked, and screwed over --- at a fraction of what the West give.
    I enjoyed the story of his/her revenge. I wanted to do the same but I know I'm not that valuable.

    if you have an agreement with the company you are working for, which only allows you to quit your Job with a three months notice and you do not have a contract to not take any blame if something happens, it would be your fault if something happened. The problem would be, since op was managing a big bank account op would potentially lose a high amount of money. Also if you want to leave the company earlier than by contract possible you have to pay the company the time you technically owe them.

    To clarify the pay-back in one of stories, in some contracts payment can be made in advance for months worked. So at the start of the time you’d get the money then you’d work. In some countries for these contracts, if you leave the work before the contract is up you have to pay the contract off.
    Tldr: company pays before work, if you stop working, you pay the difference

    I have to say my dad (who was a welder) a similar issue that one of the ops had. He never got higher in his job *EVEN THOUGH* he had worked there for *YEARS*. The promoted position gave higher pay ,which he needed cause he already was underpaid, but still was never promoted. After years of work he resigned in June (I think). He planned ahead then resignation so don't worry. He still had a small debacle a his new work with a bit of racism (we're Filipinos). It was shortly resolved, with little issue, by having him and his co-worker ,who was also in this debacle for while , and had them moved to another building so they wouldn't have to deal with that again.

    I actually worked a job that if you quit before your 90 day period you had to pay them. I hated the job and wanted out so if course youtube became a good friend
