Supreme Court hears case against Boris Johnson’s prorogation of Parliament

  • Remainer lawyers have told the Supreme Court that Boris Johnson tried to "evade" scrutiny and "silence" MPs over Brexit with his Parliament shutdown.
    Gina Miller’s lawyer, Lord Pannick, said the PM sought to “silence Parliament for that period because he sees Parliament as an obstacle in his political aims.”
    While taking the PM to task over his dramatic move to stop MPs from sitting for five weeks - a decision that has to be approved by the Queen - Lord Pannick emphasised that he was "making no criticism of Her Majesty in these proceedings.
    The legal showdown is being heard at Britain’s highest court after judges in England and Scotland delivered differing decisions on whether the PM’s move was “unlawful”.

      They did talk about that in the courtroom - the distinction that's been made is that although Major did use his powers for political advantage, he did not do so in order to prevent parliamentary scrutiny of government actions, or to prevent parliament from passing legislation which might oppose the government. Whilst what Major did was a slimy political move, it was not an action which questioned parliamentary sovereignty. Boris's prorogation, however, puts the legislature into direct conflict with the executive.

      Lord Keen was shot down, forced to concede that the usual recess need not happen: its for MPs to decide whether they want it or not. Prorogation, by contrast, is imposed unilaterally by the government.

    They don't have an argument he even states clearly that this is far from an academic case which in itself proves that this is political matter not a judicial matter. Secondly the length of prorogation was determined by the conference recess which would have happened anyway unless parliament tried to stop it which it hasn't nor has parliament stopped prorogation. The point is if parliament is supreme and this case is about prorogation then why didn't they prioritise stopping prorogation and the answer is because they decided stopping no deal was more important to them. The courts have already decided no deal is lawful which leads to the conclusion that Brexit decision making is political not judicial with prorogation being irrelevant to that.

      Most of this came out in the response, but the BBC decided people didn't need to hear that so broadcast the LiB Dem conference on both BBC News and BBC Parliament. Even when they went back to the court stream the BBC presenter was pretty much just talking meaningless dribble in a bid to drag out as long as possible before returning to the stream!

      Biggest difference is how the goverment sees it.
      1) Is it just 7 days + the conference time?
      2) 5 weeks time (with conference happening within)
      Either way, Parliament will be able to sit again as a result of either scenario, based on what the Court already said.

      Well put, and if this was so wrong and a real gagging on parliamentarians voices why didn't they cancel or at least reduce their individual party conferences and arrange to come back sooner. Not being available for this course of action only shows the entire case before the law is politically motivated. I am sure the judges will be wise not to get the legal system entwined with politics it would be a dangerous precedent to set as people would lose respect for the rule of law much like they have already done for politicians. The consequences of that are not worth mentioning.

    Lots of insinuations. No evidence of reason. Also it is not unlawful to prorogue of parliament for political reasons. There is precedence. ALSO it is not for the court to decide what is "good" governance or "Bad" governance . That would be a political ruling and would step over the line of the separation of powers. The courts have no business ruling on this case.

      Desmond Roberts the decision to prorogue was political, the court has no yard stick to make any ruling. Checks and balances in the political arena are provided by parliament. It was up to parliament to legislate if it did not want to be prorogued, which it could have during the run up to prorogation. It’s not up to the court to enter this arena.

      Desmond Roberts there is no legal precedence , that’s the point. We have the principle of the separation of power. It’s a pillar of our democracy. The court has no business judging political decisions. That’s not an opinion that’s fact and is exactly what the high court ruled.

    The Queen agreed with the Prime minister, the Queen has the authority! The Prime minister is trying to enact on what the people voted for others are trying to stop him from enacting on this vote he was forced to ask the Queen for a prorogation of Parliament because democracy was under attacked by those who oppose Brexit. The Queen agreed that her Government was being stopped from enacting the people vote and so allowed the prorogation of Parliament. Maybe the Queen should be brought to the court!

    What he has not mentioned that its taken three years with parliament, and MPS have done nothing but blocked any vote to leave, without an EU treaty. He has also failed to mention, that Boris made it clear, that he had parliament closed for the queens speech, and also did not mention, that MPS would have plenty of time to debate the issue before the 31st october.

    Nobody knows what is the motivation of the Prime Minister . That cannot be defined in court.
    1. There was no further business planned for parliament (in the remaining 4 days) before the party conferences and no party proposed to abandon the party conferences.
    2. Prorogation cannot be seen to include the party conference period which takes up most of the time parliament is closed.
    3. The "Desire" of the Prime minister cannot be proved here. However it does seem that there were important negotiations to be done with EU and no planned business in Parliament. It seems sensible and logical to allow the time for negotiations to take place, but that is only my assumption.
    4. John Major prorogued parliament for a much longer period in 1997 it is thought to avoid "Cash for Questions"

    who are bringing the Scottish case, claimed in his written arguments
    that the Scottish court decision was correct and the reasons for the
    government’s motives in prorogation should be examined by the courts.
    “It is an administrative power that has, in this case, been used abusively
    by the executive” which “falls squarely” within the court’s remit, he
    said. He argued that English law should be “brought up to the standards
    by which the executive is called to account under Scots law”.

    The Courts are being reduced to a laughing stock by all these remainer plots....Especially after the prorogue case which was not even exploited by the remainers once they had won it and was a waste of the Courts and everybody's time.....The Judges would be wise to retain the respect for the Courts by the people by just dismissing these cases brought about by remainers who claim to be doing it for the sake of parliamentary democracy whereas they are actually doing it to undermine democracy by the people whist extolling the virtues of a second referendum while not even honouring the first one which is a ridiculous farce....The Courts should look at the actual reasons these remainers are bringing these cases and assess their merits on that basis and dismiss them as political not justiciable...as it is clearly all based on a lie from the start and does not originate from an honest or honourable pleading....!!!

      According to remainers and the crux of their argument for another referendum is that we are fluid in our opinions and should be entitled to change our minds, provided it is to remain and not to leave of course. Corbyn by many accounts voted leave but is now trying to look like a devout remainer.

    In effect, as parliament is prorogued, politicians have taken their bickering over party policy to the courts, and this brings the courts - not least the Supreme court into long term disrepute. I wonder if these judges have the wisdom to see this.

    The Brexiteers being the impartial bunch they are - simply will not link prorogation with Johnsons political strategy to stifle debate. This is hardly an emergency situation or a case of nothing much to debate so why not extend the holiday. Brexiteers try to be impartial for once, some intellectual honesty would be good.     Perhaps if Josh Asprey could communicate the Queen’s English with a little more accuracy he may be better placed to understand that the majority of this country’s population voted to leave the EU.     The Queen agreed with the Prime minister, the Queen has the authority! The Prime minister is trying to enact on what the people voted for others are trying to stop him from enacting on this vote he was forced to ask the Queen for a prorogation of Parliament because democracy was under attacked by those who oppose Brexit. The Queen agreed that her Government was being stopped from enacting the people vote and so allowed the prorogation of Parliament. Maybe the Queen should be brought to the court!
