Sue the police for what exactly? Back when this happened people would routinely serve time for having marijuana. Neither Damon Stoudamire or Rasheed Wallace got arrested for it on the actual day it happened. I remember it made the local news that both them had to go to court over it a little later.

Dude you admitted to smoking weed that's illegal.
You still should never tell the police you smoked a jay. Just keep quite. There is so no way they can prove you smoked. Smell is subjective. Once they search your car and find no weed. That was an illegal search. By saying you smoked that's probably cause.
