I do like how the people protesting are not being harassed for being there. In Australia, like many countries now, it is hard to have property with farm animals on it due to people trespassing. This can cause bio-hazards and in some cases cause whole herds/flocks to have to be killed, with many people not being held accountable. I may not agree with some protests, but I believe in the right to protest as long as it is done in a lawful way. Stay on public property and don't be a harass the public. Don't block access to the property, but by all means, get your message across. If you act in a way that is respectful, you may even get more people to protest with you

Hi Kevin, I am not familiar with any effective legislation on highway boundaries, apart from the ways in which private property boundaries have to be established for legal reasons in which case where a private property has highway margins that boundary must be established, until the government took possession of our roads a few years ago these matters were constantly before the civil courts, much to the delight and profit of the lawyers. The impression I get is that only boundaries that have had disputes settled in the courts are legally established anywhere and it is only law courts that can do so. Many others can make good claims but only courts can uphold them.

5:18 Committing a criminal offence to prevent another or to detain someone who has committed a criminal offence is something that is allowed under common law. But the first criminal offence must be an indictable offence as the detainment etc would in effect by a citizens arrest. But for non-indictable offences such as blocking the road, a citizens arrest can't be carried out. But removing the person from blocking the road, but committing assault in performing the removal (even if just dragging the person off the road), would be allowed. Or at least if before a jury, likely to lead to a non-conviction.

Hi DJ, what a fascinating encounter!, probably for the first time a policeman behaving like a sensible human being!, not even dressed in the usual uniform of brutality. Actually wanting to engage with you to really make things better.
I like the bit where he tells you that to be sure that you will not be prosecuted when blocking a vehicle on suspicion of a crime you have to be aware of the differences between summary and indictable offences, then a bit later on says that 'as far as he knows' the business there is operating legally, so he can act on their behalf without doing the research that he should have done.
I am also a bit confused about the exact location of the highway, I was under the distinct impression that the highway extends to the hedge or ditch boundary which can be several metres on each side. Many of the ancient country roads were at least forty feet wide so that livestock drovers could stop to camp overnight without blocking the 'road'. This will explain the way most properties have a 'bell mouth' at the entrance which is built to the highways specification paid for by the property owner but owned and maintained by the highway authority. On that basis obstructing vehicles within that zone could qualify as obstructing the highway. My opinion is that the only way people could legitimately block any road or highway would be for a significant safety issue.
I remember the police personnel that attended the first Aldermaston Anti nuclear march in 1957 were so considerate and supportive, when my younger sister got lost somewhere near Reading my mother round her happily scoffing biscuits at the local police station at the end of the day's march.
The last bit where he gets arrested for an offence that occurred two months before was a bit strange!, was it entirely necessary?, how did they know who he was and that he was there on this day?.
    Cheers, Richard.

6:35 You have a point there DJ. How many people know the difference between indictable and summary only offence. Let alone know what it means. Most will know of a citizens arrest, or at the very least will have the opinion that it is morally right to stop or detain someone committing a crime. The constable is wrong to say that you should do your research first before making a citizen's arrest. Well he might be right in the context of the protesters, but in the context of the rest of the UK, DJ is right.

The fact that people within the company have committed criminal acts doesn't stop the business being lawful unless the criminal acts are fraud against the government in the name of the business. So a business breaking H&S laws is still lawful. Yes I'm being pedantic. But that's what the constable is meaning.

28:45 Arrested for racially aggravated common assault committed on 24 April *2020* So where was the necessity of arrest under PACE if the crime occurred so long ago. Under PACE, the following would make an arrest necessary; to get a person's name and address, to prevent harm or damage or loss, to protect public decency, unlawful obstruction of the highway, to protect a child or vulnerable person, to allow the investigation of the crime to be carried without hindrance. Making an arrest so publicly so long after the crime is perverse, but it depends on all the facts which I don't have. If they knew who the guy was, and by the sounds of it, they've known the protesters for a very long time. So why now? If it's because the investigation took two years to carry out, then it wasn't a very high priority case, so again raises the question about why the arrest was necessary now.

Hi DJ. I’ve subscribed to your channel after watching a couple and I think it’s great how you try to educate people. As specially security staff lol
One thing I would like to see personally on your channel is for you to work on your own. My personal view is I think it’s a bit intimidating when there’s a few of you walking around with cameras. But I think your great at it. Keep them coming my friend

23:45 the officer states the arrest was for "racially aggregated common assault" which was supposed to have "happened on 24th of the 4th, 2020."
He didn't say it was this year, if the incident was supposed to have happened this year and not 2020 like the officer states, then I'm not sure the arrest would be lawful...
