  • The plaintiff owns an image consulting company. She hired the defendant to create a marketing report for her, but she waited months to get it. The plaintiff argues the defendant’s plan was plagiarized and defective. She’s suing for her money back and time lost. The defendant says the plaintiff had 30 days to back out of the contract, but she didn’t do that.

    The plaintiff needs to see the strength in herself that the judge sees and the defendant tried to take credit for😂 she is a force to be reckoned with. I wish her much success!

      BS, as a business person myself, you have to learn to pay for services that ask for, and if you want something to be done in specific way them put a plan in place, ones someone's does a job you pay them not try to get the job for free like she is doing, she will learn that the hard way in business ones you burns a few bridges.

      Yeah, this was definitely a pretty unusual case for “The People’s Court” or “Judge Judy”. Probably more like something you might see in actual small claims court, I’m guessing.

    I work for a bariatric surgeon and I feel the plaintiff's services would be super beneficial for women during the weight loss surgery process, and it likely would have been beneficial to her overall success had she paid the defendants for marketing research, similar to online surveys for people in the market for bariatric surgery, to join weight loss centers, or even gyms. In this case they just didn't seem to be on the same page.

      I was thinking she'd also be good for those who go through cancer treatment. Who I was and who I am now is quite different, lost 30 lbs, hair curly and gray, instead of long and brunette with highlights, had a mascetomy as well. Could use help in getting back to feeling more normal, if that's possible.

    Great case! The plaintiff was able to recover some of her funds because she was well prepared and clear in conveying her message. The moral of the story here is, specificity is key!

    Her intelligence level is way up there and for someone like her it’s going to be very hard to find someone who gives her the information she wants and that’s where I think the issue lies. They did the job but it’s not up to her standard. She did the right thing by doing it herself lol

      They took info and just collated it. They pulled info from different places talked to a few people at a clinic I don’t think they did all she wanted.

    It’s pretty clear to me that the plaintiff’s purpose in hiring the defendant was to break out of the “plus size only” market and also assist with who are going through a weight loss transition feel more comfortable and confident about themselves. I do not believe her idea was articulated and documented in its entirety.

    This one went completely over my head. I could not understand what she expected so I cannot comment on whether they delivered or not. It did sound like they were just regurgitating information in different formats but I cannot be sure. The original draft was 3 pages. That sounds poor for the results of a 3 month contract. But I really should not be judging as I didn't understand the requirements.

      I'll tell you exactly whats going on. She wanted some of her free money from the govt back from the people she hired when they turned in a report that said there wasn't an upside to her "business model". She needs justifications to keep getting money from the govt.

    $5000 for a marketing research and plan is cheap, I’ve never seen one below 30k. You pay for what you get. They are not going to put 200 man hours for $5k.

    I understood her completely from beginning to end. This was not gibberish or talking in circles. It was a business agreement that did not have the key components listed. Too broad of a scope so that now when the judge is trying to provide her ruling, she can’t clearly state what was needed. I deal with business proposals and project timelines on the daily. It is very important to detail the business plan with milestones met and consistently keep the client involved and make adjustments as needed. I feel the defendant’s team were not experienced enough for the task at hand and should have not taken the job. Glad the plaintiff got some money back.

      The reason they both were complimenting each other at the end should not go unnoticed. The plaintiff kept the scope board on purpose. Leaving that open ended level of deliverables allowed her to use the market research and not pay for it. The defendant recognized game and said, "damn good job". Smooth talker.

    Interesting case. The plaintiff is beautiful, intelligent and professional but is a bit on the vanguard of something, really creating a niche that doesn't currently exist. Most people aren't going to understand her vision for it as much as she does herself!

    Working in an office of bariatrics. Her buisness will not flourish there. We have a very very built support system for these individuals. Before surgery even happens. I think she was just annoyed that there was no buisness for her there and ahe got mad.

    Hearing not plus-sized women saying being called plus-sized is degrading and offensive only confirms everything I believed about our society and how it views women's bodies. But tbf, this was probably filmed 4-5 years ago, and the conversation has evolved quite a bit since then.

      Plus size isn't something that has to even exist very very few people have thyroid or any other health issues its just bad eating habits whether it to much meat or to much starch or to much junk snacks or to many late nights meals..etc but basically peoples bodies are based on their own lifestyle its not caused at birth so its no reason to be sensitive about women's body cuz a fat guy is a fat guy so women get no special treatment they can fix their body if they feel away about it ...

    I understand the plaintiff and know what she is trying to accomplish. That being said image consulting sold to new customers in transition stages in not easy at all. Remember most people buy things they need. Everything that is not a necessity becomes a luxury. I can her succeeding in other markets, outside of healthcare.

      You must did not hear the case in its entirety. She said she caters to sizes 6-26 at 8:19. I understand why she specifically wanted to cater to that market. She could offer her services from the beginning of a patient/client surgery/weight loss journey to the end. If anything, she should not have conveyed to the defendant a “plus size” market, but a “weight loss” market instead.

      Market research is a billion dollar industry. Nearly every company large or small work with analysts to gain insight on your target demographic, local economy, projections on traffic flow, growth potential, etc.

    It's really bothering me that thin people think calling a plus sized person "plus size" is offensive or mean when it's literally what they call themselves. Most plus sized people just want to be acknowledged and included.

    Her business provides a very necessary service but the judge is right, the contract was waaaay too broad. The defendants didn’t really do the work she wanted but they did abide by the contract.

    This seems highly offensive in that it assumes you'll fail and need gigantic clothing.

      She clearly said her business was focusing on providing image consulting services to people throughout their weight loss journey. I don't know what part of that sounded like she wanted to sell clothes to fat people. Many people going through extreme weight loss do have issues adjusting to their changing body; this sounds like a necessary service to me.

    In a real court case the plaintiff would not have a case. There is no "ruff justice" or partial refund. It is one way or another in small claims.

    Had weght loss sugery, and yes I knew I was I was plus-sized/overweight! That's the point of the surgery! What uIwasn't prepared for was still thinking like t was still fat!! Learning to dress not fat ! That, I wasn't prepared for!!

    I feel like she has high standards that they just didn't meet, doesn't mean they didn't do their job, it just wasn't to her standards.
    He said "I didn't feel I got to express my case" and from what was shown I somewhat agree (though TV shows do cut parts out so maybe they only showed a majority if the plaintiffs side but did also speak properly with the defendant, it just wasn't shown.)
    I really didn't like that he stated at the end that she is where she is (regarding her public speaking) because of him. I like that he said he was proud of her but I felt she held herself well and he shouldn't be trying to take credit for her strength and confidence in the court room, sure maybe his course helped her but at the end of the day she did it because she worked to have that knowledge and confidence in order to present a rational, factual case. He shouldn't be patting himself on the back for that, when it's not anything to do with him

    One time I had decided it was time that I take into account the time of everything that I had been deeming was essentially what I was talking about but yet no one really understood what I was saying per se.
    That's basically what it sounded like listening to the plaintiff speaking 🤣 I had no idea where she was going half the time.

      That’s exactly what she’s doing. She’s one of those people who isn’t actually saying anything that supports she has knowledge of empirical study, but she’s using enough $5 words to keep people who also don’t have a background in empirical study from questioning her.

      This is not smart. You can tell because she doesn’t understand the value of qualitative study vs. quantitative study and she just prints out a ream of studies on obesity, which are not at all targeted to what she was looking for. This is, “I googled something and I’m trying to describe this thing I don’t actually understand, which is why I’m talking in circles without even realizing it.” It’s what most of y’all sound like to those of us who actually attended law school.

    People like the plaintiff are the same people that would go to a restaurant eat a steak, leave the plate clean them later put a bad review saying the I ate the whole thing but it was horrible, please you must be clear when you want something. They did the job pay them, if you are sooooo great and you think you can do it yourself why hired them, so dislike people that always try to double deep the chip.

    The judge didn’t want to hear or look at all that… and to that, I say don’t take the case from the respective court in which it was filed in. Stick to the rivers and lakes that you’re used to (rent deposits, dog bites and lemon cars). She should’ve got half.
