And DAs have an incentive to get along with the police department, since police testimony tends to be their best evidence for most crimes. If a DA makes an enemy of the police, their conviction rates will likely plummet. This is why police often don't get charged until after there is a public outcry. I imagine that gives the DA cover with the department.

He likely has legitimate claims for false arrest and for deprivation of rights under color of law, but not for malicious prosecution since no prosecution took place. Just because you're brought to court doesn't mean you are being prosecuted. Plenty of people stand before judges in court for plenty of reasons that are NOT prosecutions. This was one of them.

Thank you all so much for recording and auditing these videos. I have been through this exact situation a handful of times! I worked 2nd shift and rode my bike, I would regularly get home around midnight and was harassed by the police multiple times. I always bent to their will though and provided my name and ID "so they could put me in the system to note that we had contact" as they would say.
In addition to having police supervisors immediately available there should be assistant DAs to evaluate these situations on the spot ( I loved the 2-minute dismissal. )

They never read me Miranda rights. Then, as I left work the following Saturday they were in the parking lot running the plates on my truck. Accused me of robbing the place, handcuffed me and threw me in the back of a cruiser while they called my boss and made him come down to the shop and verify I was allowed to be there. Even tho I showed them I have the key to the front door.
If you were thinking of a lawsuit against those two thugs then you now have more evidence that they retaliated against you for bruising their ego. I do hope you can find a lawyer. After the first incident you had maybe a 5 to 10 K possibility. With the new retaliation you should now have 25K in damages a jury could award.

When I was a kid my friends and I got tickets for not wearing helmets, like a week later I was just sitting on my bike in my front yard and the same cop came by and wrote me another ticket. He had nothing better to do than stalking a kid and give him tickets that no kid can afford and they wonder why people hate the cops. And when I started driving they knew I got in trouble with weed once so they pulled me over constantly for no reason until I got another car.
I got a ticket at age 15 for riding my bike to school and not stopping at a stop sign (this was MILES out of town in flyover country). I was dumb and naive and trusted cops, so I gave my real name and proceeded to blow off the ticket (didn't pay or any of that crap). No worries until I go to get my drivers license over a year later only to find out that my drivers license was SUSPENDED. You read that right... my drivers license was suspended BEFORE I was old enough to get it! My mom and I went to the judge to argue this crap and we lost. Cost me several weeks work (min wage was $3.65) to save up the 50 bucks to pay these tyrants. But the story isn't over.... About 6 months later I get pulled over on my bicycle AGAIN in the exact same spot for the same thing. This time I gave the pig a fake name and address.

You should not say anything. At all. Full stop. This is exactly what people get wrong about Terry stops (reasonable suspicion stops). They aggravate the officer and it becomes a pissing contest. If you stay completely silent the officer may get mad but they will be shouting at nothing and you will be (and appear to a judge/jury) fully in the right.

I used to think this but now I don't. In some cases it is true. I think the bad cops were bullies in school. When they realize they are getting closer to adulthood and imminently entering the real world, they cannot get away with their bullying with the general public and in a future private sector career. He likely has legitimate claims for false arrest and for deprivation of rights under color of law, but not for malicious prosecution since no prosecution took place. Just because you're brought to court doesn't mean you are being prosecuted. Plenty of people stand before judges in court for plenty of reasons that are NOT prosecutions. This was one of them.

Thank you all so much for recording and auditing these videos. I have been through this exact situation a handful of times! I worked 2nd shift and rode my bike, I would regularly get home around midnight and was harassed by the police multiple times. I always bent to their will though and provided my name and ID "so they could put me in the system to note that we had contact" as they would say.

My thinking is redirect all their questions to a lawyer. Give them any email account. Hard to argue with that.
This video is another perfect example of why you should always record.. the cops denying a public records request to cover up their crimes is a obvious.. they know that if you take the body cam footage to lawyers you'll have many lawyers to fight your case but if they seal it and you need to first get a lawyer to get the body cam footage then they know you'll need to pay a lawyer before you even get started.
You shouldn't have to hire a lawyer or pay for a records/body cam footage. It should be fully available under FOIA.

They never read me Miranda rights. Then, as I left work the following Saturday they were in the parking lot running the plates on my truck. Accused me of robbing the place, handcuffed me and threw me in the back of a cruiser while they called my boss and made him come down to the shop and verify I was allowed to be there. Even tho I showed them I have the key to the front door.
If you were thinking of a lawsuit against those two thugs then you now have more evidence that they retaliated against you for bruising their ego. I do hope you can find a lawyer. After the first incident you had maybe a 5 to 10 K possibility. With the new retaliation you should now have 25K in damages a jury could award.

When I was a kid my friends and I got tickets for not wearing helmets, like a week later I was just sitting on my bike in my front yard and the same cop came by and wrote me another ticket. He had nothing better to do than stalking a kid and give him tickets that no kid can afford and they wonder why people hate the cops. And when I started driving they knew I got in trouble with weed once so they pulled me over constantly for no reason until I got another car.
I got a ticket at age 15 for riding my bike to school and not stopping at a stop sign (this was MILES out of town in flyover country). I was dumb and naive and trusted cops, so I gave my real name and proceeded to blow off the ticket (didn't pay or any of that crap).
No worries until I go to get my drivers license over a year later only to find out that my drivers license was SUSPENDED.
You read that right... my drivers license was suspended BEFORE I was old enough to get it!
My mom and I went to the judge to argue this crap and we lost. Cost me several weeks work (min wage was $3.65) to save up the 50 bucks to pay these tyrants.
But the story isn't over....
About 6 months later I get pulled over on my bicycle AGAIN in the exact same spot for the same thing. This time I gave the pig a fake name and address.

I love how he equates knowing rights with toughness. I mean, he could always pull a firearm on the officer, that’s what a “tough guy” might try and get away with but this dude is on his bike going home.

I cannot imagine how these kind of officers can live with themselves doing that to a citizens. It has to be lack of training on top of the wrong kind of people being even accepted into the academies in the first place.
Got arrested for the same thing. Cop illegally detained me long enough to get me riled up, then charged me with disorderly conduct. Pigs being pigs
Makes me think of the Attorney NJ trooper arrested for not answering questions. I'd love to see those cops' faces when the charges were dismissed.
I doubt a cop was at the arraignment, or would care, anyway. He wanted to arrest Mike for the worst crime of all, contempt of cop. That way Mike's night is ruined, regardless of whether he gets prosecuted or not.

I know his family member was afraid for him (she could clearly sense the cops were thugs-with-gloves) but... she should have been recording, asking if he was detained, what evidence they had that he (not 'someone') specifically was involved in criminal activity... anything to use in court.
I don't think she has his best interests in mind. She actually told the leos to come inside and she would give them all the information they needed!😳 Time to find a new family

Law enforcement in this country is out of control
