● Stays in India for less than 182 days during the preceding financial year, or
● Has moved out of India or staying abroad for employment purposes, or

● Has moved out of India or is staying abroad for any other objective hinting towards their intention of staying outside India for an unspecified period.
For navy officers or traders who work in international waters, the tenure of stay depends on the territory. For instance, if the person spends more than 183 days in foreign territorial waters, they are considered an NRI.
However, if they reside for a major part of the financial year in Indian territorial waters, they are considered Indian citizens. Students of Indian origin studying in universities outside India acquire the status of a Non-Resident Indian and have to abide by the legal regulations accordingly.

I knew this rule but many of my friends purchased roadside agricultural lands. They thought I was crazy to follow rules and everyone was flouting them! In one of the movies, i suppose Fidaa, the hero and his brother buy agricultural land on their visit to India, they missed this point or maybe I was wrong.

You need to define who is an NRI. Indian citizen living abroad - is he an NRI? Indian born but who took citizenship of a foreign country - He is of course the NRI. Those who gave up Indian citizenship of course they are not eligible to buy agricultural lands. But what about an Indian citizen who went abroad for a temporary job? Is he eligible to buy agricultural land?

I believe, NRI's can still be Indians holding Indian Citizenship but working/doing business abroad on VISA or Long term Residency status. So, the restrictions for Agriculture, Farm & Plantation purchase applies to PIO/OCI status holders as, they are NOT Indian citizens!
