संविधान में प्रदत्त मूलाधिकारों से बड़ा सदन और इसके सदस्यों का विशेषाधिकार नहीं हो सकता , विधायिका का कार्य कानून बनाना है किसी तरह के अपराध एवं कानून के उल्ल्घन पर दण्ड देने से संबंधित अन्तिम निर्णय लेना न्यायपालिका के अधिकार क्षेत्र में आता है यदि कोई निचली अदालत के फैसले से संतुष्ट नहीं है तो उसे उच्च अदालत में जाना चाहिए न कि फैसला देने वाले जजों को दण्डित किया जाना चाहिए , विधायिका का दण्डित करने का आदेश देना पूरी तरह से असंवैधानिक था । वकील होने की वजह से अपने कानूनी जानकारी के अहंकार में स्पीकर महोदय यह भूल गए थे कि वे वर्तमान में विधानसभा अध्यक्ष हैं न कि किसी उच्च न्यायालय या सर्वोच्च न्यायालय के न्यायाधीश

Legislature is supreme which is selected by public because it's democracy so judiciary should not consider themselves suprem over democracy. You can't select youself above the selected by the citizens of the country in a democracy.

That's why, the Parliamentary Privileges are required to be definitized and used sparingly. This case was- RE Keshav Singh (1965). It was indeed very dangerous case as the conflicts between two major democratic institutions reached the high-water mark. It ensued a complete Legislature-Judiciary deadlock which always entails disastrous consequences for a democratic country as it directly harms Constitutional ethos. Fortunately the Supreme Court's ruling brought about the stability.

Yes Surajit Paul Judiciary is empowered to be cancelled that bill if bill is infringed fundamental rights of citizens and it is entirely constitutional according to constitution art 32 supreme court is empowered to produce judicial review if there any kind of infringement of fundamental rights and same procedure will be prevail to be high court in the ambit of art 226 . Art 32 and 226 imposed restriction upon parliament and state legislature

I am from CLC. You don't need much resources to read. There are many you tube channels which could help you in your preparation. Make your own notes and use library as much as you can. Additionally read Live Law daily without fail. You will succeed

Legislature is more powerful than Judiciary because legislative members are elected by public at large Whereas Judicial officers(Judges) are appointed by Collegium system. In this system judges are appointed by judges. Judiciary shouldn't override on legislature because laws are passed by parliament and it is the duty of judiciary to implement the laws. But they should not think themselves to be more powerful than legislature. They should and must work within the framework of law and their attitude should not bias for others. They should keep open their both eyes without doing partiality.

Sir मेरे भाईसाब का एक साल पहले एक्सीडेंट हो गया था, तब से आज दिनांक तक वो कोमा में है, वो एक सरकारी कर्मचारी (माध्यमिक शिक्षक) है , उनका मेडिकल छह माह तक लगा रहा और इसी दौरान वेतन निर्गत होता रहा ,
लेकिन पिछले पांच माह से उनका वेतन निर्गत नही हो रहा है, ऐसे परिस्थी में क्या होना चाहिए।
कोई भी अधिकारी से बात करो तो ये कहते है हम कुछ नही कर सकते, जबकि भाईसाब शिक्षा विभाग के परिवार से है क्या विभाग उनके लिए कुछ नही कर सकता??
जब कोई कर्मचारी सस्पेंड होता है तो उसको गुजाराभत्ता दिया जाता हैं,yhaa व्यक्ति कोमा में है, तो कोई सुध नहीं ले रहा है।
इस तरह की परिस्थि में क्या प्रावधान है??

Judiciary and vidhayika working as per sambidhan . Vidhansabha frame law in consultation of group of ministers and voting basis duly approved by president of India. Whereas judiciary review wheather law is followed as per sambidhan of the constitution after giving opportunity to represent by groups of advocates of both sides and pass the order. There's no place for arrogant order and no question of powerful kaun as there's provision in law to appeal at higher level rather show power keeping in view it's loktantra koi dictatorship nahi?

Aaj Mai Aapki video se Naraz hun kyun iske peeche 5 main reasons hai :-
1) Video ka main title kya hai who's is more powerful Judiciary or legislature. But ismein Aapne kuch baatein hide ki hai.
2) Current time ko dekhiye, Karnataka High court Justice HP Sandesh ko threatened kiya gya hai Legislature duara aur Anti corruption bureau (ACB) daura.
3) Emergency (1975) ke Time Justice HR khanna ko threatened kiya gya tha.
4) 2019 mein Tatkaaleen CJI of India Mr Ranjan Gogoi ke upar bhi fake Allegations lage the.
5) Aapne Ground level ki baat na krte hue ek incident ke upar jyada dhyan diya. Answer toh exactly diya nhi.
