It's not a warcrime. It's only a warcrime to fire upon non-combatants or surrendering foes, "NEUTRALIZED" doesn't mean they're surrendering. If they were, they'd radio it in and fly away from friendly territory. Not only that, if they were surrendering, and the system could recognize that, you wouldn't get any points/cash for shooting them down. No one would pay you for shooting down a jet that was about to surrender, especially if they can feasibly use it themselves with no issue.
