Because, due to the forbearance of a president's opposition in the past, immunity was not officially necessary. Lines have been crossed on the part of Trump's opponents, which means that now, official enforcement of immunity must be invoked. Laws and rules need not be enacted or enforced if they aren't ever breached.

A President has limited immunity, 24/7, during his term(s) in office, with one exception. A president can be impeached and have a 2/3 vote in the Senate to referred to the DOJ for prosecution. The 2/3 vote is to eliminate political prosecutions such as we're seeing now with Trump. Therefore, an ex-president should also face a Senate 2/3 vote to prosecute for something he did during his time in office. The US Constitution made that supermajority vote just to void political bias.
Impeachment is a political process whereas former Presidents are liable for civil and criminal processes.
Let's go to first principles: The remedy for criminal acts by a President while in office is impeachment ... not criminal prosecution.
If it's as bad as Turley claimes, are not the Judge and Prosecutor both exposing themselves to Bar disciplinary action or even disbarrment?
