      Case law (Federally and in Florida) is pretty clear -- once a suspect understands that they have a right to remain silent, that anything they say can be used against them, and that they can have an attorney present before and during questioning, anything ELSE that's said (or NOT said) in relation to Miranda doesn't matter.
      If someone answers questions (after indicating that they understand those rights) their responses are PRESUMED to be voluntary.

    Judge Kraynick followed the law and the testimony and got it absolutely correct. In Judge Kraynick's decision, he noted Sarah Boone lacked credibility in her testimony about Chelsea telling her that she could have her phone returned the next day. Judge Kraynick pointed out that the first question on her list she brought to the interview was when was she getting her phone back. Liar. Also her timeline of calling Chelsea the night before the interview was way off based on Sarah being at the crime scene for 10 hours, she couldn't have called detective Chelsea at 9:30-10:00pm. Again, Judge Kraynick called her lack of credibility on that too. Respect for the court.

    So if Sarah had the position of authority over Jorge then why did she rant about him cheating on her and not about him abusing her?

    • @Julia-uh4li
      @Julia-uh4li 4 часа назад

      There was no real rant though. The video evidence lasted just over 2 minutes. She stated clearly that "Now you know how it feels when you choak me!"
      That was more coherent than her slurring about a possible cheating that may have happened.

    How she said she was afraid of his family such BS

  • @greenman6141
    @greenman6141 5 часов назад +2

    Yeah, her Big Excuse was "I was hung over".
    Well, the only time she hadn't been hung over for the preceding 5 years, had been when she was lying in the ditch drunk, so that was hardly news.
    She also LIED over and over, on the stand. She lies instantly and with great ease.
    But that's because she's been lying for decades.
    However, she is just not used to being pinned to the ground over her lies. Not used to being faced with prosecutors who not only are not giving her the benefit of the doubt, but KNOW she's lying. Not used to having video of what ACTUALLY occurred being shown.
    And she's only had about a month to work with her ambulance chaser of an attorney ("Sarah owes me") to sort out what lies to tell, and when to tell 'em.
    Charlie Adelson had about two years to rehearse all his lies with his mother's OOPS, I mean HIS attorney. Jodi Arias had FIVE years to rehearse HER lies...and even so, with all that time, for all the major crime parts she had to fall back on the "oops, I seem to have forgotten that part...um ...PTSD...um....I was battered as a child....um....I was battered not as a child..." A defense "strategy" borrowed by Monica Kay.
    All of them convicted for murder.
    I REALLY hope that one day Sarah and Donna Adelson can share a cell.
    Huis Clos, as it SHOULD have been written.

      He didn't divulge any of her info, known as his 'clients privilege' at all. And he has to see to it that he never does, at all, for the rest of his life. At least that's what the LawTube lawyers have said. He can commentate to his hearts content, but not say anything of her privileged info.

    Her lies about still being intoxicated sure doesn’t comport with her prior statements about them not being very drunk. I think she said something about them sharing a bottle of wine. Regardless she is setting up an opportunity for the prosecution to impeach her credibility if she ends up testifying to that

    I don't think Sarah is trying to go for a defense of her being intoxicated when she left him to die in that suitcase, I believe shes trying to use the "I was hungover and still somewhat intoxicated, therefore anything I said when being questioned that morning should be inadmissible."
    She knows how damaging her statements are and she's already tried to get them thrown out using the Miranda warning route and that failed so now she will likely try the "I was too drunk the next day to know what I was saying, so can we throw the statements I made out on the grounds of intoxication seen as the Miranda warnings have been been denied.
    All irrelevant, Throw out all the statements and the Prosecutor will just produce the video she filmed of her doing this.
