    This is an excellent primer on depositions, better than the class I took in law school. I will definitely review your video the next time I have to take a deposition!

    I subscribed, I was in a Disposition just this past Thursday, September 15. I was out of that office in about an 1 hour and 25 minutes. The Plaintiffs Attorney never read my reports of that incident, but my attorney did, due to the fact I explained to him in a meeting. I first had met my attorney on a zoom call, on taking my case from my previous employer at that time and day.

    Great video with useful examples. In Canada, we call depositions examinations for discovery. Rather than object to a question, the opposing lawyer will refuse his or her client from answering the question. The rest of the process is very similar. Keep up the great content.

    What is the main difference in strategy for a plaintiff's lawyer during depositions of defendants vs. cross examination during trial?

    Great video, sir. I love legal intrigue, and watch lots of depositions and deposition advice videos. I must say, I was put off by your title at first. The reason is virtually all deposition advice videos are for the deponent and how not to blow his case. And as you know if there's anything your client must know going into a deposition is that he's not there to win the case, or even argue his side. But now I see this is for how an attorney can win his client's case when deposing the other party. I don't know, maybe change the title to "Obliterating the Witness at Deposition to Win the Case"?

    This is great information. I would love some information on a employment discrimination law. I've been dealing with a case for past 3 years and still in discovery phase. I was a victim of this discrimination, harassments and retaliation even after my wrongful termination. Any suggests are helpful. Its currently at the Federal court in NY. Thank you

    Does the opposing counsel have to send me the deposition transcript for my review? Thanks!

    • @LawVenture
      @LawVenture  3 года назад

      If you're the deponent, then the stenographer should send you a copy for review so that you can check it for inaccuracies. There's usually a time limit for you to identify them.

  • @gracegeng2256

    After I finished asking questions to the deponent, the opposing council went ahead and ask the same deponent a few questions ( obviously something they talked about during the deposition prep), which caught me off guard. Can the opposing council "cross exam" during a deposition?

    • @LawVenture
      @LawVenture  2 года назад

      In most situations, it's allowed. That's why the game plan is to always put the deponent in a box before the other side starts their examination. If you can do that, then any questions from the other side should be pretty ineffective.

    Isn't making the confused "Really???" face kind of tipping your hand though? How does that help? Wouldn't it generally be better to put on a poker face?

      When it comes time to try and settle the case, you need to talk about strengths and weaknesses so that both sides can fairly evaluate the case and hopefully reach a resolution. It's HOW you're going to present good and bad facts at trial that you want to keep closer to the chest.
