      I saw it in a CLE that I took back in 2018 as an example of what not to do in a deposition - hilarious!

    My tip would be to always qualify your answers. For example if the deposer asks "What injuries did you suffer from the accident" start your answer with something like "My injuries as a result of the accident are as follows *but are not limited to* " that way they cannot catch you in an alleged lie by omission.

    I'm facing an important deposition. Of all the RUclips videos I have been watching yours are the best. You hit all the points, explain them clearly and are charming while doing it. This old woman thinks you are an incredible young man as well as attorney. Wishing you all the success in life.

    After my deposition, I asked for a copy of the transcript so I could review it for errors. At the time the deposition was taken, my answers to some of the questions was, "I don't remember." But during and after reviewing the transcript, I was able to jog my memory banks until I was finally able to recall what I was not able to remember at the time the questions were posed to me. My attorneys greatly appreciated me sharing what I hence remembered since some of the facts helped us win the case. Upon reflection, I think I said I don't remember simply because I wanted to be as truthful as possible, so I erred on the side of caution in order to avoid telling a lie.

      It was only a few days. My lawyer made me a copy from the copy he was given.

    Im the plaintiff of an upcoming trial in December.. have my depo on the 16th, and a scheduled (second) mediation on the 28th. I’ve waited about 3 years for this trial I think being nervous is kind of gone, but then again I’m the queen of anxiety. I’m glad I have two awesome attorneys

    Is it true if you have a judge or jury trial is it true that the client should look at the jury or judge when answering questions? I’d have a problem doing that. I like to look directly at the person asking a question when I answer them.

    Is a pro se plaintiff, like myself, can I ask the defendant the same questions during his deposition that he did not answer in my interrogatories served on him, which was all of them?

    Hi I currently work for a company which filed a lawsuit against a logistic company who I interact with. I received a deposition email for a date in August of which I will no longer be employed by the company due to financial issues my employer is having. The deposition is in another state. Do I first have to attend and or can I request it done locally and also who should cover my cost for legal representation. Also should I be compensated. Also do I have to attend or can I decline. Thanks look forward to your advice.

    Can a Plantiff ask for more than 1 deposition?..If I had one do I have to do another one. Ty kal

      It depends on the rules in each state. For the most part, you get one deposition per witness, unless something extraordinary happens.

    I'm not a lawyer, my sister was in a car accident where she truly was at zero fault(just sitting at the red light when a car just slammed into her rear end at 30-35 mph). Her lawyers just told her today that the deposition is tomorrow, no notice, just bam. She's scared, her entire life has been injury free, and now she has 2 herniated/bulging discs in her neck. She's so nice(too nice), I'm afraid she'll downplay her injury/get bullied by the opposing lawyer, she desperately needs whatever money and care they're willing to shill out. Of course the car was totaled, but she's now got a neck injury for life, and I just want her to get what is owed to her. Besides me telling her to just tell exactly the truth, your case is so strong you don't even need to exaggerate anything, you literally did nothing, etc., what can I tell my extremely nervous sis before her Zoom call depo in about 12 hours? Wish I had more time to help her.

    I have a Dep Coming up She call me Friday Feb 18 2022 and she was asking me questions bout did I go in Serg and my Phone number and few more thing she also going to Court March 7th To turn that in I guess and then I guess it’s Trial omg I’m Scare

    Do you spend any time when preparing your clients trying to figure out how they tell stories? I always watch how my client's eyes move to see if they are trying to create a picture, or remember a sound.

      Typically during intake I can get a good sense on how good the client will be as a witness. If the story is jumbled during intake, then I prep them before the depo on keeping it short, simple, and credible. You have a good thought with using triggers to help recall the memory! I haven’t thought of that before

      So my wife watches Bull. As she's watching, I typically catch portions of the show while I'm in the kitchen and I've been really impressed with their courtroom scenes.

      @@LawVenture The funniest deposition that I have seen involved a black couple and his mother . They were not pleased to be there and did want their faces on video .The husband pulled out a pair of women's pantyhose and casually put it on his head .

      During breaks, everyone mutes themselves. I typically give the client a call during that time.

      But be careful. Depending on the state, you cannot have any discussions with your attorney about your testimony.

      @@MM-yb2fy It went well. I was able to do it from home so was more relaxed. I wrote on a paper details I needed to remember, some responses from lawyer prep. I did start to cry a couple of times which helped. And took a couple of breaks. I just made sure to pause before answering, ask for clarification if I didn't know/understand, & said I don't know when I didn't. Oh, & I corrected him when he tried to trick me with dates or details I didn't say.

    What if the defendant lied about something serious while under deposition

    #11 ????? You just said only answer yes or no. Now you're saying to explain yourself so the other side understands your yes and no.
