Actor here. Sometimes really obnoxious actors who think they know better than the director will just change the lines in the middle of a scene and then claim they were just “so in the moment”. It’s obnoxious, it wastes everyone’s time, and it’s disrespectful to the writers. It sounds like that’s what she was (allegedly) doing. Or perhaps having long arguments about wanting to change her lines, which is also obnoxious and wastes everyone’s time. If she was constantly doing this… I completely understand why everyone would get frustrated. It makes sense… she also insisted on using her own wardrobe, which I believe is true because she brags about it in interviews! “Those were my Loubotins, those were Ryan’s shirts, this is my dress…” Couldn’t let the costumer do her job. obnoxious. 🤷🏼♀️

Part of replay crew today and having seen many people cover this on different fronts. I appreciate all the wtf we need discovery reactions. I think one thing that is not spoken about enough is that there is a development timeframe prior to onset production occurring that is super important. This includes locking down the script, props, wardrobe, set design, blocking instructions, lighting, etc. Changes to character choices, script changes, "improvising" can affect all of the work needed to get the camera actually rolling. Scenes are shot out of order and any delay can snowball into lots of $$$ lost by production. Discovery for this will be so interesting (if it makes it that far).

@@darkydoom there are over thousands of homes burned and so many people evacuated. Winds are calmer tonight, but still 25mph. There’s different fires, but one is moving toward West Hollywood. There’s also one in Pasadena, near a ton of homes and shops. It’s heartbreaking to watch the news right now
I just can't with the internet on this case, its like Depp V. Heard on steroids, both sides frothing at the mouth. The mob demands a sacrifice lol. I'm gonna be replay crew permanently on this case. Excellent coverage as always :)
The internet bandwagons hard, I learned that as an early follower of the Depp cases. It tends not to read the documents, have a short memory, and side with whoever dropped the next batch of receipt without asking if it actually addresses what was said. I am leaning towards Blake on this one, but can concede that Baldoni made some points although I am not sure if they address the issues of harassment and whether they retaliated even if it wasn’t to the extent they planned. Emily is the first one that I have seen cover Baldoni’s lawsuits critically though. I have been following since the Tati lawsuits and she never disappoints.
Tone is everything. I’ve personally had miscommunications because I haven’t included Emoji’s. I’ve also had online communications with emojis that have been misunderstood and I could go back and make clear the context by pointing out the tone of the emoji. Emojis are highly important in our new language. It cannot be discounted in language now because like it or not: it is A PART of modern day language!
Same. I don't like it really but when communicating I usually play "safe" with people I don't know. They don't know my tone or humour so it can easily get wrong.
Emojis are important however, I am not so sure that particular edit was purposeful because of what we have seen in previous cases. Based on the formatting, it looks like the texts are extracts, which can exclude emojis depending on the tool and carrier. Noteably we don’t see emojis in any of the other texts which supports that theory. So while the emoji can add context and tone, I don’t think this was deliberate, omitting the “it doesn’t matter if it’s not true” is a much stronger argument for deception
@@SolMarAzul I agree However, I think Baldoni's lawsuit adressing the missing emoji builds context to the rest of the text discussion being a joke, which was also missing from Lively's.
Same way we have issues where I am from for using ! It is considered rude and shouting and I see in other Western culture it’s for insisting or to put a point across ( so says my American colleagues)
The way Emily described her experience in school needing to have an interest engaged to be able to pay attention with ADHD.... same same. I actually feel understood for once!
I thought that part of the issue was that the times gave Baldoni 14 hours or so to respond before it was published and they didn’t even wait 14 hours to publish, therefore not giving him a chance to provide his side of the story.
But they responded. They gave a statement which the NYTimes published in the article. So, they thought they didn't have to wait. They had their statement.
@@imathumb Did the short statement ask NYT to wait or let them know a longer statement in incoming? Because I would have thought since a statement was released within the 14 hours then it's ok to publish earlier. I still think it's wrong to give someone so little time to make a statement though.

A critical thing you’re missing here is the power dynamics between Lively and Baldoni, one of the rare situations where a woman has the upper hand. He was the inexperienced director, and she, Hollywood royalty, an A lister alongside her husband, whose movies have brought the industry billions. And Reynolds is a reported billionaire. Lively was literally able to remove him from his own film, which should tell you everything in terms of how much influence and control she had. Baldoni wasn’t an established director, and this was his first major studio film; and Lively was able to use that to wrestle control. So when you ask, “well could he have said no?” in reference to him and the studio acquiescing to her demands, you really have to think of it in terms of the existing power dynamics. Baldoni wasn’t in a position of power, as evidenced by him literally being cut out of the post production process after Lively went behind his back to work with Sony directly. Due to Baldoni being a male, you aren’t really considering it from that perspective though…
@@TuningAnApple @ Steve is a business partner, yes…But, Baldoni himself is not a billionaire, doesn’t have the same level of personal wealth and resources as Lively and Reynolds, nor does he have their level of influence and power in Hollywood…Reynolds is Deadpool and Green Lantern, who has made Hollywood studios billions of dollars, and Lively herself has been involved in the industry since she was a child (her family are involved in the business). They are friends with Taylor Swift, Hugh Jackman and other high profile celebrities. That Lively was able to wrestle control away from Baldoni, by going around him and directly negotiating with Sony, is very indicative of the power dynamic. I doubt this happens to a more established director. Her producing her own cut, firing production staff and bringing on editors and composers who worked with her husband? WME (who also represents Reynolds and Lively) dropping him suddenly after the lawsuit was announced, is also pretty indicative. The industry ultimately sides with its butter. I don’t think he was in a position to say “No”. He had no leverage. They had already invested millions of dollars, 5 years into pre-production, and had investors depending on them, on top of staff who were already affected by the writer strikes and needed the income. On top of that, this movie is make or break for him as a director - His first movie with a major studio. If he says “no”, and Lively refuses promote the film, they’re forced to stop production and recast, further delaying a film already years into the making, it’s a bad look with the studio, as well as investors. (And then you have to worry about the speculation that will naturally arise.)
He COULD have said no. But let's really be real about what saying no looks like, and as a filmaker who is just starting to make films, and banking on this to be his first big film, he would have never had another opportunity to do this again. And regardless of whether he said no or not, it was NEVER going to stop her from suing him, (in fact it guarantees it), or making SH claims, especially if you dont do it her way -- so he might as well get his movie made, LET IT be successful and deal with the aftermath later. It's either that, or never get your moviebaby made, and still get torn apart publicly anyway and still get nothing out of it anyway and ruin future opportunities. He had to choose between 2 lose/lose situations. He chose the situation where he could win a little, and now possibly a lot more after she extorted him. This was clearly the bigger win of the lose/lose,

How are the comments misinterpreting EDB's breakdown of each complaint? Emily has been very impartial at this point. There are issues with both complaints. Seemingly valid points in both complaints. One does not void the other. Yet. Y'all coming after Lively have virtually 7 hours to listen to. The internet becomes a game of telephone where some influencers frame their perspective and bias, the masses run with it, but no one is raising the fair questions. Thanks EDB for vetting this issue, although I truly hope both Baldoni and Lively and this drama with the rude reporter all disappear somehow.
The only thing I know for sure about anything is that Emily’s breakdown are pure unbiased legal opinions. I’m sure she has her own personal opinions but I can NEVER tell which way she swings because everything she presents is strictly the legal facts and what might happen in court.

The reason the NYT MIGHT not have all the texts is that they took her version, gave him a 14 hour deadline before christmas at night (that they didn't even keep), so he had no chance to get them to them. Their play was ALWAYS to pump out her biased story with no chance for him to counter.
They gave a statement hours before the deadline. They didn't say give me two hours and I will have a statement with evidence for you. They gave a statement. The NYT had what they wanted and ran the story. Why wait when they gave them a statement? They thought they were done.

Probably there are, the didn't come prepared enough imo, they could've brought demostratives from te textbooks she refered to use as references on how does it look, big dog, small dog. Glass, pierce, etc. I think they could have leaned more into this is trained judgement if they had made clear that there were textbook references, but what is more important is practice. When she said "articles " or "textbooks" she seemed unprepared or bluffing, she needs to be lore confident and work on the memory, name dropping books, catalogues or authors is important and she should do that with due care ofc. I understand her, bc when I am nervous I just forget the names of the authors and books, I can remember every detail even quote it but not remember the name, but being able to cite the title or author is a very huge part of credibility.

If they want firefighters to be able to fight the fires, than they better. Some people did, so some people will. WME denied he was ever at Deadpool premiere. It came out they did know why they had the meeting to return to work, people were not coming and going and Ryan didn’t yell or raise his voice. This was 24 hours or less after it came out. He’s going to have problems if he’s already being outed by people that were there and not Blake or Ryan. Cast and author backed Blake then and still back her now. Sony is backing Blake as well. The core cast and author reposted the NYT article as well to read
I enjoyed Emily's commentary all day in background of my daily life. However, this case is kind of too complicated for the level of interesting law stuff it contains. Luckily, Emily can make anything interesting.
I am curious about the phone number that Jen Abel was told that she could keep by Jonesworks, LLC, but then told no four months after she was terminated. Does that mean that Jonesworks, LLC were able to access all the messages that were sent during that time?
At 2:35:35 Emily reads " Abel's text messages were forensically extracted directly from the company phone that Abel used during her employment at Jonesworks and voluntarily returned to Jonesworks upon her termination in the presence of an employment lawyer." It wasn't 4 months after she was terminated.
That live was insane! That was my first experience with that many bots! I kept second guessing myself until the live ended. The same person that kept saying irrelevant tabloid nonsense just kept going. After everyone said bye they kept talking about the book vs movie that she's a bully blah blah.... Wild times folks.

@MSumong I felt insane. It wasn't that bad back during depp v heard - most people were pretty normal and slow to judge. This time, it was like there were 5 people at a time just spamming the same irrelevant stuff at each other agreeing back and forth for hours! It was that blake is such a 'mean girl' or a bully or her clothes were awful, she didn't read the book, even someone kept trying to say she was in love with Justin and this was all Ryan's jealousy..... while we were reading confusing text messages or discussing the PR stuff. I know they get engagement from real folks, it even tricked me for a bit. Then they accused me of being 'paid to comment all day' when I pointed out how irrelevant their gossip was! I'm truly worried for the future since I know it influences plenty of people. Its like a high school rumor machine on overdrive. It's honestly no wonder she's suing after seeing those text messages if that's the kind of stuff she's been seeing nonstop. I suppose it's too much to hope that this case sheds light on how much manipulation is on social media.
@hkandm4s23 The common reoccurring themes I keep seeing on reddit are Blake had a plantation wedding, her and Ryan are super powerful in the industry, and she picked on poor Princess Catherine. The wedding and Princess Catherine thing seem really suspicious considering it doesn’t have anything to do with the current situation and it was so long and she apologized for both things already. Most people don’t even remember things that happened over 6 months ago let alone remember them so well that they’re still actively angry enough to bring them up online in the comment section.
The line that was improvised that Justin has to say the line. It was literally pretty please with a cherry on top. Justin was the one that said the line. Not sure why he’s whining now. The screen writer also said it was a very popular line. That was it
Justin gave multiple interviews with how good Blake was and how important she was on set and she was the female gaze he couldn’t be and she would be a great director for the second one. This wasn’t just one interview. So it wasn’t just the letter. It seems like they are mad now and trying to twist reality. It seems so sketchy! She used her clothes and gave good direction on intimate scenes.
Every single one of Baldoni’s texts read like someone who is aware of how people in the work place gossip and carefully words those texts as if they might be read by someone else or shared with other people. They were too perfect. No chance of them being misconstrued or something being taken out of context by a missing emoji or anything else. I send those types of messages every day! They aren’t indicative of my moral character or how I feel or think about anything. They’re professional and they say the things you’re supposed to say and nothing more. I want to see Baldoni’s text conversations between him and Jamie Heath. I think those would paint a more accurate picture of how Justin felt. His texts to crew members and co workers are hardly any indication of anything. They were carefully scripted “I’m a saint, woe as me, I’ve been wronged but I’ll keep my chin up and take the high road etc” Even truly good people aren’t that perfect. Sometimes you can tell a forgery from the real thing because the forgery lacks any and all mistakes or errors. It’s not the lack of perfection, it’s the perfection itself. He needs to add a little bit of dirt to his good guy feminist ally schtick if he wants people to believe it.
@@AM.000 No there was a meeting so that it didn't become an official HR complaint. People from Sony and Wayfair were at the meeting which was at the Lively/Reynolds home. Interesting that reports say that Ryan went off at Justin over that (Ryan says that he didn't yell), but no reports of Ryan being protective of Blake regarding harassment. You would have thought that would be more of a priority than supposed fat shaming.

Must say that it appears that NYT had already decided on the slant that they were going with. Kjersti Flaa reached out to them saying that she wasn't involved and the correction that NYT made regarding that made it sound like they didn't believe her but included it because she reached out. If they had of actually wanted to know and try to work it out they wouldn't have included that Kjersti and Nikki were a part of the hate campaign. Poor Nikki found out that she was included in the NYT article when her TikToks suddenly had a whole lot of hate comments on them and she was getting media requests for a statement. Turns out Nikki's crime was that she went to Baldoni's preview of the movie and said that she had a positive experience while she was there. No other content related to the whole thing.

My grades in college would prove this 😂🤣 I started a new job about 9 months ago in the Transportation industry and my brain just hums doing the work and being busy all the time. I think this missing obvious answer to the questions is easy…POWER, how many more films will there be by Baldoni in the future vs job opportunities the cast, crew, film studios could acquire or be blocked from via Ryan Reynolds (and maybe Blake) She stole his project and held the film hostage to get her way. What better way than to put the fear of God into everyone by accusing him of sexual harassment, you must believe the woman these days. Who would speak up against her?! And yeah money=power baldoni $1mil, Blake/ryan $350m net worth, that’s easy math. The only reliable witnesses will likely be digital material that was not altered. People will not sacrifice their careers for him. NYT may not have known some things, but it’s because they😢 CHOSE not to try to hear the other side. Weaponized ignorance. Baldoni may have not been perfect but given how she took over, she had motive to lie, he appeared to do everything to get along. Childbirth is not porn. Context is everything. I’m also sure her trailer had a lock on the door as well.
Do you have any evidence that Ryan and Blake have that much power in Hollywood? I have seen assumptions made in comments, but nothing else. Also has there been any evidence or even rumor of them Blacklisting anyone? Or having the influence to? I've seen absolutely nothing besides random comments on RUclips videos. Being popular at the moment is not the same as having true influence. Some of the most behind the scenes people have been known to have the most power in Hollywood and some of the most popular stars have the least.

Her and Ryan are God level powerful and can vanquish their enemies using the dark arts and infinite amounts of money and influence. I’m fairly sure it started as an artificial idea and now it’s being repeated naturally by people who are either highly suggestible or lack critical thinking skills. 🤷🏼♀️

This includes locking down the script, props, wardrobe, set design, blocking instructions, lighting, etc. Changes to character choices, script changes, "improvising" can affect all of the work needed to get the camera actually rolling. Scenes are shot out of order and any delay can snowball into lots of $$$ lost by production.

The internet bandwagons hard, I learned that as an early follower of the Depp cases. It tends not to read the documents, have a short memory, and side with whoever dropped the next batch of receipt without asking if it actually addresses what was said.
I am leaning towards Blake on this one, but can concede that Baldoni made some points although I am not sure if they address the issues of harassment and whether they retaliated even if it wasn’t to the extent they planned.
Emily is the first one that I have seen cover Baldoni’s lawsuits critically though. I have been following since the Tati lawsuits and she never disappoints.

Tone is everything. I’ve personally had miscommunications because I haven’t included Emoji’s. I’ve also had online communications with emojis that have been misunderstood and I could go back and make clear the context by pointing out the tone of the emoji. Emojis are highly important in our new language. It cannot be discounted in language now because like it or not: it is A PART of modern day language!
I’ve had this problem too but it’s been with international friends because emojis don’t always translate across cultures the same.
Same. I don't like it really but when communicating I usually play "safe" with people I don't know. They don't know my tone or humour so it can easily get wrong.
Emojis are important however, I am not so sure that particular edit was purposeful because of what we have seen in previous cases.
Based on the formatting, it looks like the texts are extracts, which can exclude emojis depending on the tool and carrier. Noteably we don’t see emojis in any of the other texts which supports that theory.
So while the emoji can add context and tone, I don’t think this was deliberate, omitting the “it doesn’t matter if it’s not true” is a much stronger argument for deception

I thought that part of the issue was that the times gave Baldoni 14 hours or so to respond before it was published and they didn’t even wait 14 hours to publish, therefore not giving him a chance to provide his side of the story.
But they responded. They gave a statement which the NYTimes published in the article. So, they thought they didn't have to wait. They had their statement.
they only had time for a short statement. the NYT still published ahead of it's own indicated schedule, which is apparently against industry standard.

A critical thing you’re missing here is the power dynamics between Lively and Baldoni, one of the rare situations where a woman has the upper hand. He was the inexperienced director, and she, Hollywood royalty, an A lister alongside her husband, whose movies have brought the industry billions. And Reynolds is a reported billionaire. Lively was literally able to remove him from his own film, which should tell you everything in terms of how much influence and control she had. Baldoni wasn’t an established director, and this was his first major studio film; and Lively was able to use that to wrestle control.
So when you ask, “well could he have said no?” in reference to him and the studio acquiescing to her demands, you really have to think of it in terms of the existing power dynamics. Baldoni wasn’t in a position of power, as evidenced by him literally being cut out of the post production process after Lively went behind his back to work with Sony directly. Due to Baldoni being a male, you aren’t really considering it from that perspective though…

@@TuningAnApple @ Steve is a business partner, yes…But, Baldoni himself is not a billionaire, doesn’t have the same level of personal wealth and resources as Lively and Reynolds, nor does he have their level of influence and power in Hollywood…Reynolds is Deadpool and Green Lantern, who has made Hollywood studios billions of dollars, and Lively herself has been involved in the industry since she was a child (her family are involved in the business). They are friends with Taylor Swift, Hugh Jackman and other high profile celebrities. That Lively was able to wrestle control away from Baldoni, by going around him and directly negotiating with Sony, is very indicative of the power dynamic. I doubt this happens to a more established director. Her producing her own cut, firing production staff and bringing on editors and composers who worked with her husband? WME (who also represents Reynolds and Lively) dropping him suddenly after the lawsuit was announced, is also pretty indicative. The industry ultimately sides with its butter.
I don’t think he was in a position to say “No”. He had no leverage. They had already invested millions of dollars, 5 years into pre-production, and had investors depending on them, on top of staff who were already affected by the writer strikes and needed the income. On top of that, this movie is make or break for him as a director - His first movie with a major studio. If he says “no”, and Lively refuses promote the film, they’re forced to stop production and recast, further delaying a film already years into the making, it’s a bad look with the studio, as well as investors. (And then you have to worry about the speculation that will naturally arise.)
He COULD have said no. But let's really be real about what saying no looks like, and as a filmaker who is just starting to make films, and banking on this to be his first big film, he would have never had another opportunity to do this again. And regardless of whether he said no or not, it was NEVER going to stop her from suing him, (in fact it guarantees it), or making SH claims, especially if you dont do it her way -- so he might as well get his movie made, LET IT be successful and deal with the aftermath later. It's either that, or never get your moviebaby made, and still get torn apart publicly anyway and still get nothing out of it anyway and ruin future opportunities. He had to choose between 2 lose/lose situations. He chose the situation where he could win a little, and now possibly a lot more after she extorted him. This was clearly the bigger win of the lose/lose,

The reason the NYT MIGHT not have all the texts is that they took her version, gave him a 14 hour deadline before christmas at night (that they didn't even keep), so he had no chance to get them to them. Their play was ALWAYS to pump out her biased story with no chance for him to counter.

Probably there are, the didn't come prepared enough imo, they could've brought demostratives from te textbooks she refered to use as references on how does it look, big dog, small dog. Glass, pierce, etc.

The common reoccurring themes I keep seeing on reddit are Blake had a plantation wedding, her and Ryan are super powerful in the industry, and she picked on poor Princess Catherine. The wedding and Princess Catherine thing seem really suspicious considering it doesn’t have anything to do with the current situation and it was so long and she apologized for both things already. Most people don’t even remember things that happened over 6 months ago let alone remember them so well that they’re still actively angry enough to bring them up online in the comment section.

Every single one of Baldoni’s texts read like someone who is aware of how people in the work place gossip and carefully words those texts as if they might be read by someone else or shared with other people. They were too perfect. No chance of them being misconstrued or something being taken out of context by a missing emoji or anything else. I send those types of messages every day! They aren’t indicative of my moral character or how I feel or think about anything. They’re professional and they say the things you’re supposed to say and nothing more.
I want to see Baldoni’s text conversations between him and Jamie Heath. I think those would paint a more accurate picture of how Justin felt. His texts to crew members and co workers are hardly any indication of anything. They were carefully scripted “I’m a saint, woe as me, I’ve been wronged but I’ll keep my chin up and take the high road etc” Even truly good people aren’t that perfect. Sometimes you can tell a forgery from the real thing because the forgery lacks any and all mistakes or errors. It’s not the lack of perfection, it’s the perfection itself. He needs to add a little bit of dirt to his good guy feminist ally schtick if he wants people to believe it.

Kjersti Flaa reached out to them saying that she wasn't involved and the correction that NYT made regarding that made it sound like they didn't believe her but included it because she reached out. If they had of actually wanted to know and try to work it out they wouldn't have included that Kjersti and Nikki were a part of the hate campaign. Poor Nikki found out that she was included in the NYT article when her TikToks suddenly had a whole lot of hate comments on them and she was getting media requests for a statement. Turns out Nikki's crime was that she went to Baldoni's preview of the movie and said that she had a positive experience while she was there. No other content related to the whole thing.

Whats scary is, money can pull a lot of strings, and Blake and Ryan have unlimited amounts of it. Just hope the truth comes out!
