Hello if I want to attach PDFS , signed statements of witnesses , screenshots etc for evidence would I put them in a form mc025 or would I just submit them when EFILING ? Thank you

Hi, thank you for your question. Typically the declaration is attached to the FL-300 or FL-320 if you're responding to the RFO. Both the RFO FL-300 and the declaration tend to be filed together. A judge cannot make any new orders based solely on a declaration, without an RFO being filed. I hope this helps.

Hello, How do I prepare the MC 031 for a motion to compel to waive spouse's pdd? It is the last thing holding up my divorce. Spouse/Respondent won't give me his financials and I just want to waive our final PDD and move on to get the divorce judgement.
Tell the judge the story. Explain that you've complied with your obligations, what you've done to try to get him to comply, what assurances you have that there are no financial details that you don't know about. For instance, have you seen his Income and Expense Declarations and were they recent and did you get evidence that they were accurate? The judge wants to make sure you are protected. See Family Code 2104 and 2107: leginfo.legislature.ca.gov/faces/codes_displayText.xhtml?lawCode=FAM&division=6.&title=&part=1.&chapter=9.&article=
My document processor told me to use MC-031 instead of MC-025 if I needed more room past my MC-030. I've already turned this in, will the judge accept this? If my witness uses an MC-030 to write their statement does my information go at the top as "party" or does their information?
It seems like the clerk's office would accept the form in a small claims case. It's a "miscellaneous" form so should have general application to all sorts of cases. You might talk to the court clerk to be sure. By way of example, the MC-031 is a form that can be attached to a small claims form (the SC-105).
It's unclear exactly what kind of help you need and how much help you need. In many small claims courts, there are people there to answer questions and assist with procedure.

1. The judge will likely accept it. 2. A witness is not a "party" to the lawsuit. It will be your information in the top left corner.
