Very good efforts to explain how to read the case papers in a fast manner.Fast reading and understanding is very much essential not only for Law Students but also for Lawyers and Judges. My heartiest congratulations to Prof.Rosa for this good work.
I agreed with everything in that case. I'm suprised the father wasn't suing the hospital for negligence too. I enjoyed this explanation, it wasnt over complicated like some Law videos.
In regards to the question of contemporaneous Perception - He was at the location at the time he saw the results of the neglect and he has personal first hand knowledge of those results in which he would likely be called to testify in court. It's hard to suggest that someone could have personal first hand knowledge that meets the requirements of admissible testimony but isn't considered a contemporaneous perception... or "he didnt' see it at the time he saw it".
This is a great video. Professor Rosa.I have a question, how can we improve to translate in plain language what the court is saying? Any tips? I was amazed how you were able to basically translate in plain language what the court was suggesting. Thank you

@greatwhite8412 I don't know what you are talking about, but I have high functioning Autism and the only way for me to understand Case law is to read it myself, And the more I read the easier any theoretical Subject based content becomes, for me and remembering it word for word becomes a breeze. This was my experience and some (not all) people who take my advice become better and understand Case law better.
@greatwhite8412 Did I ever refer to a disciding factor I was only speaking about interpretation in an academic setting as a student. Seems like you are speaking from a legal professional point of view. Or research point of view whereas I am speaking about test prep
Sorry but the first question is always... why am i looking at this case? Then, is it relevant to the area of law i am investigating? A murder trial is probably not relevant to a contract dispute. The next question is, can i quickly rule out this case from my research? The catchwords can help here, if the catchwords contain a phrase or word that is similar to what you are thinking about then its likely it could be relevant.
hi, it's called "stare decisis" (latin) and is the principle that every decision in common law systems contains a sort of hard core, a rule applied to the present case, that another judge, in a similar case, must to follow. It's for this reason that in common law countries you have both laws and judiciary decisions to make the rule system. Hope i've been clear.

Stare decisis... = reasoned decision of the court.
It translates to "Let the decision stand." Meaning this decision is to be followed.
