Two things that I found problematic in her testimony:
    1. According to Sarah, they were joking and laughing UNTIL Sarah starts taking the video and mocking Jorge when he's begging to be let out. To me, THAT sounds like the overt act (on her part).
    2. Sarah conveniently can't remember taking the picture of the suitcase (and she initially said she didn't remember taking the videos), but interestingly, she can remember what she was thinking and feeling at that time...huh?

@@LaLaLonna I was shocked and confused, as well. I guess it's an appellate issue, because the standard to establish the overt act is so very very low. He was literally trying to survive and then she beat him with the bat... who is the aggressor? Who is the victim? They're really just trying to argue that Jorge deserved what he got, and the prosecution has nothing to say?

Her callousness on the stand immediately made me feel like this was the same callousness she had when zipping up Jorge. Several aspects of the narrative didnt make sense: she talked about how great and fun of an evening they’d had, so her acts weren’t premeditated, but now is saying she kept suggesting new activities to bring up the mood. Which was it? How does she explain the neighbors hearing something tumble down the stairs? For someone who can't remember she made a couple videos. She has excellent recall for the 9-minute gap. She's had 3 years to refine that story into something believable. Both are guilty of DV but she wasn't in fear for her life, or she would've fled or dialed 911. Did the prosecution think O.J. was convicted? What about the interrogation video? C'mon!!! Why is she playing with the zipper? Did O.J. teach you nothing? Sheez I'm sorry, this was a terrible day for the state.

Context, Jorge is stuck in the suitcase.
Sarah - "Please stop doing this to me! Please stop doing this to me!"
Doing what? Asking you to let him out? Even if it was funny at first, she admitted that she started antagonizing him first. That's when he started to get angry, wanting to get out of the suitcase. Yet, she's trying to say that she's the victim because he was angry that she wasn't letting him out. Wow. Ok. I think Jorge had the right to start getting angry when she's antagonizing him. This is not a battered spouse situation. This was a power situation, where she had power over him and wanted to teach him a lesson. She said multiple times that "she was gonna give him 5 minutes" to think about they way he treats her, sometimes. It may not have been an intentional act. But she definitely had a flagrant disregard for whether or not he lived or died. I bet she wanted him to die, based on what she said in those texts. The part about "I'll get rid of him."

The suitcase demo: So LYK said his mind goes to Jorge being in on the game because it took her so long to zip up. My mind goes elsewhere. He was probably incapacitated. Sarah PUT him in the suitcase, she took however long to zip it up, and then she threw the suitcase down the stairs. All of that is consistent with his injuries and the neighbours testimony. As a juror that's exactly what I would be thinking. Especially given how she speaks whilst on the stand with zero remorse, zero care, zero interest in anything but herself.

I have two theories on how he got into that suitcase, but neither of them involve playing “hide and seek”. I think either:
    1. She hit him with the bat during an argument and knocked him out. She panicked and stuffed him in the suitcase. When he woke up, she got giggly because she was relieved she didn’t have to hide a body and then started taunting him because she was still mad. She then just decided that she wanted him dead, and figured Brian would help her cover it up. Brian then foiled the plan the next morning.
    2. He passed out from drinking too much. She thought they were going to have $ex (as she mentioned) and since she was also drunk, she got mad. To play a trick on him, she put him in the suitcase, and when he came to, she just started berating him (queue the video). She left him in there out of being smug and self righteous about her amazing prank and that he deserved to have to fight his way out.
I’m leaning toward #2. I just can’t believe they would have been thinking it’s funny long enough to get that suitcase zipped up based on the time it took to get it zipped in court. I also can’t believe that two adults would play hide and seek in their own home.
I think she was abused. I also think Jorge was abused. I think they were a powder keg. One of them was probably always going to kill the other, it just depended on who got there first.

And why did she go to bed expecting him to come and join her if she was so in fear for her life, or "disfigurement".
I agree her injuries from PAST incidents were very graphic, but sadly Jorge can't explain any incidents in which he was the victim. I'm also fairly sure from what I've seen and heard that Jorge was certainly a victim of controlling and emotionally abusive behaviour. A classic codependent relationship. But again, sadly, we cant hear his side of this. RIP Jorge.

for some of the injuries there are gladly explanations.
When she called the cops on him because he "kicked her in the face for no reasons" she ended up getting arrested as well. Because the strangulation marks on his neck told another story.
      So did he.
And while her "story" was never complete because she could never remember the moments when she attacked HIM.. HIS story was solid from start to end.
Also her ex husband told how easy she gets aggressive while Jorge never had anything to do with DV before he met Sarah.
I am more than sure that her injuries are not from DV but from Jorge defending himself.

I had a friend who SB reminds me of SO MUCH. when she would get drunk she would attack/jump on/throw things and hit her boyfriend. While attacking him she gave herself bruises, scars, marks and even broke a finger once. I witnessed it all the times because i was staying with them for a while. The next day she would be crying to me, blaming him for her injuries. If i hadnt witnessed it i would have believed her.
She lived covered in bruises and marks, she always had injuries alot of which came from her falling and running into things when she was drunk.
She also always had drama going on, was never happy, it was always everyone elses fault and in her mind she was the victim, she tried when others wouldnt and she was a WONDERFUL mom (she absolutely wasnt)
