If the defender wasn't holding Klose, he might have not used his hand. Btw. after the goal Klose immediately signalled the foul by raising his arm. Nothing special for Klose. There was a similar incident in 2005 when Klose played with Werder Bremen vs. Arminia Bielefeld and declined a penalty awarded to him by the referee.

they were jumping on him before the goal so it was a foul, look he is grabbed by Cannavaro who pulls him strongly away, so its like a reflex.
