      He was going anyway...Putting this guy in drug court is a waste of resources. If he wanted to quit drinking, he would have done it by now...Even in prison, he will just go through the motions in order to get his next drink. And, the prison will stick him in a room a couple hrs a day, and call it "treatment", to get him paroled faster...Guys like him are the last ones they want taking up resources...

      ​@@brentfarvors192you obviously don't know the Texas prison system very well. I know a man that got 5 years for his third DWI. When he came up for parole, the parole board gave him what's called a "Serve All". That means he did the minimum of 2.5 years. It was 2.5 years because he earned one day of "good time" for every actual day served.

    Dang, this guy played himself. He was so certain he'd get straight probation, no treatment requirements, he'd not prepared himself for the decision.

      No. The way his atty explained it, he would get probation contingent on being accepted in drug court. Which is how it typically goes. More than likely, they wouldn't accept him because its alcohol. And, this dude is will %100 buy a bottle the first chance he gets. Boyd knows that.

    I started paying attention to what the bailiffs are doing since watching Judge Simpson. The bailiffs moved in quickly and quietly.
    They do their work in the shadows and in front of your face.

    Why do people think that because they went to college, had something happen to them, were in the military, etc that somehow that will keep them from jail? I've seen that in a lot of these videos.

      In the US the military is worshiped, it's a cultural and political thing. They do get special treatment and even have their own court system. Higher education can also help, because there is potential for those people to be contributing members of society that pay taxes. That's why you hear her ask people all time how far they went in school, and urging them to go to get degrees.

      Once you leave the military, you're no longer subject to the military courts -- barring being recalled to duty, which is incredibly unusual.

    ​I understand people are saying, "Why could she have given him a chance?" I've seen the judge give numerous people chances, but it is clear that this guy wants to do what HE wants to do.​ Perhaps he needs to learn to stop 1) being indecisive and 2) LISTEN to the judge and stop trying to find an easy way out of situations he create

    The sad thing is not that he got three years in prison by not allowing hus attorney to do talking in court.
    No, rather the sad thing is that most likely due to jail/prison overcrowding and time served, this habitual drunkard will ultimately not have to serve three full years incarcerated and upon his release, he will be free and unsupervised to repeat his drunk driving.

      If im not mistaken, He didn’t take the deal of community supervision so all the provisions he would have to follow are now null and void, including suspension. He just has 3 years prison time and then will come home and go about his life as he wants, depending of course if he does straight time or is paroled out.

    His lawyer was awful. Literally did nothing. Multiple dui offenders should not get probation anyway and should have long term parole type monitoring after prison

    Why is everyone bashing the judge? This was a felony case and the plea the defendant originally agreed to was 3 years prison which is what she ended up giving him. He wanted things his way and that’s not how it works. The lawyer probably told him to not talk but he obv thinks he is slick with his “i went to college” etc.

      Because she has no intention of rehabilitation for him. Admits the system is broken both because of prison overcrowding and no fair and due process with the drug felony court that was mentioned. She condones and accepts working with a broken system that has no interest in true justice but just the appearance of justice. If you complain she gets an attitude. She is a 🥷 sat at the slavers table. Doesn't get much lower than that. Hope that answers you.

      We don't know that the defense attorney did not tell him the possibilities. The defendant, as so many do, may not have listened.

      I agree! whether the client was in the right or wrong, the attorneys JOB is to advocate for his client! He should have at the bare minimum said to Judge Boyd, let me go over the options you just gave him briefly before he makes his decision. He stood there and did and said NOTHING!

      The attorney has to go over everything that they're about to do in court, that's why the judge asks them if he read it, understood it and signed it. Many defendants don't even listen to their lawyer so I don't blame the lawyer one bit

      Well, that won't happen! He waived his rights to appeal because the judge followed his plea agreement with the state. His lawyer seemed rather exhausted with his shenanigans and was ready to be outta there - almost like they had a heated disagreement before his court appearance. Either ways, he should've just kept his mouth shut. DWI is no joke and this ain't his first rodeo.

    Seems like the attorney could have stepped in and asked for a short adjournment to talk this over with his client. But as others suggested below, maybe he would have failed any kind of probation so better to take the jail time, and when he gets out he can start drinking again.

What I said was at bare minimum He should’ve at least said to the judge give me a moment to speak to my client about the options you have given him, he said nothing that is not advocating for your client. Just my personal opinion.

      She did..."Drug court", is more of a "program", than a court...The longer you stay, the more liberty you receive when you follow the program...Many claim jail is better...
