    Their should be something in Splice that states that any artist using a Splice off their platform cannot sue another artist using the same complete loop.

    The issue isn't whether it is "lazy writing" or not. What's really lazy is having attorneys go and sue others who use the same Splice loops that you did, hoping to make a quick buck, without understanding the meaning of royalty-free!

    Justin isn't the one in trouble, the artist trying to bring suit KNOWING he used a royalty FREE sample is really the problem. A few always mess it up for the many.

    This argument makes no sense to me. It’s basically “assholes who don’t understand how splice works might sue you so don’t do it” like wtf. Obviously you shouldn’t just make every song u sample a straight use of the sample if your creative some will be chopped, some interpolated, some straight loops and some original compositions.
    Personally I make most of my own loops, sometimes I chop or interpolate.
    But once in a while if I use a free to use (or pay to use without paying royalties ect) sample then who the fuck cares? Like this should not even be a debate. I don’t even understand this video. This guy is basically saying let this one little lawsuit scare you into completely changing how you go about making music. If a sample doesn’t need to be changed at all to get the sound you want then why change it?
    This should be a simple process. No money required. You should be able to represent yourself. And the court says.
    “Does beibers producer have or had a splice subscription?” Yes
    “Did he download this sample using one of his credits”? Yes.
    Boom case thrown out because he didn’t sample this bitch artists song he got it off splice.
    But you know what you shouldn’t even have to do that. The court should just go “who owns this sample”. The answer? The producer who made it who then sold it or it’s licence to splice who now own it and sold it to you for 9.99 a month.
    How the fuck can you sue someone for something YOU DO NOT OWN!
    If what you guys are saying is true then a class action lawsuit should be taken against splice for false advertising. They claim it is royalty free not “royalty free if you are first”.

    what splice is saying (i think) is that a Sample, A Full Loop is a Snipper Of Inspiration, in a sense that the sample doesnt MAKE the song, but it inspired the producer to make a beat on it in his way, and inspires the artist to make a song on it, in this case the producer was inspired by the loop and made a beat with it, and justing was inspired by the whole beat that HAS the Loop in it and made a song,

    If you use a loop that available for anyone & everyone to use royalty free then that’s exactly what it should forever be & no one should have the legal standing to Sue anyone for doing the exact same thing they did, period!! Artists should know if they wanna copyright something then it has to be THEIRS, not taken from Splice free or for a few royalty free dollars. How embarrassing to behave that way!!! 🤦🏻‍♀️🤦🏻‍♀️

    Some of those loops come in midi form which i recommend that way you can switch it around those that don't come in midi use cable guys halftime or just chop it up make your own sound

    Lawsuits cost so much money and you can’t claim loops as your own period! Most artist don’t even make enough money off of their songs worth suing for...in the end these idiots claiming loops as their own will cost them way more money then their song is worth. People don’t be scared to use loops..also even if you alter the loops it’s still a loop...

    Splice need to change their terms and conditions, there might even be a case of splice users to sue splice, it’s actually disappointing splice did not think about this as a company and there solicitor missed this scenario when drafting terms and conditions.. A clause that indicates that user cannot sue other users that use the same sample,

    If a sample is memorable and is melodic in its inherent nature, it definitely is not an inspiration - the intent of its creation is to be used in production purposes, so for Splice to call those specific loops snippets of inspiration is incorrect. Look, if you need a loop to make your track work, just find a loop you like, listen to it, and then LEARN how to recreate a loop similar to that, using your own tools. This way, you killed two birds with one stone - you have a loop for your track's needs, and you have acquired one or several new skills in composition or sound design.

      This takes me back to high school, when I took an electronic music class. A friend wanted to use a particular synth loop. I brought the bootleg ACID disc to class, but we struggled to get the loop to stretch properly in Logic without the ACID metadata.
      The teacher walked up like _Silly rabbits, loops are for chumps. You've got a fancy keyboard and expensive virtual synths on your desk. Just remake the damn thing!_ So he did that, and it came out pretty nice.
      Another classmate came back from Thanksgiving break with his final project: an epic "Fur Elise" trance mix which his producer cousin "helped" him create. The teacher was not amused. 😆

      The same drum loops/ breaks/ melodies have been used to create some of the biggest hip hop/r&b jams ..i.e Portraits "here we go", Digital Undergrounds humpty hump dance, and Aaron Halls "don't be afraid" all use the same drums. The songs all groove the same but are different in so many ways and do not sound alike. There's no point to knocking producers that use samples.

    Splice needs to include a piece in the user agreement that says, “producers using loops and artists using beats containing loops from splice may not claim copyright infringement on the basis of a sound provided by splice.” Not sure if that leaves any legal holes or not but there’s gotta be a way to write that in. Maybe, “loops provided by splice are available for commercial use to all good standing splice users and therefore all good standing users enter into a legal agreement not to sue for copyright over projects containing shared splice content”

    The truth is as a Producer we can't deny that working with loops and samples is a Game changer but lets try to resample, change pitch and alter even if its just a semi tone up or down it could swerve the artist from trouble...

    Weird how similar the vocal melodies are. This is a situation where PRO’s will not pay anyone; if they can’t find he exact owner and if its from splice or construction kits; they wont pay royalties to anyone.

    How do you view drum loops on splice that have no melody or no signature sound but its a loop of kick and snare and hi hat for instance in a rock pattern, or swing pattern, or hip hop, etc. how often do people make copyright claims on a pattern?

    There needs to be something put in play in order for someone to be able to use loops and not run into this issue. Sound is sound, it’s a fun starting point and a quick way to gain inspiration and let a vocalist do their thing. There are no rules in music but there sure as hell are laws and regulations in the music industry. It’s funny how Laxcity could care less about the use of the loop, though what I find the most interesting is you stated Laxcity had used this loop for his own song. Some digging would have to be done though if he registered that song with that same loop then he’d been the first person to own the copyright to it. So how is it that the third release (that we know of) Asher Monroe could claim he is the owner? Leading to another interesting point, this is a first come first serve basis. Whoever is the first person to copyright their music (since on ASCAP/BMI, SongTrust, Sound Exchange, etc) all have time stamps on it, can claim a royalty free loop as their own. To be honest, and I’d love to get your opinion - a solution would be for anyone giving out samples/loops to also include their BMI/ACAP IPI (May have the wrong acronym) and they can give them 5%, 10%, 15% + etc. This is almost comical because Laxcity is the originator, he created this and doesn’t care at all about what’s going on. Then you have this guy looking for a quick win like come on man, ridiculous. Whoever created the sample/loop in the first place should have the final say and a solution to this would be they simply register the creator along with the song, everyone gets paid and no one runs into legal issues. What do you guys think? 5%-30% seems pretty fair to me if you’re using a loop and everyone involved wins.

      Next, if the record becomes big, I'd suggest some formula to count the royalties, e.g. Track lenght / recognizable sample lenght / number of creators involved in songwriting and production. If sound engeneer have made any creative decisions in the mix, then he also counts as a part in creative process.

    You CANNOT copyright any royalty free loop you use from splice. You can only copyright the composition you create using the loop in whatever capacity... and if you don't like using splice or samples.. then don't.. knocking people that do is a waste of time.

      I'm not knocking anyone here (other than perhaps the artists that are throwing these garbage legal demands around). You're right - you can only CR the entire composition you create WITH the loop included - but that's not stopping these C&D's from being sent out (and wasting people's time & energy). At the end of the day, we are each responsible for our own actions and how we use loops - I'm just reporting the facts.

    very good points in the video, now there is another way to see it, lets hope there will be many cases in law for this kind of free samples or loops and maybe courts will be fed up and oblige sites like splice to mention that noone can sue for royalty free loops. It is a waste of money and time for useless cases tbh

    Great podcast on not using some Particular Loops without Altering it. And oneshots, some loops sound really great to create an entire track around it, but as a music producer ,what i do is do my best to create an entire new feel around that loop and hope that it is royalty free, and its not sort of a setup to be in lawsuits, smh.., i like loops and depending on the kind of loop, no melodies loops, if i use a melody loop i want change it by adding more feel to the melody with a different instrument that flows with it and altering the key. To avoid all of the hassle ,if any, create our OWN MELODIES BY LAYING HAND THE KEYS AND CREATE SOMETHING THATS CATCHY FROM SCATCH. Thx Jesse greaT INFO!!!

    Continued Sage advice brother. Funny that all these artists, and ESPECIALLY for a creative team like Beibers , that they kinda got lazy and just used a straight loop for the beef of the track as opposed to diversifying it knowing that anyone IN THE ENTIRE WORLD can use the same stock sample. Puzzled on that move.

      Many times the artist has no clue where the producer is getting his/her samples/loops from (this story might inspire some artists to put some "quality control" tactics in place). The artist just listens to a bunch of pitched tracks, select the ones they like, and then start writing to them.

      just listened to the song, and the Loop isnt the problem cause the beat is different, the flow of justins song is the same,
      the same rhymes were being used in the verse, and kind of the same flow

    A WHOLENOTHER PROBLEM is that that loop is very close to being just an arpeggio, and u cant copyrihgt a chord progression. and an arpeggio is just a chord proegression played out in step like fashion. If u really could copyrigth an arpeggio so many rock artists would have never been aloud ot exist consider how many arpeggios are literally copied from others

    Well there is more then a hundred older artist that actually played their music and still they all come out with similar style and melodies and that’s with actual playing of instruments. It’s bound to happen you only have so many notes and variations to go with.

    Don't get caught up in fake news ( Remember Iggy I. and the list goes on ) ... same stuff different day. Also that melody has been used thousands of times just like many others before it ( as it is being downloaded as we speak). Unless you made money then there is no money to be made in a lawsuit. I agree with you on how to properly handle a sample "if" you were to find yourself using one but best bet is to "create your own" .

      That's exactly the issue. If you use a pre-made melodic Splice loop and make money from Sync Fees & Royalties then another artist could demand you pay all proceeds to them. This is what is happening to the Library Owner I interviewed on my channel.

    There appears to be no legal problem as Laxcity doesn't seem to intend to sue. Lazy writing? Yeah, maybe. We all should try to stay away from melodic loops anyway, bury them deep in the mix and/or always throw another melody as counterpoint.

    Just because there is a lawsuit it doesnt mean that he won, if he did I didnt know about it. Anytime there is a hit there is always a lawsuit, it just happens, it doesnt mean that they won or will win. Anyone can file for a lawsuit and have the court proceed with the lawsuit or throw the case out all together. It doesnt actually mean that there is anything wrong with sampling from a sample broker, and not altering any of the sounds. Justin isnt taking that L. I can bet on it.

    What about samples like a kick,hats,claps, uplifters,downlifters,fills? Not loops but one shots,,i cannot use those? Or i can?

      Those are usually safer than melodic loops.

      Drum sounds/loops usually don't attract these kinds of legal problems. It's mostly recognizable melodic or vocal loops.

    I don't think this would have clout its juts a cash grab and intermediation tactic for money. if u purchase it it's yours to do as u like the disclaimer saids that & royalty-free clause is stipulated by law splice would be liable not the producer. Fear-mongering at its best.

    Okay! So thank you for this. I just got off the phone with a distributor who was advising me against using a loop because of the strike headache. He suggested that I get the melody remade by a guitarist, im going to go this route and have him use the same chords and change any Melodies in the original. I also use this as a base then add my own Melodies on top. Hopefully this should work?

    it happened to me two days ago with a sample that I had taken from splice, I opened a dispute to you tube explaining that the sample is royaty free, I hope that it will be resolved.

    No, neither JB, nor his legal team will have trouble. In fact i hope he gets sued so this creates a precedent for these cases in special. To frame it like 0:32 is a joke tho.
    its OK to be aware of possible issues. its imo not OK to frame and go full panic mode.
    as you mentioned in your initial video, this will not hold in courts. its an annoyance for indie artists though.

But in this situation it’s going to be hard to win this sue against Bieber because they used a sample aka loop that’s royalty free and it clearly states that on splice website. Yes you sue for anything BUT that doesn’t mean they are going to win or hell even has enough evidence to take it to court. Heck even a lawyer had to see if he/she has a case anyway.

    Splice and loopcloud Is not first come first served no point artists and Dj s getting lemon about it they know if they use a sample/loop that anybody else can use the same loop as long as its been purchased legally via loopcloud or splice otherwise whats the point of these sample sites it would be laughed out of any court so keep being lazy and fill your boots looping your tracks up

    Ok listen,samples of songs have always been used in the industry and samples need to get cleared. Ice cubes "today is a good Day" was sampled from the Isley Brothers it had to be cleared but,he "Ice Cube can't claim ownership unless someone stole his lyrics because he did not create the sample. Splice need to have something to allow people to use it but,can't claim ownership because they put a song out with a loop they did not create. What of it wasn't royalty free and you had to pay to get it cleared? Many people wouldn't use them if they had to come out their pocket and give ownership to the original person who created the loop.

    ALL The beat selling platforms should have a "Shazam app" type feature. When you upload a beat to sell to artists, it runs through the list of registered music to prevent this. I think Beatstars has this feature. I might be late.., and they all might have them by now.

    Don't see any problem,3 different songs of 1 sample!And laxity is the only one writer and owner of the sample and has an agreement with Splice so.....Just a few crappy artist wanna make money out of justin biebers wealth!Its not because somebody, use a sample earlier then anyone from the same sample provider(Splice)that makes the sample or loop exclusive for him/her to use only in his song/track!!!!

    As a producer or beat maker it is up to you to actually add some creativity and flavor to the loop by altering it and making it your own. The loop should just help kickstart the beat. it's for when you lack inspiration. If you are going to make beats with loops that everyone is using learn how alter that beat in pitch, tone, BPM, filters, eqs, reverse, reverb, chops etc. You shouldn't use the raw loop like that. C'mon beat makers and producers stop being lazy!!!
