    This video has old school Comic Misconceptions vibes that a lot of you have been wanting to see again, so I hope you like it! Definitely not how I’d write this video today. For example, I know the topic of criminal justice is a BIG one, and I didn’t really touch on it much in this video. Kudos to the original inventors for at least recognizing that rehabilitation is important, not just punishment. Free pizza might be silly, but at least they tried _something_ y’know? More bigger videos to come in 2022! Just wanted to squeak this one out while the stars aligned.

    While this is still an awful way to "solve" the crime problem, it is in my opinion the best thing ever invented.
    It's better to keep low offensive crimes stuck at their own homes than in jail at list.
    Jail can easily brake a person and while we all learn what being stuck in your house feels like, you can atlist relax withing the confines of your own home

    • @bethanychomiak1399

      You have a point that this keeps people with non violent crimes out of jail. However, may I suggest broadening your knowledge on the topic? If you are in the USA the book "The New Jim Crow" has a chapter about how this does not solve the mass incarceration problem because of the loss of civil rights faced by anyone with a felony record past or present.

    • @Gatorade69
      @Gatorade69 2 года назад +17

      @@bethanychomiak1399 Yep. I have a felony for marijuana in a state where it is now legal. That felony has hurt me so much, for something now legal in the state. Having a Felony on your record really restricts you from moving up in life and keeps people down, down where they might turn to a life of crime (either for the first time or again). To me it has led to a life of depression. I have never in my life committed a violent crime nor have I ever hurt anybody, it definitely isn't fair, especially my friend who's brother is a cop getting off of his charges of bringing a loaded shotgun into a restaurant and holding people at gunpoint. The whole justice system isn't fair.

Anyway some racists in the bar he had been drinking in were talking shit (His mom is white and his dad is part hispanic , he got some recessive genes or something because he ended up having a darker skin tone). After giving him a lot of trouble he went to his house which was just down the road a bit and grabbed a shotgun.
      He came back into the bar and pointed the shotgun at the racists and threatened them. Personally I don't think he would have shot them but Xanax makes you do stupid shit. They ended up running and getting in their car and he decided to give chase. The end result was a crash and police involvement. They also found marijuana paraphernalia in his car.
      When he was taken into jail they found out his brother was a cop and took him out of general population. His brother then got him out pretty quickly, he didn't really serve any jail time. He had two pages of charges, numerous felonies and misdemeanors (including a DUI). He was charged only for a few misdemeanors.
      When I compare it to my case... I really got the shit end of the stick.

"Hey maybe we should encourage people to be better instead of just making their lives hell if they commit a crime" is at least a good start on that path, i guess?

      @@DarkSolidity Of courde they do, but that's not the point. Applying "revenge" as in - you gave suffering, now you suffer will actually only encourage they continue to be a criminal when they get out.
      And we can't really leave everyone locked until they die can we? So that's why ways of guaranteeing the criminal stops being a criminal are, in the end, more pragmatic than simply locking them in. In the long run, it's better for management, even if they don't "deserve it" (which they don't)

    • @DarkSolidity
      @DarkSolidity 2 года назад

      @@marxist-leninist-protagonist obviously the punishment should fit the crime but you’re being too soft, the victims deserves more. How are you ever going to disincentivize crime if you’re handling criminals with kid gloves. When criminals realize you’re not going to do anything they’ll continue committing crime & escalate their crime. Which we are seeing play out right now, violent crime is spiking because police can’t hold criminals. They arrest a criminal and they’re back out on the street on the same day. You disincentivize crime buy making the punishment unacceptable and making examples of people who choose to hurt other people lives. You have an argument for non-violent crime. But I believe in throwing the book at people who hurt people. Lock them up for as long as can be let them be resounding examples to anyone who would victimize and hurt others and make them thick twice before committing such an action.

    • @mastere6115
      @mastere6115 2 года назад +3

      @@DarkSolidity yes, locking them up is fine, especially for those who hurt others, but when they are in there those ones would also need to assistance to change like those who where non violent would get. Yes they did something bad, in some case something awful, but in the long run helping someone to change will help far more than making them stay in a place for years doing barely anything with no help to get better at all.
      Kinda why I think that as you and the other person pointed out, non violent could be one that is treated in a non prison help way, and violent could be in prison but still receiving help to get better aswell, just in an environment they can't hurt others when they are learning.
      Obviously not everyone will change but it's got a better chance of change happing than ditching all people who may have made a mistake and gotten violent, or even those who don't see it as a mistake.

      @@mastere6115 I agree with everything you said, I think this is why a lot of churches have prison outreach ministries. To give some semblance of life to prisoners so that don’t become out of touch with society. I guess my concern is these ideas tend to erode the justice system if applied poorly, which we’re seeing working in a lot states at the moment with spiking violent crime. I agree as long they’re treatment comes while they’re serving their time, I don’t think support groups would be a bad idea after they’re released as accountability is a big variable in preventing convicts from reoffending. But I don’t think we actually disagree on anything.

    I watched your nebula discussion about your concern about the politics surrounding ankle monitors. But I don't think the use of ankle monitors is particularly controversial. I went to law school an hour North of Roanoke at Washington & Lee and worked in a clinic assisting inmates at the Alderson Federal Prison Camp in WV. All the inmates I met were eager to serve as much of their sentence as possible on home confinement. They might not want to wear an ankle monitor, but they would rather wear it then stay in prison, even a relatively comfortable "Club Fed" like Alderson. Ankle monitors are the technology that makes home confinement practical. There can be controversy over which inmates with which kind of convictions should be eligible for home confinement. But that has nothing to do with the technology.
    Home confinement is in the news this week though. In 2020, a number of federal prisoners were released from prison and placed on home confinement due to Covid. The Trump Justice Department Office of Legal Counsel (OLC) issued an opinion that at the end of the Covid "emergency" those inmates should be returned to prison. The Biden Justice Department OLC issued an opinion earlier this year confirming that the Trump era opinion was the correct interpretation of the relevant law. But after much lobbying the OLC revised that opinion and said the inmates should not be returned to prison. Of course none of that actually matters unless and until the emergency is over. Malia Obama is likely to be in her 2nd term as president before that happens.
