BC carjacking victim left in disbelief with "catch-and-release" system

  • There are more questions and anger about B.C.'s so-called "catch-and-release" justice system over the case of an alleged repeat offender.
    Asha Makwana was a victim of a carjacking in Victoria, B.C., on Monday, which ended when the suspect crashed into two vehicles.
    Seth Packer was charged with robbery and theft of a motor vehicle. It was his second arrest in two days on charges of trying to steal a vehicle.
    After making a court appearance, Packer was released, despite Victoria police asking that he be held in custody. Just a few hours after that release, Packer was arrested again, accused of stealing a wallet from a home and allegedly trying to steal yet another car.

      The politicians and the judges who let this happen are the true criminals. The police are doing the best they can, and honestly, I feel bad for them.

      Probably more to go with the judges. Also these laws made to keep cost of incarnation down (but also strains policing with repeated responses). So more money needs to put in that area too.

      It's not the politicians, it's the people. Their soft tolerance on criminals and drug addicts has allowed the problem to fester. They happily pay their taxes to politicians to allow such criminal behavior to exist.

      We need the community to intervene. They need to consider hpw this criminal activity makes them look? They know the issues and the people doing these crimes. How did islamic extremism get handled? By community intervention to a large part. This criminal behaviour is now staining those communities reputation in the eyes of some i fear, and these communities can now make the decision to intervene and stop this behaviour by helping those who are willing to be helped, and sending those who wont change off our streets. Unless they like being mislabelled. Just my opinion.

    The judge even went against crown council's recommendation to keep him in custody. That judge should not be anywhere near the justice system if they're that incompetent. They care more about criminals than public safety.

I'm aware that the Canadian Criminal codes are weak, but Justin Trudeau is not solely responsible. There was a revolving door of criminals who commit all kinds of midlevel offenses that get punted back out without seeing a day in jail/court long before he was Prime Minister.

    See what happened to that poor Mr Zameer here in Toronto, and a police officer was accidentally run over. These things happen because the law is letting law abiding citizens down. Carjackings and other crimes are on the rise big time, and no one is prosecuting and putting these dangerous criminals in prison. What is happening in this country, that law abiding citizens aren't allowed to live in peace?!

      Maybe the parents, relatives and friends need to get involved. Nothing like abit of an ultimatum and an offer to help change one's ways to keep someone from keep going down the path of a criminal. Islamic extremism used to be a problem, community members helped handle that by reaching out to the people in need of help and enforcing good behaviour. It was better than some people beginning to think badly of a whole group because of the actions of some bad apples. Just my opinion.

      @@ellomate.. We have to start somewhere. Even gang members have non gang friends and families in many cases. Also citizens arrests are okay i hear if its safe. But thats based on the situation. We at a community level have to have a much lower tolerance for criminal activity in my opinion. But we also need to address the real causes so those who continue have no excuse for their bad behaviour. Just my opinion.

    Canada needs its own 2nd amendment type laws Law abiding Canadains need to be able to carry weapons for self defense this should include pepper spray and tazers and firearms. Clearly, the police and politicians can't protect us its up to ourselves. Canada needs its own stand your ground laws and castle doctrine !!!!!

    The driver road test should have locking the doors on the test, like putting on your seat belt. Car jacking and big rig highjack has always been a threat. Lock your doors at all times.

It is grounded on the premise that the commission of three serious offences is severe enough a circumstance to warrant an extenuating punishment. The government insists that the "three-strikes" reform targets only the most dangerous, high-risk, serious offenders. It also maintains that the DO designation would be applied only if an offender could not effectively dispose of his "three strikes" burden. Moreover, the government maintains that the reform complies with the Canadian Charter of Rights and Freedoms and that it will enhance the law's ability to protect Canadians from dangerous criminals.

    It's not the policies, it's the lack of staff in the justice system. It's the poor education system. It's the lack of a good legal post secondary institutions. Canada is still ripping off the indigenous, paying for lawsuits. Can't change legislation fast enough to make it a truly equal nation.
    The court houses don't even have the space for the number of cases to be heard. Much like the medical system, it is not keeping up with population growth. Immigration isn't helping.
    Due process works well when you have the capacity. Many don't believe in the rules anymore. Flags cussing out the prime minister and he can't get a clue. These flags don't happen often if ever.
    In a democracy one should only be able to point inward.
    The release wouldn't be for so long or at all if ther was staff to take the case. There is a rule that a case must be heard within a certain time frame. Many get off because that time passes. Holding them and then figuring out that they were innocent is a huge setback for everybody and not justice.
    Was it a joy ride or grand theft auto?

      I was attacked by a random man on the street over a decade ago. I don't know who was in office at the time but it definitely wasn't this Liberal NDP coalition, and wasn't Trudeau. I was taken to hospital by ambulance to get stitches. The guy was released before I even got in to see a doctor.
