    Our legal luminaries souting loudly after six years "where is black money" It is first converted from 1000 denomination to 2000 denomination and unearthed from bed rooms and bathrooms ,bank lockers of bada babus .Ask RBI how much money was deposited by IT dept after raids in the past two yrs across country !

      😀 .. 😀 .. mere juggling of the words & doing drama will not reach anybody in the vicinity of truth ( dimensional ) by any mean though it may sometime works if situation remains in control of the actor (this time it's different situation that why he started fumbling after having a straight question from a judge where he was tried to tweak) .

    If RBI has no control over currency it is simply printing press why we call it Reserves Bank of India . After all it is just printing press.

    Like EC appointment where you people want CJI to be included do you people want on every RBI and government issue CJI should be included!? Pass orders that all decisions any institution should take SC permission before doing anything. So much precious time wasted on a irreversible thing when crores of cases are pending. It's same with recent Maharastra problem. Wants to take AP split problem now when everything is lost. Not took the case on time and AP lost everything but want to adjudicate now!?

    RBI shouldn't exchange old currency, the black money hoarders can just give some commision to poor to have money exchanged in their name. This was thought during note ban time also, people with cash amount below their income combined could exchange it easily, but with black money would have to explain where did extra cash come from if documents they have lower amount.
    some rich owners of black businesses gave money to their workers that time to exchange, some just straight out burned money because they couldn't explain where did money come from. Only people angry about demonetization are black money hoarders.

      But both are related. That's the spirit of that provisions. Simple logic tells that as far as the tenders remain legal they will enjoy govt's garanty.

      @@sbos79 Sir, the promise on the notes is made by the RBI and therefore it is the liability of the RBI to pay an equivalent amount of money to the bearer of an old note, a soiled note or the currency pulled out of circulation by the RBI itself ( demonetization). In the present case, the Central Govt chose to demonetize the currency and announce it to the public as an event of immense concern in a surprise announcement. As concerning the public , the promissor is the RBI and not the Central Govt. It could be assumed that the Govt acted on behalf of the RBI- the sole monetary authority. Where is the question of guarantee by the Central Govt in this case. I think the RBI alone bears the responsibility for the whole episode.

      @@kaypee9187 RBI manages money on behalf of the govt. It works under the govt as an autonomous institution which was given task to manage money & time to time were allowed to takes policy decision to micro-manage money. But in case, govt through its finance dept takes any decision that has bigger implications then it was bound to execute & take policy decision on their own to comply with it . Juggling with the words will not change this fact. Otherwise the autonomous institutions can do anything & raise conflict that could paralyze the decesion of the people (in democracy govt is people's representative) & thereby developments. That's why govt brought rule (not RBI itself) which formed a guideline by which RBI could start functioning. So the promissory note of the govt was given through RBI & after that it was taken back by the govt on the basis of a specific policy decision (demonetisation of certain tenders within a specific timeframe) which was the example of exceptional case (not regular case otherwise it would face a severe trust issue).

      Sir, the RBI is the Govt. Banker
      The RBI also is a Regulatory authority of the Banking system in India. A move such as demonitization of currency has major effect on the economy and must be done carefully. While the reason for demonitization maybe political and well meaning. The decision must be made on facts connected with efficacy of implementing it. The role of the RBI is also to caution the Govt, prepare the details of the notes to be demonetize and a plan to implement the scheme. We all know what happened actually.

    Does this not limit the subjects on which statutes and their enforceablility in such subjects of importance to the nation and the trade and public. Its a technical subject which cannot be disturbed by political parties without report from Reserve Bank. The FM has to depend on reports of RBI and not vice versa.

    Only argument against demonetization is that it causes inconvenience
    while pros are : people now opening bank accounts to keep money safe,
    digital transactions push, black money hoarders just left paper with no value

    The liability of the government should never extinguish. It is not the birthright (to act on a whim), of the government but the tangible possession of the person. The government may charge a late fee to cover additional costs (or may not. Afterall, they did not compensate the citizens for the enormous hardship caused by this ridiculous notification).

    Impressive argument made by Senior lawyer Shiyam Diwan more enough to reject the argument of Mr.Chidambaram. Bench now convinced after all questions posed were convinced by sound argument by interpretation of law. Demonitisation law will be upheld.

    Money or Currency is the exchange consideration for Human Hardship! In case of the Currency held by an individual denial to honour the value of such currency by the Guarantor would be breach of trust! Alternatively, the Government has no power to nullify the accrued exchange consideration in the hands of an Individual. Voidance of the status of Legal Tender is Passe.
    In short, any or all currency notes issued by the RBI shall remain guaranteed without any time limit. Human Hardship is protected aptly under the Constitution.

    If space in between the law is exploited by highly paid lawyers then what Rajeev Gandhi did in SHAH BANU case and what Pravan Mukherjee did in Retrospective Tax is justified -- Courts should hear case keeping larger interest of the country in mind.. Courts should not be play ground for clever lawyers.

    Ban the use of english in All level of courts in India, for this is looking as an English court, when will the judiciary evolve? Carrying legal duties must never be allowed in the language of the oppressors of India in this rapidly developing nation of Bharat in the twenty-first century.     Is the counsel arguing that the govt. in power cannot dictate to the Reserve bank on demonetisation or exchange as pokiticians so not have economic expertise that is expected from tbe reserve bank. It should be indenpendent of the Govt. in power in such decisions as the economics of the country is prior.Infact the economic policies and announcements ofht to have approval of the Reserve Bank .Almost like the SC on the validity of law and rules introduced /powers excercised by the Govt.

    Even if the negative , the loss to our country, to Indian Citizens are proved also, do our SC have the power to penalize RBI or dismiss the RBI Governor, If so , please may do it. Minimum, implement the basic aim, penalize the people who had deposited the currency, 20 lakhs and more, which to be considered as black money. When all major business were happened through bank transactions. Otherwise, we ordinary Citizens stands as fools.

    How come SC Lawyers are expert in Neuro Surgery to Space technology including world economics .. This is strange -- despite so much argumentative justice delivery system, our country is full of corruption and " RIGHT TO CORRUPTION " may have to be added as Fundamental rights it appears ..     I am not a lawyer and for sure didn't understand all the nuances in the arguments made by Shri Divan, but I feel he got a bit repetitive with his own argument of whether the government's guarantee survived the cancellation of the status as legal tender...
    Even AFTER he was asked to explain it in light of the provisions of Contract Law by Justice Ramasubramanian.

    As a layman, one felt that Demonetisation was anti-poor, anti-daily wage earners and anti-farmer. In the first place it was not warranted. It has not achieved any worthwhile.Further, the Government was very ill-advised.And also it behaved arrogantly and ignorantly in its implementation .

    Mr. Diwan is trying cleverly to hoodwink the basic question in this case "whether the PM was right in declaring the 500/1000 notes as not legal tender without going thru the due process".The SC has every right to examine this issue and if it is proved the due process is not followed prior to the declaration by PM,, it can strike down the demoni-
    tisation as illegal, and all other arguments of Mr. Diwan will fall to the ground.

    Why does the Top Court think that Central Govt cannot even suggest a measure like demonetisation? or devaluation ? This is not practical. Again on the contrary, the Central Govt has authority to overrule any recommendation of the RBI. What is intriguing is Mr Chidambaram requesting the Court to pass a law so that such ’ misadventures’ are not resorted to by the Govt. This is horrific that the Court is asked to pass a law perhaps because Congress has no likelihood of passing any such law in the Parliament. My hope is that the Court will not take the bait which is not its right to do so ,opening another round of confrontation with the Govt. Let us end this case without much further ado

Is Kashmir like killings happening to muslims in Hindu majority area!? Being in 95% they don't allow others live let alone weak, divided and non aggressive Hindus.     No use of wasting time. This is an open and shut case.Central government has the power as per the constitution and rbi acts, central govt is the sole custodian.Central government never said it will not guarantee the value of the currency. They gave resonable time. Only the thing blck money holders couldn't make their black into white.This case is petitioned by chidambaram so court has enough time to waste. Where as if it would have been a comman man. The court would have rejected it by telling wasting the valuable time of the court.
